Doesn't Brazzers and other companies shoot lots of their stuff in Las Vegas year round? Depicting shooting porn in areas other than Los Angeles as "highly illegal" is not accurate. I would say that it might be, it could be. It just hasn't been brought up in a court case yet. And quite frankly, I wonder if a charge would even hold up in other areas. Los Angeles is the only place where a court case has taken place. I just don't see how it would be illegal elsewhere. What is the actual law that is being broken if an adult film is being shots outside of LA?
I don't know the answer. This is just food for thought. A good topic for discussion maybe?

Just about everything I see online says that CA is the only legal place to hire actors, but I think that as long as you have a signed model release, business license & tax ID number, and a lawyer's ok, you can shoot where ever you want to. I recently watched Eden, and that was shot in Hawai'i.
If it was really "illegal" to shoot outside of CA it would be foolhardy to make permanent records (DVDs) and go blathering about it on one's website. The DoJ needs little to no provocation to pursue obscenity charges. Why make their case and lay out the evidence for them?
Some of these guys are simply playing to the taboo factor, hoping it'll hook them some extra buyers. It's a marketing game.

You may be interested in reading about the charges brought against a company shooting internet porn in Florida. They were on the Florida panhandle if I recall correctly. I will link to some information if someone here doesn't link to it first. They were charged with racketeering. I will go searching for the information.

I probably could understand if it wouldn´t be legal to shoot in front of national buildings or things alike but i can not understand why it should not be allowed to shoot in »any« hotel room what´s so ever. Don´t get me started on adult shows for adults where adult performers are not allowed to show off their nipples. did i mention that only adults are allowed to enter these adult shows ? ridiculous

Yes, thank you I've read about that story. I think two of the charges brought in that case are pimping and prostitution. But that is exactly what the case in CA many years ago set the precedent for. That it is not pimping, pandering or prostitution if a producer/director hires actors for a film. I am sure that charge will get tossed. I'm leaning towards the belief that even though that the case was in CA. it still sets a precedent. My question still remains. If a company in Las Vegas, or anywhere for that matter, produces an adult film, what law are they breaking?

I don't know anything about the state to state legalities, but I believe that they can only prosecute if you are caught in the act. Even with a dvd as record, after the fact, they can't do dick, again, from my understanding.

I thought it was the sale of certain types of porn in certain areas that broke obscenity laws?
E.g. B/G vag is not illegal in the UK, butt fisting is.
I was under the impression that it don't matter where the hell you shoot the damn thing, as long as you don't do it in public where the act itself, being viewable to uninvolved others, is obscene. Same as shagging in a park.
It only matters where you try to sell it, I believed.

I think I remember reading somewhere here on this forum that Brandon Iron once shot a scene with Steve Holmes and Hillary Scott in a Vegas hotel room, although it never came out to DVD (as far as I know, and believe me, I've been looking for it!). I was under the impression that this happens often, but maybe I'm thinking of the hotel rooms I've seen in European porn, like when Vince Voyeur went to the Venus Fest in Raw & Uncut In Berlin.

They absolutely can and will prosecute if they believe they have a solid case. Screen caps of some guy announcing "this is illegal!" would certainly not help his defense.
Each state gets to define it's own standard, so we've got at least 50 different definitions of what constitutes obscenity and what doesn't. Thus leading to
CALIFORNIA v. FREEMAN, 488 U.S. 1311 (1989) is [ invalid url ] isn't a crime in those parts?

California (not just Los Angeles) is the only state that has case law that protects anyone's First Amendment right to produce adult hardcore content.
Porn is shot in probably every other state, however, by shooting in other states those production companies run the risk of prosecution. It rarely happens, but it can.
As for New York, there was a criminal case that compared porn production to prostitution but that case did not establish the legalization of content production. It is still illegal there as well.

I think that the charge would likely be pandering, just like it was in CA vs. Freeman.
In some locations, I would think that prosecutors would just avoid a case like this because, if they lose, it could become a "green light" for others to shoot porn, in that same jurisdiction, without any fear of prosecution.
They're probably better off if people continue to confuse "not explicitly legal" with "illegal" in places like Las Vegas.

In terms of shoots in hotel rooms being "illegal", I wonder if it has more to do with local ordinances and the contract that exists between the renter and the establishment regarding a prohibition on conducting for-profit commercial activities on the premises without specific consent of the owner.
Although I'm not a lawyer, I could see where the owner of the property might be able to enjoin the release of any such photos or video, or at least attempt to compel a disgorgement of the revenues. Either way, the producer would have an unwelcome legal fight on their hands, and might lose control of the product at the end of the day.
And looking at it like this, it wouldn't matter one bit whether we're talking about a porn shoot or just about any other type -- the same logic (and restrictions) would seem to apply.

Mann Act can apply. The Feds have not used it in a long time, but from what I understand, it might rear its head again in regards to the on-going prostitution investigation they have going on.
And Jazzman is correct as well. Location releases are needed. If there's art on the wall, those would also need releases. There are a bunch of problems with shooting in hotel rooms in Vegas.
Whether it would happen, well I haven't heard of it so far.

I can't remember the name, but I know there's one porn company that prides itself on shooting in Maine and using only local performers (to distance themselves from the stigma of "corporate porn" in southern CA). It says that right on their website.
Maybe now that John Ashcroft's not Attorney General the Justice Department realized there were better things to worry about.

It seams there are about five reasons filming might be illegal
-acts performed are illegal
-obscenity
-prostitution
-permits
-zoning/
So lets say our scene involves only consenting adults preforming mainstream acts and the location does not have any silly laws against fornication/homosexual acts/oral sex ect.
Obscenity is probably not a problem most places at the time of shooting since there is no finished product to show the jury and no copies got to backwards towns yet via undercover agents ordering them yet.
Prostitution is a potential problem in 48 states
a California court case settled the point that in California adult film making does not constitute prostitution
similar arguments might work else where but this has not yet been done
In Nevada prostitution is legal under some circumstances
permits
Many places will not permit adult productions making them illegal
For that matter I suspect many southern California productions are not properly permited hence technically illegal.
Zoning
This is the problem that might occur in some Nevada Brothels if they are not zoned or licensed in a way that allows filming

Legally, you can only operate a brothel that is in a Nevada County with less than 400,000 people in the pop.(No I have no idea where they came up with that number.) Clark County (Vegas) and Washoe County (Reno) are the only places with those numbers so anywhere else in Nevada is fair game.
But you're right, lots of people have the impression that it's legal in Vegas. Mainly because there ARE 100s of escort services in Vegas, probably more than in any other US city. Like other cities, these flourish, because renting an "escort" for an evening of "companionship" is not illegal.
It would be interesting (and legally expensive I'll bet) to see what would happen if someone living in Vegas openly announced that he was filming scenes in his own home.
Additionally, in Rhode Island (!) street solicitation and brothels are illegal, but otherwise sex for money is perfectly legal. Again, it would be interesting to see what would happen if a shoot was made in someone's home there. Of course, I somehow just don't see Providence becoming a hotbed of the industry.
