Ok so my cousin emailed that very well respected ebay adult store informing them that MH and JM dvd has been obtained by canada customs to determine obsenity and asked how often does this happen and they replied,"This is the first time this happened for us as a seller. UPDATE- Well my cousin told me of the 5 dvds detained by canada customs, he recieved 4, but 1 dvd from JM productions was considered obscene and the "importation into canada is prohibited under tariff item 9899, classified as, description and/or depiction- sex with pain, sexual assault." (he never saw the dvd but its just acting and it is legal in great'ol USA). He wants to know if such a dvd that is deemed obscene and prohibited TO IMPORT into canada may be LEGAL TO POSSESS in canada? If so then he may appeal their decision with the defense that if its legal to own in canada then it should be legal to be imported into canada or there would be hypocrisy within the law---the law saying, "yes it CAN BE in canada but it CANNOT ENTER into canada." he wants to appeal their decision or in 90 days the dvd will be dusted. This really is not a battle worth pursuing. Customs agents in most countries have discretionary powers and are not a court of law. One group of agents may let it all through, while others may find it obscene and refuse it. Obscene material is a matter of perspective and is not able to be so specifically defined in the legal code. A customs agent who consumes porn in his/her personal life may see your dvd covers and go "meh" and let it go. Someone else may be deeply religious and think masturbation is a sin, and see the dvds and go "obscene material" and stop it. You should be happy you got 4 of them through. So you lost one, eat the 20 bucks or whatever it cost and move on. You should also consider VOD or digital downloads. I just looked to help your cousin out and it turns out JM Productions have digital downloads for a lot of their product. If you MUST have DVD's for some reason, drive to the USA, buy them.. throw out the cases and box covers, and put them into a CD wallet with a bunch of other CD's. The likely hood of them getting found is minimal to none. You are not breaking any laws by doing that. If they happen to randomly search your CD wallet, and find them... then it is no worry other than if the agent thinks it is obscene and takes it from you. Well, it is their concern and has been and will be for a long time into the future. What I would suggest is you and your cousin work your way into politics. If you both can run on a platform of eliminating border controls on pornography, and you get enough support, perhaps you can work on getting the laws changed. Unless the law is changed through legislation, I am not sure you have much else you can do at this point. Many of us who used to order stuff in the mail internationally have moved onto digital and there are no more concerns about customs agents opening our packages. It was part of the cost of buying porn that maybe your package shows up and it has been opened and one of your VHS or DVD are missing. Just the way it was. Since you won't get digital downloads or use some of the other suggestions to get around these inspections, you just have to live with it. and like it or not, most people would see Max Hardcore and many JM titles as "rough porn" and interpret the laws to their discretion. In the US Max went to jail for it, and it is all based on interpretation. doug you are not getting the message about how borders work Border checks, inspections, package openings, etc are not courts of law. They are interpreted on the spot decisions by agents and that is why things are not 100% the same in every situation. If you recall my story about two gangbang girl tapes... on was seized and the other was sent to my door. Both had similar content and similar box covers. That is how border controls work. Its the same as if one agent smirks when smelling pot and sending you through and another one pulls you over and tears your car apart. They have to make discretionary decisions with every single person and package that attempts to enter the country. Also, packages are opened randomly or if it fits a profile they are seeking, they don't open everything. So often you will order your porn and it will show up intact. So, yes, they can "make mistakes" and seize something they shouldn't or search the car of someone they didn't have cause to, etc. You can take your grievance to court if you have suffered damages as a result. Like I said, get active and change the laws so porn can not be seized by border officials. Or, get a lawyer and take your case to court. You can file a claim that your merchandise was improperly seized and make your arguments in front of a judge and if you have a good legal case, perhaps you can get your DVD back. You are correct that discretionary decisions are not facts, nor are they the same for everyone. However, like I said, that is how border controls are. The agents do not have time to contact your legal team and setup a court date and get you in front of a judge and all the costs associated with that. They don't get warrants to search your car or open your package like the police would out in the country. Alternatively, you could seek out methods to avoid this hassle such as going digital downloads, watching VOD, etc. Nothing has been "proven" about JM productions. As far as I know, they have not been taken to court for their content and subject to a rigorous review by the legal system. Nobody has decided to go after them for obscenity so you can conclude that the US system is comfortable with their product being sold; or at the very least they have not motivated any prosecutors to invest resources in shutting them down. Actually JM Productions were taken to federal court for obscenity under Bush Jr. and got off on a technicality that had nothing to do with the content. A number of distributors after that case deem to have stopped carrying JM, perhaps not only due to the risk but also because during their case JM sold their distributor down the river so I doubt many wanted to continue working with them. The US laws are so weird their material could be declared 'obscene' tomorrow if a case was brought and they lost. Sounds like the DVD was pulled due to depictions of sexual violence. The violence doesn't have to be real or be an actual sexual assualt under the law to be blocked.

Why anyone in this digital age would order porn on physical media to be shipped across international borders is beyond me. We had no choice in the past, but now most places offer digital downloads, online "lockers', VOD, and so on. Heck, you can download it and burn it to a DVD if you really want a physical copy. I don't know how much you travel doug, but Canadian Customs are actually far more lenient than many countries in the world. They are doing what they have to do to keep the bad stuff out and YES, that means there is collateral damage and you lose some product. Very little legal porn is seized anymore; it is just stuff with box covers that illicit emotions of abuse in the minds of the agents. 15+ years ago when gozno really started to show the sex acts on the box covers (up until the mid 90's almost every box cover would have modelling shots and not penetration or cumshots), even simple DP's were getting seized sometimes. Again you got 4 of 5... that is pretty good. Us older porn consumers in Canada were used to ordering and sometimes we would be missing a piece. It was part of the game. Just keep ordering your DVDS and if you lose one her or there just consider it a cost of doing business. It isn't going to change. As for you concern about quality when getting an original DVD.... digital downloads can be in very high res (better than you can put on a standard DVD in many instances) and you can burn them to DVDs and Blu Rays and they look magnificent. As far as I know no pornographer has been jailed in Canada in modern times. That isn't true in the US where they not only jailed Max Hardcore but drove Rob Black into bankruptcy and tried to jail John Stagliano. Not to mention the years of legal harrassment of Adam & Eve and many others. So the US is hardly some oasis for pornographers. It was only under Janet Reno, who just passed away, that pornographers for adults were left alone by the federal government.

I don't think doug is listening or wishing to understand how border controls work. Every decision they make is an on the spot opinion from a human being who may not always get it right. That is why you can take action in the court system if you feel they have caused you damages. Border officials are not judges and not courts of law, they don't have time for due process or rigorous examination. THey make judgement calls. Although doug seems to be going back to this thing of wanting to see adult women dressed up to look like underage girls. That will always be a sticky area because of the emotions it brings up. Some would say that a person who wants to see a 19 year old look like an 11 year old is just looking for a way to get around child porn laws and still get their jollies. I have had stuff siezed from my packages. I know what I am talking about when I give you this advice. having your dvds seized at the border does not mean you are committing a criminal offense, you will not be arrested or charged. If they were actual children, of course you will be arrested. A particular agent may see a dvd cover with women dressed as young girls, or subject to physical acts, and deem it obscene and seize it. This does not make you a criminal.. it just means they won't let you import it. There is no law that specifically says a specific DVD or sex act is banned... they define child porn, beastiality, snuff, and things of that nature... commercial porn is a discretionary issue at the border. Another agent that looks at your next order may do nothing! again, border control are not courts... they make instant decisions based on their own discretion.... they are human, bias plays a part, and sometimes they will get it wrong. LET ME MAKE THIS CLEAR AND PLEASE TRY TO READ THIS.... You can order that lost DVD again, and it may end up at your door. YOUR DVD WAS NOT SEIZED BECAUSE THEY DEEMED IT MIGHT BE CHILD PORN. IF THEY SUSPECTED YOUR COUSIN , HE WOULD HAVE HAD POLICE AT HIS DOOR WITH A WARRANT SEARCHING HIS COMPUTERS. AN AGENT USED THEIR DISCRETION, NOTHING MORE. You can not seem to understand how the borders work and I am sad we have to explain this 100 times. You have three options here... 1 - take them to court over your lost DVD, explain your case, and you have a very good chance of retrieving it 2 - go digital and never worry about a border agent again 3 - accept that seizures are part of the cost of ordering internationally, and keep ordering your legal porn from the US. Most packages will not be searched. Those that do, most of your stuff will make it to your door.
