However, by using the HD-DVD logo it definitely implies that the disc is an HD-DVD disc because the HD-DVD logo is not supposed to be used along with discs that aren't HD-DVD discs.

I think that we're going to start seeing this a lot. I think that it will be fair to assume that when someone finally does release an HD-DVD or BluRay disc, it will be very clearly stated on the boxcover because 99.9% of the public will not be able to play it. The exception to that would be if someone includes an HD-DVD disc as a bonus to a standard DVD release.
