Exactly, there has to be some level of personal responsibility taken-it would be like suing FacialAbuse because they rammed their dicks down your throat until you puked, you weren't signing up for Wicked Pictures Couples Romance. Nobody with a functioning brain can still believe in the era of the internet/smartphones etc that they are going to shoot porn for a hefty price tag & not have it all over the web in very short order.
I'm aware of the current date, thank you very much. You do realise that by "emotional distress" I am playing devil's advocate to a nebulous and arbitrary thing that gets an arbitrary price tag in the lawsuit, don't you? If there was a signed contract in place where the terms of distribution were agreed but GDP violated it and the plaintiffs are entitled to sue for more than just the originally agreed fee & legal costs, why should they not take advantage?
I would expect nothing less in this day of greed-after all the purpose of them doing it was for money & supposedly he was paying over the odds which is what lured them in & as a society we now encourage a total lack of personal responsibility-it is never the persons fault they tripped on the pavement & hurt themselves because they were gawking at their phone, instead let's get the ambulance chasers to sue the ass off the council for not maintaining the pavement 365 days a year. I am sure a judge would find 100% that a contract violation occurred if they were not paid the agreed fee, however it is highly unlikely a judge could uphold anything about the footage not being seen outside of a certain part of the world, simply this is totally impossible to guarantee & totally obvious to any sane human being without learning issues that that is not going to happen in a world where people can find out in real time something happening anywhere in the world thanks to the internet. In reality these women must have known full well that these videos were going to be seen worldwide & were just hoping none of their friends or family happened across it. Now that this clown has it seems filed for bankruptcy it is highly unlikely any of them will see a penny, if they had any brains they would have demanded cash up front, or at least half.
I was looking at some of the scenes I had from when I subscribed to that site, and there is one from not that long ago, where the guy asked the girl if she planned on watching her scene, and she said if she could find it she would. Now, on the one hand that suggests that they did not tell her that it was for a specific website, but on the other hand it shows that the girl at least thought it would be possible to find the scene. So, sort of a mixed bag.
Just watched another scene that is ever more informative. A girl who had done a scene a year previous was back and the guy asked her if anyone had stumbled across her scene. She said "yeah, my entire high school". I guess she was 18 but still in school when she shot first. Anyway, that indicates that if they did tell some girls it was for Australia only, they must have not done that with all of them. My guess is that if they did it was with girls that were hesitant to the initial pitch. Probably wasn't necessary most of the time. Doesn't make it right in the times it did happen though.
Actually, she later said she was now 21, so she must have meant that people that she went to high school with.
names of accusers must be made public it is unfair to publicly accuse someone in public court anonymously gdp should file suit to release these girls names.
on another note, upcoming studios need to do proper 2257 and explain to girls what exactly is the video for.
Wow! this trail is still going on with no end in sight. I can't even imagine how much this whole thing is costing. The owner Pratt has left the country. If he loses, He will probably declare bankruptcy and the girls will end up with zinch except with the lawyer bills.
Good, the owner of the website should also be sued for creating such a rubbish design too, beyond difficult to actually find a scene on it as the girls are nameless.
^ Wow. I wonder how long they had been building this case. Were they just sitting and watching the civil trial, and then decided at some point they could collect enough evidence from that?
Also, Pratt is definitely not returning to the US now. I wonder if he's in a country that has an extradition treaty with the US?
They should have packed it up a long time ago. Once all those rumors and allegations started, they should have closed down shop. They thought they were untouchable with those contracts they have the girls sign on video. I was never into gdp, lots of hot girls wasted on terrible amateur scenes. Could never get into it. Always was impressed about how many hot girls they were able to get. So many too hot for porn girls it was very impressive. Don't think they got as many hot girls the past couple years because they stopped lying to the girls. Still hotter than most girls doing pro porn though. I think they will have the book thrown at them to.
There was no weekly scene posted last night for the first time in GDP history. Since the FBI is in possession of their computers now, we may never get to see any filmed but unreleased content, which is a shame. Oh well, it's been a good run but lesson be learned for the next GDP copycat to recruit and treat their models the legal way.
^^ Except they didn't stop , they were still recruiting with lies even when on trial which was as dumb as it gets , how long do they think the police need to place one or more officers in disguise faking to be a gullible wannabe recording their scheme and documenting their lies?
Also I don't think it'll stop there. The timing and the hurry some people had put into buying and then immediately destroying all the HDDs of Pornwikileaks which apparently contained many evidences of such scheme could hint there's more to it , even if there's nothing still the feds would look into everything and their recent history with porn related inquiries don't show they are keen to let anything go so...
^ I think before those hard drives were destroyed the feds got the evidence they needed off of them. They wouldn't just allow that evidence to be destroyed without getting what they needed. It's the Feds.
I'm talking the hard disks of pornwikileaks who is not involved with them but had evidences of their scheme. Those HDDs have been purchased by Bangbros also not involved as of yet who immediately destroyed them as soon as they put their hands over them , the Feds at that time had no reason to seize them especially without the faint accusation over those who owned them.
As expected they are already extending this case to the whole Industry.
It's something similar to the Rob Black situation , he was despised by almost everybody in the Industry whe he was accused with obscenity charges nobody stepped in, "he deserves that and more" was the common answer , at the end of that they all found themselves vulnerable with the same accusations and some stores with them to many paid that price. This may end the same way, those are scumbags who deserve anything that may happen to them but the very same allegations may be charged against anybody recruiting girls
^^ I didn't know that, so those scumbags also gave all personal data of the girls they tricked to PWL? This would explain why they sold it in such a hurry and also explains why their hard disks were destroyed on the double
^ Of corse but still BangBros stated they did destroy the disks they just bought
I read somewhere that Donny sold it to GDP and GDP sold it to Bang Bros. I don't really know but I tend to believe it because there was tons of GDP stuff on there, and more seemingly recent info than most of the other content. But again, I don't really know.
^Maybe some of the ones in America but unless I am wrong then BangBros is owned by the same people who own Legal Porno and aside from being less than honest. They also don't live in the US.
"fraud to coerce low-income women ages 18-22 into performing in adult scenes under the guise that the videos would be sold only on DVD to private distributors abroad, and that the models would be able to maintain total anonymity. ... their videos went online immediately"
Wow! I wouldn't have thought in this internet age you could still pull that line.
^I tend to agree with you but then again GDP never used names to identify their videos but instead relied on numbers so a general search would not necessarily yield much and the women while they may not have wanted to have their faces and body all over the internet were still okay with someone paying them a sum of money for the right to film them having sex with a stranger. I don't think the women are claiming rape so much as being conned into a fantasy that the video was for private use and not general broadcast all over the net.
The allure of quick money is usually hard to pass up and tend to cause most of us to make mistakes in judgement that we regret.
I really have no idea if it is, it was just a post on a message board. But even if it's not true I still think all the GDP info on there would have had to have come from them.
Because there was a ton of it on there and they even had a separate GDP section. just tons of personal info and who else would have it?
GDP was a pretty 'closed shop' and not very connected to the rest of the industry as far as I can tell. Most of those girls never did any other adult stuff, aren't with agents...who even knows about testing. So I just don't see how anyone else would have all that info.
Anyway, what the GFY post basically said was it was all dumped on there as a sort of intimidation tactic. Which rings kind of true to me, these guys being the scumbags that they obviously are. Which was my original point. Scumbags.
