I would think in this political climate even asking about fake incest scenes would put you on some law enforcement agency's radar in some shape or form. Why do you think that this theme died out in porn about twenty years ago? You may not get arrested but someone is jotting a note about you and stuffing it in their file cabinet for future reference.

As for the supposed crackdown on porn, I haven't seen any significant progress. The videostores are filled up to capacity with porn and there's always new titles waiting in line to fill up the shelves.
