Now these are the "US versions," which I now need to ask the board two questions: 1) Are these illegal to own now since ol' Max got tossed in the shitter for one of them, and 2) Is there really a difference between the US version vs the European versions? No, they are not illegal to own. It is probably illegal to sell them across state lines or to use the US postal system to deliver them to a buyer, though. My understanding is the 'European' versions contain pissing. I'm not sure if there is any other difference, since I've never done a comparison.

The only issue that could cause you problems are if there are underage actors/actresses and you are aware of it. In that case you'd be guilty of possessing child pornography and you could be arrested and charged.
Since "Max" was tried in court for distributing obscene material, not creating child pornography, I think it safe to assume that the adult status of the performers is not in question.

Not illegal to own, quit worrying. I remember in the 80s picking up all the Traci Lords tapes at a local video store when I heard she was underage before they pulled them from the store shelves. No one cares. Distributing it is another matter, that can be a problem depending on what you do and where you do it.
In the US versions, when you see a perky, fresh-young girl happily humping away one second, then the next second you see mascara running down her chin, the residue of what appears to be flecks and chunks of vomit around her neck and pooled in her lap, her blouse absolutely drenched from some unknown, vaguely yellowish liquid, coupled with a dead-eyed, ten-thousand-yard stare on her face... you'll know you've just missed about 30 minutes of pure, unadulterated hell for the young starlet. In terms of legality, as max himself pointed out in his recent interview, it was a Euro version of his flick that got him in trouble, not the american versions. And it was because--it's my understanding--because a Euro version was ordered and sent to an extremely conservative community, thus violating the "community standards" of said community. As incredibly extreme as the flicks are, I'll bet there are vast swaths of the country where he absolutely would not be found guilty of obscenity. So I suspect that you can pull those flicks out and have at it.
Yeah. If they didn't cost you anything, just shred them and throw them out. They may not be technically illegal (yet) but there's always the chance they could be in the future. Not worth the risk, IMHO. And don't try to mail them or distribute them in any way unless you really have a hankering for confrontation with the authorities. Besides. you all forgot to mention that not only is there pissing and vomiting in the Euro editions but there is "Fisting" and that along with the urination got him put in jail down in Florida. i can't imagine a day when owning a copy of a max hardcore dvd would land you in jail so hold onto them if you like them. to believe otherwise reeks of red scare demonization and intimidation tactics as well as paranoia by people who probably hate max stuff on religious or because of their definition of decency (even though we are all here in a PORN DISCUSSION FORUM for which 80% of the population would call all of us SCUMBAGS. if we reach the point when cops can break into your home and throw you in jail for pulling the pud to a max hardcore dvd you better also watch who you talk to and what you say on phone calls. and while you are at it never criticize your president (or any politician) or complain about the military or police in public or on the phone etc. etc. etc. keep your 20 Max's and enjoy them or not but don't freak out as if it was a pound of weed. I honestly think what got him put in jail was the fact that the didn't really hide the notion that he truly seemed to enjoy making these girls so often seem incredibly degraded and abused. The kink.com studios in San Francisco has a whole line of pissing (don't they even own the domain pissing.com?) and fisting is a regular feature of many of their BDSM sites. In fact many woman are fisted while being tied up. Yet kink takes great care to promote the idea that everyone is having fun; the post-shoot interviews of happy participants are there for a reason. An I'm assuming that the folks at kink run every thing by lawyers well ahead of time... The Catalinas and Laylas of the max world aside, there's a reason why it seems like the vast majority of Max's girls had their first and last porn experience on a max shoot, yet at kink the girls keep coming back for more.

Ask a lawyer....not sure any of us porn fans can tell you what is and isn't legal to own. But the last I read, ownership of obscene material is not in itself a crime in most states. Disseminating such material by any means, including merely transporting it from your home to someplace else, may get you in trouble if caught. A good example is our backwards friends in South Carolina. In SC, its a felony if you are caught in the act of "buggery" of "whether with mankind or with beast," but there is no penalty associated with ownership of obscene materials...just dissemination of same. I'd imagine you need to check with an attorney licensed in your home state. But if it costs you legal fees to feel better, I'd say destroy it and sleep well for free.

LnL i agree about the lawyer solution and agree that if its "too hot" for any one individual just dump it. unless Rick Perry wins in November 2012, i'm keeping my porn stash and will sell or "donate" most of it to a local store if push comes to shove (as in Perry becomes W Bush X 10 with the moral police) rather than sell it online. We'll all see soon I guess, Texas has effectively outlawed abortion and closed down most free clinics while labeling them as "abortion factories." So I suppose, like RandomPrecision says "anything is possible."
In that case, you don't have to think of it as totalitarianism. If you wish, you can think of it simply as mob rule (AKA Democracy) and the outcome is the same. If the majority hates you (for whatever reason), don't press your luck. You might not have noticed but these days in the US, prison is a much better business proposition than porn. Whatever the case, the powers that be obviously didn't like Max too much. It's a safe bet they don't have too many warm, fuzzy feelings for his audience either. This is just a public service announcement for those who didn't fully understand the message that was sent when they tossed Max in the slammer. They'll go after anyone they think they can get. The people who were behind Bush and his buddies are apparently out of power for the time being. If there's one thing I've learned over the last 20 years or so about the political landscape in this country it's that appearances can be very deceiving. Never assume if you have something to lose. Unless you're assuming the worst.
