I am confused about this mailing obscene material law - 18 us usc 1461. I always though it was legal to mail porn, however this law states that mail addressed to you that is obscene is a federal offence. Does that mean every time porn is mailed to me I am walking a gray area as to whether the material is obscene in my community. I am not a lawyer but I really need to know what this means, please help.

So far as I know, it is the sender who is responsible for what's in the mail, not the recipient.

This administration considers all porn obscene no matter what your community standards might be. If they 'find' your porn in the mail and it is not deemed obscene in your community they'll just go somewhere else where it is deemed obscene to prosecute the originator of the material.

What about this line found in the code

"knowingly causes to be delivered by mail according to the direction thereon, or at the place at which it is directed to be delivered by the person to whom it is addressed"

Thats seems like if you order your responsible.

The law is not only confusing, but obscenity is undefined.
I personally feel that the government in not interested in individuals (consumers) as much as they are companies making and distributing adult material. Unless of course the material involves minors.

Don't worry about it. It's not really the mailing part that's illegal. It's the selling/renting of it. The federal government goes after mailed porn for 2 reasons. First, by ordering their targeted porn to be shipped across state lines, it becomes a federal case. Second, it allows them to choose the location that the case will be tried.

The government chose western Pennsylvania as the place to have titles from Exreme shipped because they believe that they will find a conservative jury that will benefit the government in the case.

The U.S. v. Klazura case is very dangerous to the rights of free speech. It is summarized in the link right above this post. Basically a man was got stuck with obscenity violation for having ordered two pictures of nude ADULT woman. He even cancelled his order but the Postal Inspector delivered it anyway.
