There has been some speculation on the net that there is little, if any, scope for relaxation of the current R18 guidelines produced by the BBFC. As a result, I contacted them for clarification, as well as asking why, if this was the case, they included questions about the R18 certificate in their current online survey; This is their reply:-

"The BBFC's guidelines are a mixture of what public opinion requires and what the law permits. Therefore it is reasonable to ask the public what they think of our current 'R18' standards (which are inside the standards
permitted by the criminal law). We are not 'hoping' for anybody to say anything - we are simply interested in what the public think. It is true that there is not much room for further liberalisation at 'R18'. However, it would be useful to know whether people feel that current 'R18' standards are about right (or, even, too strict). It is worth remembering that the public were not consulted when the 'R18' guidelines were significantly relaxed in 2000 (this was, of course, the result of a court case rather
than public opinion)."


Although I would still urge any interested parties to continue to respond to surveys, consultations etc. as well as making direct contact with the BBFC to express your views (It can't hurt after all), it looks as though there is unlikely to be any relaxation of the R18 guidelines.

Its amazing the guidelines are the way they are when you consider that just a few years ago all actual sex was banned and there looked to be no signs of that changing whatsoever. The guidelines already allow for quite alot and usaully only a few seconds are cut these days from videos.

I'm not suprised the guidelines aren't getting relaxed further, but then i dont bother buying them anyway so im not to bothered.

I agree that the change in 2000 was dramatic, and very welcome, but I believe that further relaxation is very important. I do not purchase R18 videos either (for reasons of price & censorship - I think if you check the BBFC website, you will find that a considerable number of videos have more than just a few seconds cut from them), but the guidelines have further reaching implications. Customs use them to determine what they can confiscate, so the more relaxed the guidelines are, the less chance there is (should be?) of an individual loosing their money when purchasing something that Customs decides is in contravention of those guidelines. With further relaxation, the potential purchaser would have a far wider choice of what they can buy (hopefully) without fear of it being seized.

In light of the response from the BBFC to my enquiry, it would seem that, as was the case with the change in 2000, the only likely way of achieving change is for the BBFC to be legally forced into it.

I do hope the guidelines get relaxed further for the reasons you have said. But i just cant see it happening soon because the last relaxation was done by the BBFC on its own, no laws were changed. The governement was very much against the relaxation and i think still is.
However i think it is now Lib Dem policy that porn that does not involve harm to adults, simulate very serious harm or children or animal abuse should be allowed for everyone 16 years+. But again i cant see the Lib Dems getting in next election.

Apart from pissing, which is also excluded from US releases, the main concern of the BBFC is with 'abusive' behavior such as throttling or aggressive deep throating, especially if it appears that the recipient is physically unable to withdraw consent. Personally I don't find this any great loss. Even pretty strong gonzo material (e.g. Rocco, RLD, or Anabolic) is usually passed uncut or with very small cuts. An exception was Rocco and Kelly's Perversions in Paris, which was cut not only for pissing but for a scene in which Kelly abused a middle-aged guy and the guy abused her back. If you've seen the uncut version you'll know what I mean. This is some of the weirdest shit Rocco has ever filmed, and apart from its curiosity value I wouldn't want to see it at all.

You can argue on 'freedom of speech' grounds that nothing should be censored, but short of this I don't see much to complain of in the BBFC guidelines. The only real anomaly is the ban on pissing (during sex), which is just about the most harmless sex act there is.

With respect, I disagree. This whole issue of banning any behaviour which may be harmful if imitated is bizarre in the extreme. One film (a Private title I think) was cut because it has a scene where a dildo was used attached to a stick. In the view of the censor it was deemed potentially dangerous to operate a dildo at distance so the scene was cut. How on the face of the fucking earth can something like this be cut and then certificates granted to things like Jackass or WWE wrestling? The BBFC is being wholly inconsistent in how it treats sexual behaviour compared to any other aspect of human experience and I really cannot fathom why (other than simply 'because it can').

Personally though, I have little to no interest in the BBFC classification system. At present, where the cost of certification is dependant on length, R18 titles frequently have all the extras hacked out the film and invariably cost more than importing the original anyway.

PS2: I should add that to suggest the BBFC guidelines are irrelevant to me isn't wholly true: customs base their standards on the BBFC so the chance of a package being seized is to some extent related to the domestic standard set by the BBFC.

As far as I know, the BBFC were also VERY much against relaxation (possibly because of governmental pressure) - the change only occurred after a protracted legal battle between a distributor and the BBFC.

Seemingly, the BBFC had previously started to allow slightly stronger (but not hardcore) material ‘on the quiet’ while the last Tory government was in power, but when Labour came to power, the then Home Secretary (Jack Straw) was not happy about this, so the BBFC were apparently forced to return to only allowing softcore once again. When the BBFC then refused to classify a film that contained material which had previously been OK, the distributor appealed to the Video Appeals Committee (VAC), which upheld the complaint. Rather than accept this, the BBFC then went to judicial review, where, again, they lost. This effectively meant that, legally, they had to classify the material. As a result, they then 'got together' with all interested authorities (Police, Customs etc.) to formulate their new guidelines, which are those currently in use. It has to be said, that the guidelines allow much stronger material than was apparently contained in the film that initiated the aforementioned proceedings.

FWIW, I may have glossed over some of the details, and I am recounting the story from memory, so I make no claims as to the absolute accuracy of the information contained above (he said covering his ass! )

Id like to see the guidelines changed. Alot of the cuts i know of are a joke - squirting, refernces to spanking/underage sex. The Fashionistas was cut alot, by 20+ minutes. I have some idea what the cuts might have been from seeing only the uncut version, but think it should have been left alone. I agree about their inconsistency, and for all certificates. I have the Robin Hood Prince of Theives DVD (PG) and all the cut bits are in the "making of.." feature and they obviously didnt bother to listen to audio commentaries.

Its worth sayng though that although customs and police etc may refer to the BBFC guidlines they arent actually the law. So a customs officer could just seize anthing they dont like the look of and say it is obscene and theres nothing much you can do.

But overall R18s allow for alot compared to before and they real problem is the re-authoring and removing of extras.

The chances of the BBFC relaxing the certification any more are quite slim, mainly because they pretty much cover everything anyway.
Factor in the very real possibility of a Tory government next election and the chances of seeing a pissing video on these shores are pretty bleak.
But still, you can hop on a ferry and get your filth from Amsterdam and be home in time for tea. One of the benefits of the EU!!
If there are any UK distributors reading this, please include extra features on your DVDs. If I have to pay 25 quid for an hour and a half of film, I'll have to keep buying from abroad.
