As long as the pirater knows where he got the content, and it meets the requirement, he is in the clear; he doesn't have to own it....as far as I understand.

2257 applies to the maker of the porn and not to those further down the chain.
I don't have the actual age-proof documents of the performers in my DVD collection.

Anyway, to get back OT, the tubesites obviously don't meet 2257 requirements because they're illegal in the first place, it's just that the government hasn't really tried to shut them down, after all why would they do the porn industry any favours?

Not true. Primary and secondary produces are treated the same under the lastest revisions to 2257 and 28 CFR 75.
For the most part, tubes arent 2257 compliant unless, as Vanessa pointed out, they own the content.
There is an exception in 28 CFR 75 that states that social networking sites do not have to comply, but that is really meant for mainstream sites that happen to have adult content uploaded in violation of their TOUs not adult tube sites.

Ninja, we are exempt because we don't show any depictions of sex acts or nude pics with genitals. That's why we have an image policy.
Technically, if one of you posts a picture of video showing sex acts then you are distributing the material and should have the records. Obviously, tube sites and average people on the internet do not comply. The expanded definition of secondary producer is ridiculous.

I am on quite a few tube/social networking sites. I'm always looking for amateurs who will fulfill requests. If these explicit requests were fulfilled on a web-cam and downloaded to my hard drive, would that require me to keep a 2257 document?

Can someone tell me what actual sexually explicit conduct is? A lot of fetish type of productions may be entirely or mostly non-nude and not contain penetration, genitals or boobs. But the producers still have the 2257 on their sites (I assume they have to - do they?)
However, similar content can be found on YouTube (both pirated and by amateurs) and YouTube obviously has no 2257 but since a lot of non-nude fetish porn is actually within YouTube ToS it's still on there. Also Google caches a lot of porn image thumbnails in their image search and they don't have 2257.

So, hypothetically:
If ADT image policy allowed explicit photos, and
I went to Pinky's website "free samples" section, and found a photo of Pinky holding Mandingo's cock, and saved it to my computer, and
I posted that photo in an ADT thread about Mandingo scenes,
Would ADT be required to have Pinky's I.D. and Mandingo's I.D. on file ??
Would ninja1 be required to have Pinky's I.D. and Mandingo's I.D. on file??
Are both ADT and ninja1 required to have those I.D. on file??

The Dost case defines what is and what is not covered by 2257. However, Dost is a children pornography case. But if you read that case you will understand how difficult it is to define "sexual explicit."
Fully clothed camel toe pics can require 2257. Women pulling on their nipple pics can require 2257. There are no hard and fast rules. Its hard to explain to a client but the easiest way to understand it is this way -- does the pic/video have stroke value ? Usually plain nude images dont. Stick a finger into the vagina and bingo you need 2257....
Nina -- yes to both and you would also be violating Pinky's copyright and Pinky and Mandingo's Right to Publicity.
AsianAnal -- no, unless you posted that content somewhere. 2257 is for content producers and publishers, not purchasers.
