i don't get it. why are they being charged? what is the difference between what they do and what goes on in LA?

"obscene material" because consenting adults are having sex on camera for money? you don't say! are they living in 1955 in Florida?

This is ridiculous. Isn’t the law grasping at straws here? I mean seriously. How can they justify arresting these people if everyone is over 18, consenting and most likely signed documentation?

What’s worse is these cops are probably acting like the just took down Al Capone or something. Acting like bad ass cops with their stupid cop mustaches.

The difference is precedent. Back in the 70's, porn was mostly shot in NYC, LA & San Francisco. These movies were shot while hiding from the law. Ususally, when caught, the producer would be arrested for pandering. Essentially, pandering is hiring someone for sex.

Someone in LA fought this charge and won. I don't remember if the case was taken to a higher court or not. But the outcome was that he judge ruled that hiring people to have sex on camera for the purpose of distribution is not pandering.

Once that happened, nearly all of the adult industry moved to the Southern California area where they wouldn't be charged with pandering.

No such precedent exists elsewhere. I assume that the reason that the police are talking about prostitution rather than shooting a movie is that they intend to charge these guys with multiple pandering charges.

The case Bill is referring to is the Freeman case which makes it legal to produce adult content in Los Angeles county. POV is still illegal under Freeman though. A producer/director is allowed to pay others to perform sex acts on camera, however, the case never discusses POV types of scenes.

Anywhere else and the producer risks prostitution/pandering as well as RICO charges.

Not that I disagree with COHF's practice by any means, or that I support any of this moralistic BS, but was COHF irresponsibly making itself more of a target?

I've never subscribed to the site, but if the outdoor shoots I've seen in some of their clips, were conducted outdoors, merely in wooded areas in parts down south, and not the countrysides of Budapest, that might raise a red flag.
Also, and correct me if i'm wrong, but don't they involve some of their subcribers with some of the bukkake shoots they produce, and use the practice in almost a form of advertising pitch in it's promotional online ads?
From what I've understood, and simply for perspective, casts used in JM Production's American Bukkake, are also rounded up from the general public, yet even though they're made here in Porn Valley, still seem to be conducted with a certain degree of discretion, through relatively underground cattlecalls, and every AB flick I've ever seen, was filmed indoors.
Not to suggest theres any halfway discreet, wooded areas left in LA.

First of all, this case is a reminder of the fact that pornography is not at all any different than prostitution, but is in fact the same. If it is illegal to shoot porn anywhere in the U.S. outside of L.A., then there would be a whole lot of pornographers in trouble besides just these guys. I'm thinking that the authorities in Pensacola must have just decided to pull some some antiquated law out from the woodwork to use against these guys. Shooting porn in Florida might be illegal (which makes one wonder why none of the other porn companies operating in that state are being charged), but if it is, I doubt if it was commonly enforced prior to this case.

Bill is probably right that this COHF case is a precedent for non-L.A. pornographers. And if these guys lose this precedent, then I predict that we'll probably see a whole lot of other sites starting to shut down as well.

woaaa... i never knew porn was illegal outside of california...i just tought most of the porn shooting there was because it was more confortable (this is where hollywood is after all, and all the glamour)

But this is weird, think about guy like BrunoB , the guy is in montreal, he is clearly saying on his website he shoot there, and on one shoot i remember he said he was in vacancy to Florida. I don't know if the law is different in canada, but that mean he could get arrested for that?

This is weird, i always tought porn was legal as long as paper where signed...

And when i read a maximum of 30 year in jail...i say WTF !!! Ok this may be the maximum and i don't think some judge would give that but actually just thinking about jail for porno, i mean normal porno, is just out of mind for me, the only thing that could be acceptable for me is something to pay, like 250 000 bucks but this is the very maximum. That really put me out of my seat... After all people should be able to have sex for money, what is the probleme with that, its there body after all...

It is clearly election time in Florida / southern Alabama. Someone is scoring points. It isn't illegal to shoot porn. There's no law against that. Just that there has been no precedent set that says it isn't illegal. And for the religious right that's enough for a prosecution.
I know the people who shoot COHF and I participate regularly. This is a bullshit prosecution and is further proof the US government is is niether for the people, by the people. The people are great; no doubt,, but the gov. needs a slap in the head to remember what freeedom means.

yes it was taken to the supreme court of california and it is legal to shoot porn anywhere in california. also in new york state there was ay similair court decison and also in other states i believe
