Her family just won a lawsuit against the facility caring for her , about 3 million dollars , unfortunately Emily will probably be in a vegetative state for the rest of her life .

That is some good news I guess, but as everybody says, this whole thing is just so sad, so terrible.
I hope they can use the money to try to help her achieve the miracle she needs, but honestly $3million wouldn't even pay for a month in a hospital in this country. And long term maintenance care ain't cheap either.
If I remember correctly she had a substantial estate that her family was trying to get access to to pay for all her bills but couldn't get it yet. Hope that's still rolling.

I'm a lawyer in Canada and I do some personal injury work. My rant is that the fees collected by the lawyers here are greater than the amount that Emily and her family will receive. The story notes that there was a $3 million settlement and that Emily and her family will receive $1.26 million. That's $1.74 million in fees and disbursements. Obviously, I have no inside knowledge of this case but it seems to me that it was a relatively straightforward case from the beginning. I can't see that liability would be much of an issue here. Emily was under the care and control of healthcare professionals who were negligent in their duties. There isn't much of a defence here, especially one of contributory negligence on the part of Emily or her family. She was in crisis and that is specifically why she was at this facility. The only issue would be quantum. I can't speak to that, but $3 million does seem a bit low.
But $1.74 million in fees seems absurd to me. I get that this is the justice system in the US, but c'mon people. Demand change. Again, I have no inside knowledge of the case, but the number of hours in this case wouldn't be significant and it wouldn't take reams of expert's reports (paid as disbursements) to prove the facility's liability or quantum of damages. I'm not even sure that based on the facts publicly available that any expert reports would be needed beyond an actuarial assessment for future costs of care. (Again, $3 million seems low.)
Where I practice, the most that a law firm could take from this settlement would be $900,000 but given that this isn't terribly complex case it would likely fall closer to $750,000. An actuarial assessment might run to $20,000 and I am being very generous with that amount. Probably closer to $10,000.
$1.74 million is legal fees is robbery. Apologies for the editorializing, but Emily and her family are as much victims of this law firm and the US legal system as there are/were of the treatment facility.

If and when she makes a full recovery, there's ONE person who was in the industry she should definitely have a long conversation with for obvious reasons - Eden Sin. She was active for about 3 years or so until she hit a bout of depression which medications made much worse and ended up jumping from the fourth floor of a building.
Even reading the sentence that she is walking, sleeping, and watching TV - I'm so relieved and continually hopeful for her. If those sources are true, which I pray for, she may yet have a shot at living mostly normally

I'm all for being positive but it's impossible to do that based on this latest TMZ article. I don't know if TMZ took everything they were told at face value and didn't do their due diligence of even doing a quick Google search but the effects of long term oxygen deprivation to the brain are so severe that 5 minutes is all it takes to start brain damage and the article states that Emily was without oxygen for 30-40 minutes. There are some pretty obvious opposing statements in that article that basically put this on the same level as Elvis sightings. We are told that she is learning to walk but somehow can't use her arms or hands to do anything because at minimum she could point to things if not write but the articles states that she can only move her head and eyes. If her arms don't work then her legs won't either.
I appreciate everyone trying to put a positive spin on this but let's be honest and realise that anything coming from the family at this point is to be considered as fantasy unless given visual proof.
I see the contradiction now. Still, she either moves her eyes/head or she doesn't. And if she does(with purpose that is) then it's an incredible amount of recovery in of itself already at this point.
^As much as I would love to think of it as a great recovery. The possibility is quite high that her mother is lying about most of what is in that article and even if she isn't. The fact that her head and eyes move means absolutely nothing because they could be autonomic reactions. IE: Her head and eyes move but there is no conscious actions on the part of Emily to do that.
I know I'm very late to this because sometimes you just don't know what to say. I sincerely wish Emily Willis a speedy recovery. It was truly heartbreaking to hear the news, and I hope she finds the strength to heal and recover as soon as possible. Wishing her nothing but better days ahead. I also hope that the industry supports her in the best possible way, not just financially, but with genuine care and help during her recovery.🙏
^^I'm no doctor but if say an object is moved in front of her and her eyes/head follow in the same direction it's a pretty clear indication of brain activity. Obviously I have no clue of the actual situation but calling her mother a liar is ridiculous. At worst you can claim she's mistaken but 'liar' is a misplaced comment.

I think the best course for everyone to read up on what happens when a human brain is without oxygen for more than a few minutes let alone 30 plus minutes like Emily was and you will understand that what her mother is claiming in that article is humanly impossible. I can't speak for why she said what she did in that article other than maybe she needs to believe that her daughter has a chance at some kind of recovery.
So happy to hear some positive news about Emily's condition. Despite my feelings about TMZ, they are credible in this space and I'm glad they covered this. This seems like good progress since the time she suffered the injury.
