So I'm making a post on craigslist trying to find a female to make a pov porn.

What exactly am I allowed to put up there so I don't get in trouble with the law?

If it's an explicit post saying this is for a porno and pays $500/hr, is a one on one scene, is shot in my home, etc... am I gonna get in trouble or arrested?

Or should I keep it vague and say this is for an "amateur erotic video" without any more details? Can I mention pay in the post?

I have no idea, lol. I definitely don't wanna go to jail for soliciting prostitution or something.

You're not allowed to put up ads for paid sex, so how would this be different?

If anyone could advise that'd be great!

You can talk about the legalities here, but you can't actually solicit/promote the hiring of someone for paid sex services.

I apologize I honestly didn'tthink this would be a problem at all. It's anporn forum I thought it would be ok to talk about making porn.

Not interested in hiring or talking about any current porn stars or anything like that.

I'd suggest you read up on Canadian pornography law before proceeeding. If anything is still unclear consult with a lawyer, make sure they are not knee-jerk anti-porn or anything.

Unfortunately the last time the Conservatives were in power they passed laws that rolled back the more progressive sex worker rights rulings of the courts but under the Liberals the focus is on child exploitation and actual sex trafficking from what I've seen. Although there are those out to exploit legit concerns about trafficking to roll back sex worker rights even more.

Don't forget that some of the biggest internet porn companies in the world are now based in Canada with little to no flak although most of the content is still actually shot in the US and Europe. I can't even remember the last time there was a prosecution for consensual adult pornography in Canada (the 80s or early 90s maybe?) and it is shot all the time in Montreal for instance.

My understanding is that there shouldn't be any issues as long as you are appropriately vague as they would have been back in the 70s but I haven't read the statutes in a long time and I'm not a lawyer. At a quick glance unfortunately there is still a lot of vague language in the Criminal Code regarding what obscenity and solicitation of 'sexual services' actually means.

I do get the feeling that posting to craigslist may be asking for trouble though, if your town still has an alternative weekly advertising in their backpages may be the better move.

Obviously doing this in the middle of the current Coronavirus crisis isn't a good idea either.

My advice is to find lawyer in your area that knows about this and ask them. Who knows when an overzealous religious politician/attorney general might use you as mince meat.

The religious right in Canada doesn't wield that kinda power in Canada, quite the opposite in fact, particularly with the current government in power. But I agree about consulting with a lawyer.

Good question, I didn't see anything indicating there is but again I'm no expert, just relying on my Google-fu and my reading of books on the history of pornography in Canada, of which there are only a few.

I do know you can't be prosecuted for mere possession of obscene material, material evidence of child sexual assualt excepted. The law as written and the law as enforced are two very different things, an unfortunate hypocrisy. In general almost all the pornography produced in the US, straight, gay, etc. Is widely availabke in Canada.

The Border Service can confiscate material it judges as 'obscene' but that has no reprecussions on the person it was being mailed to (again child sexual assault material excepted). In general that is material featuring piss, defecation, puke, bestiality, etc. It used to include material featuing fisting and BDSM but more recent rulings in the last few decades have rolled most of that back.

As an example I've had orders of DVDs and burays from the US opened by Customs and they've always resealed them and sent them on, even including the 70s BDSM film Dominatrix without Mercy.

Like a lot of places the laws and their enforcement are a bit of an incoherent mishmash at this point because neither the courts nor the politicians want to deal with it or sex worker rights honestly.
