I am sorry to have to make this announcement. As of right now, I have decided to stop posting the 4 weekly performer series. The reasons behind this decision, are explained in this thread. I hope you can understand my decision.

That truly sucks. The performers of the week was one of the things I've enjoyed most about the forum. It was a great way to learn about new performers that I have not heard of or catch up with performers I had forgotten about. I understand it is a slippery slope but these kind of postings would seem to generate interest in performers & products, which in turn generate profits for the various companies. I know I've picked up at least a dozen discs based on featured performers Walter has done here in the past. Oh well.

Walter, I think that posting your Babes is still possible, using links instead of images.
There are lots of perfectly legal tgp sites that offer samples of galleries.
There are legal id sites, like SportyONE.com.
And don't forget boxcovers.
Life in this board must go on.
As long as ADT is safe and we sty within the rules.

I have addressed this possibility already in the thread in World News & Nonsense. Sure, I could do that, but it will just be too much work and work that could easily be done by any ADT member, probably much better and more efficient than I ever could. I don't see the point in doing that.

btw, I had a really wonderful picture in mind for the next Mystery Babe. I have scanned this picture from a French magazine from 1995. The picture itself was taken in 1976 and was not intended for publication at the time it was taken. Suppose a fan has created a free fan site devoted to this babe and has posted this picture on that site. What is the difference between me uploading my scan to the ADT server and me linking to this picture on a free website? I realize there is a difference from a legal standpoint, but imo, it is a hypocritical difference.

As I repeated too many times yesterday, it is a "hypocritical difference". Absolutely.
It is a violation when the offended part thinks it is a violation, which can be ALWAYS and in any form.
But there's also the fact that one thing is allowed and the other it isn't. It's pretty obvious.
In the last months I've been contacted by a few webmasters which gave me permission to use their pictures in exchange of links.
But then I wonder: am I allowed to post those links? Are quotes from interviews or songs in signatures a risk too?
What about screenshots?

I am saddened to hear these news, but I understand the reasons behind it. You don't need to apologize, Walter Burns, I will keep enjoying your post with or without the nice pictures you have posted in the past.

OK, I have had some time to think about this. I have reached 1 conclusion: it would be a sin (yes, a sin ), to stop these series. I like doing them too much and I have gotten so much wonderful responses to them over the past few weeks since I started doing them, that I believe they were serving some purpose besides making me feel good.

As Sbando has said: "Life in this board must go on." And since Sbando is a wise man, I would also like to point out his following comment: "This a turning point and kind of the end of an era."

So, this is what I am thinking right now. I realize I can't post the performer series anymore the way I intented them. But maybe a more healthy approach would be to rethink the fundamentals of these series, instead of putting an end to them. I am asking for all kinds of advice and input on this, but here is what I have figured out myself.

The 3 performer of the week series — the Euro Babe, the American Babe and the Male Performer — could be rekindled by turning them into a more interactive event. I am thinking along the lines of the modus operandi in the thread about [ invalid url ]. Why should I rely on my feeble collection of pictures alone (feeble means around 20 gigas worth), when there are so much knowledgeable members here. When I said that it will just be too much work to look for links to free websites and that this work could easily be done by any ADT member, probably much better and more efficient than I ever could, I only saw this in a negative way. Now I am beginning to think that this offers in fact many positive things. I am not being restricted in my choices to performers of which I have a picture and I can rely on the knowledge of every ADT member who is willing and able to lend a helping hand in finding as much information about performers as possible, including websites with pictures. What I am saying, is that the 3 performer threads can be better than before if we can make them a more collective enterprise. I will still "call the shots" as it were, but I will also make more room for participation from others. Let me know if this sounds good to you and if you got any other ideas.

This leaves my favorite series, the Mystery Babes. Does anyone have any ideas how this series can be "saved"? Are scans from magazines no longer in print, really that big a deal? If I stay away from high res pictures from pay sites, and only use scans and pictures found on free sites, is there any problem if I upload these pictures to my space on the ADT server? Any input as to where the boundaries of acceptable use really are, is welcome. There must be a way of doing this series without stepping on anybody's toes.

Maybe if you could get some web space elsewhere (maybe one of those free home page sites) and then link the images to your ADT post???

I would like to explore this option. Anyone have suggestions where to look for this kind of thing. Doesn't many of those free home page sites have rules about nudity and porn?

Walter, I realize this is not a legal opinion, rather it is based on past experience.

Most of these free hosts do have rules about what you can post. But most of them do not enforce any rules unless they are hassled by exogenous litigious parties (pissed off outsiders). Even then, the almost universal response of these hosts (again, IMHO) is that they eradicate all traces of the offensive user. End of story.

One of the fundamental rights of a copyright owner is to be able to control how his work is reproduced.

When you upload your scan and have it hosted on the ADT server, you're basically asserting that you have a right to do this... (and you may have this right under fair use but that's a different argument).

However when you give a link; you're only giving the address of where the image resides. You're not making any warranties that the outside source has this copy legally either. Any infringement liability falls on that outside source.

It's a fine distinction but that's what happens when people start looking for ways around the law.

MT - Must the linked image be displayed as a hyperlink, or can it be inlined into the body of the text on the forum (using [ img ] tags with an external address), in order to take advantage of this obvious loophole in the law?

I understand that. That is why I called it a hypocritical difference. Like you wrote in the thread in World News, there is "a bad double standard that the moderators didn't allow any talk of violating movie copyrights while image copyrights were blatantly violated". This double standard still exists if linking to site which may be violating copyrights is allowed. Just my opinion.

It should be hyperlinked. By including html language that references the image inline, a strong argument can be made that you're making an unauthorised copy. Then there's that whole bandwidth stealing issue.
I thought it was a bad double standard because the actual violation of image copyrights were allowed while merely the talk of movie copyright violations were not. (I realise we don't allow the talk of movie violations not because of legal ramifications but that we don't want to alienate the kickass movie companies that frequent this board. Shoutout to the lovely Tricia.).

I felt we were hypocrites for ignoring that, but I put off talking about this to Steph (after conferring with some of the other mods) because I figured the likelihood of someone complaining was very low. I didn't know ADT even hosted a Euro Babe Index until Wednesday night.

There may not seem to be a practical distinction in outside linking (other than one or two extra steps) but the most important legal distinction is that you're shifting liability away to someone else.

Yes. As I was told backstage while the fight was going on, Morbidthoughts' original comments (at least here in the Forum) were not directed to my ex site.
But, in reality, my site is the only cause for all this fuss.

Since it's now down and it will never come back (at least hosted by ADT), I'm confident that in the near future people will be able to use their pretty avatars again and post pictures as always.

That said...
Again, here are the rules:
no links to ripped movies or stolen galleries .
There was NEVER a double standard. But the general assumption that people were embedding images in their posts just to show them to the others for informational purposes. That's what happens everywhere without any risks or threats.
AS I replied to another poster before all this happened: NO LINKS TO DOGFART AND SUCH.
Is this done "just to please Tricia"? No. because it's completely inappropriate for a Forum where these celebrities hang out to offer links to stolen movies and vidcaps.
And (EDIT), linking to moviez pages (which, ironically enough, are also pay-sites) is like linking to mp3's or warez. I think everyone is well aware of the difference.
Web piracy is also the reason for things like watermarking or extra taxes on the products that you buy in shops.
Think about it.
So: no double standards about piracy.

I hope that it's clear once and for all.

I think Walter has now collected enough info to decide if it's worth it or not to keep his Babes posts going.

How about posting the images to a usenet newsgroup? You could post an announcement here each time you upload a new one, giving the name of the group, subject line, name you post it under, etc. I realize you would probably prefer not to make ADT'ers deal with usenet to get the pictures, but this approach would insulate ADT from any copyright hassles, and probably minimize your own potential problems.

All of the follow-up discussion, guesses, etc., could still be done here.

They will continue. Not as before, but that's OK.

As to the idea of using newsgroup, I am not in favor of that. For one, my newsserver won't allow me to upload binaries and I have never felt the urge to do so. Besides, retention times limit the availability of the pictures.

Edited: Sbando, don't say that the Index will never be back, not even if it's true. It is demoralizing.

Again: there is no reason why Walter, myself or anyone else should stop debating about pornstars and babes or even about DDF or Suze pictures and models.

But, a request to everyone:

there's a sticky thread in World News & Nonsense dealing with these controversial issues.
No more discussions about legal questions (not to mention moderating policies) in this section of the Board.

Follow the rules. But, as Asmodeus was telling to some poster the other day:
also use your frigging common sense when you decide to post a link.
All links to illegally-distributed copyrighted material will be deleted. That means no dvd rips, no "alternative" Suze galleries or any other instance where it's obvious that we are dealing with piracy.
