My rant is that the fees collected by the lawyers here are greater than the amount that Emily and her family will receive. The story notes that there was a $3 million settlement and that Emily and her family will receive $1.26 million. That's $1.74 million in fees and disbursements. Obviously, I have no inside knowledge of this case but it seems to me that it was a relatively straightforward case from the beginning. I can't see that liability would be much of an issue here. Emily was under the care and control of healthcare professionals who were negligent in their duties. There isn't much of a defence here, especially one of contributory negligence on the part of Emily or her family. She was in crisis and that is specifically why she was at this facility. The only issue would be quantum. I can't speak to that, but $3 million does seem a bit low. But $1.74 million in fees seems absurd to me. I get that this is the justice system in the US, but c'mon people. Demand change. Again, I have no inside knowledge of the case, but the number of hours in this case wouldn't be significant and it wouldn't take reams of expert's reports (paid as disbursements) to prove the facility's liability or quantum of damages. I'm not even sure that based on the facts publicly available that any expert reports would be needed beyond an actuarial assessment for future costs of care. (Again, $3 million seems low.) Where I practice, the most that a law firm could take from this settlement would be $900,000 but given that this isn't terribly complex case it would likely fall closer to $750,000. An actuarial assessment might run to $20,000 and I am being very generous with that amount. Probably closer to $10,000. $1.74 million is legal fees is robbery. Apologies for the editorializing, but Emily and her family are as much victims of this law firm and the US legal system as there are/were of the treatment facility. Demand change!!!! [Link] |
