^There are many different types of birth control aside from the pill and the performer in question must use one of those. Think about it. Do you really think anyone would do porn without somekind of birth control? Yes male talent would be financially responsible for the child, unless she was married then by law it would be her husband's child and he would have to pay whether it happened on set or not. The more interesting legal question is what responsibility would the producer have under work comp laws, is pregnancy an injury ? I would have to look at that one. I am sure there is a case close to this but not on point.
also one thing I might add this Performer does a lot of Anal she even stated that she enjoys anal over vaginal sex and its no way a women is gonna get knocked up doing anal.
Interesting thought regarding workman's comp liability. The next question (if liability is assessed) would be could the insurance company force an abortion aka baby murder rather than pay to take the pregnancy to term. This one is a slippery slope that would probably end up in the courtroom. The decision would depend on the state's laws regarding the issue.

Also can the male make the same claim, if he is now on the hook to support some child he had no intention of creating...?? It is an interesting concept however. Imagine the Supreme Court ruling on this one.
There have been cases where an employee was off on an employer sponsored business trip, suffered an injury during sex and was awarded work comp benefits. The most notable case in California involved a guy that was in Vegas for business. He had sex with a prostitute and died during it from a heart attack. His wife filed a claim against the work comp ins. company for death benefits and claimed the commercial traveler exception. (Which means if your employer sends you out on business anything that happens to you while you are on that trip should be considered a work related injury).She eventually won the death benefits. In our industry benefits have been awarded based on the contraction of HIV on set. If the Work Comp Appeals Board is willing to award a lifetime of treatment for HIV contracted on sex I cannot see why they would not award treatment & benefits for pregnancy on set for 9 months. And no one could force a woman to have an abortion. The "injury" would be the lost of income for the female performer from not being able to work due to the pregnancy as well as the medical bills. Those are normal work comp benefits. I think that would be a rather easy case to prove up. As for the male, yes he's going to be on the hook for child support. Now he may have a civil lawsuit against the producer if they did not check to see if his female co-star wasnt on birth control especially in light of the condom mandate. Or if he had ask to use a condom and that request was refused by the production company. Makes for interesting case law....

^ You keep saying that pre cum can cause pregnancy, but it isn't the case. It's a lubricant. The reason people feel this is true is because it's often followed by a little bit of ejaculate, which of course can impregnate, but the pre cum itself cannot. If your contention was correct, there would be an epidemic of pregnancies in porn.
Gerault, I have to agree with you regarding abortion. As for Kacey Jordan, she needs to learn how hard any surgical procedure is on the body (including a dilation and curettage, the medical name for abortion). Every time you go under general anesthesia you are really taking a risk of losing your life! ^ Here's the Wiki page on it. For what it's worth, there are a lot of men who can't keep sperm from mixing in with their pre cum. I would suggest that most guys in porn are not plagued by that particular problem if they're working with any regularity. This isn't significantly different from a woman's natural lube, which may or may not be followed by orgasm, but does make things very wet and sometimes pretty creamy. I don't believe there are very many women using abortion as birth control. It's a pretty traumatic experience no matter what side of Roe v Wade a person falls on. No,the "porn queen" has a right to expect a duty of care from her employer if she has made them aware of her non-use of birth control and the employer shoots a high-risk scene anyway. Not all women wish to take pharmaceuticals (especially if the employer isn't reimbursing them) and may have reactions to certain materials used in other b/c methods.

Cop a feel: that's a totally different set of circumstance if the producer has been notified by the female of her LACK of birth control. Even if she did, why does this automatically free the female from any responsibilty of her actions. And what of the male performer. Does he get a say in the matter...?? Goldstein is incredibly open-minded on personal issues. However, I don't see why proof of satisfactory birth control isn't a requirement for female performers? In other words, if you aren't using satisfactory birth control, a porn employer would be within their legal rights to deny employment to you. For example, if you are a heavy-equipment operator who can't pass a drug test, or shows up for work drunk, an employer will not hire you and/or will send you home. Goldstein, for example, would like to be an OTR truck driver. I'm single, and I love driving coast-to-coast. But, because I take insulin, the DOT says you can not obtain a CDL license -- end of discussion. I guess if you are a big enough star that moves product, the studios will let the girls do almost whatever they want. HOWEVER, I just draw the line on people being able to make poor decisions (e.g. like doing porn without birth control) that can cause significant consequences to others (e.g. like saddling a male performer with child-support), because of their own actions. There's got to be a better way.

I would imagine there are a fair number of male stars who have had a vasectomy just to avoid any potential paternity problems even in their personal lives. Has anyone noticed any telltale scars on a guy's sack that would indicate that. Sure solve this unnamed pornstar's problem if she only worked with guy's who have been clipped.
^ I doubt someone could find the scar from a modern vasectomy. The two incisions made during that surgery are less than a centimeter long each. I have had bigger cuts on my finger that healed without scarring, I would assume vasectomy incisions would heal without scarring as well. As for porn studs having a vasectomy I am sure some of the older men have but someone like James Deen who is only 26-27 and may want children in the future probably have not. Well, to put it crudely, the actress is being hired for her "external" features and performing abilities, not what pills she's prepared to take to alter her internal chemistry and keep her job. Most employers in normal jobs are required to provide safety equipment so I don't see how this differs.Employees will still perform duties that are risky but they have a right to expect the employer makes an effort to minimise risk.
