I remember several threads in the past that discussed this same topic. The bottom line always seems to be that it's NOT prostitution in the eyes of California law...but most fans still consider porn girls prostitutes because they get paid for sex.
Well who is doing the paying? The studios are, the actors and actresses aren't paying each other to have sex with one another. Prostitution is one party paying the other for sexual favors, not a production company compensating both actors to fuck on camera.

How about this scenario? I'm wining and dining a prospective business interest. After dinner, I put him in a limousine that contains two beautiful women and tell them to show him a good time. They've been paid, but no money has passed hands in front of this guy, and he's shown the time of his life. But the women have been paid. Are they prostitutes? I paid, but didn't fuck them. Well in a conventional scene you're talking about a crew on a set filming a scene with everyone being paid by a production company, but with a POV it might be just one guy, a girl, and a camera. Take for example the days of the Old West where you had the mining town and the local bawdy house(bordello). You've seen these in the movies. In the Old West they at least knew what they were and didn't mince words. In today's world we get bogged down in semantics. Is it the word prostitute? In the old days they even had bordello in the middle of a respectable neighborhood because the girls acted like ladies when they went out in public ilrespect of what they did in that house. William Faulkner wrote about this in a book. They seemed to have figured it out 100+ years ago about what prostitution was and it's place in society and people walked around with their heads(no pun intended) held high.

Admittedly this never has and probably never will be filed in my mind under the category of great philosophical debates or topics with the most influence on society. In theory this could allow a case to be made but not without making mountains out of molehills.

well being paid for sex acts is prostitution whether its filmed or not. But no one should be told what they can do with their bodies whether it be sex, abortion, etc. So its a tricky subject.

Technically, it is prostitution, money being exchanged for sex, regardless of who is paying and receiving the sex. Legally, it's another story.
Why do you only mention the women? The male porn stars are also selling their bodies to strangers. The focus is always about women being whores but in fact the male performers have more different partners than the female have. And to the question in this thread: I don't think porn is the same as prostitution. Prostitution is 1 person having sex with another person for money. While porn is about sexually satisfying a 3rd person, the viewer. But off course the jobs are related and some porn stars are also doing escort in addition to doing porn. conquistador you're nearly saying the same thing twice. In the second sentence the female or male actor is being "paid" to have sex before the camera. Pay is the magic word. That performer is getting paid(money, not a pearl necklace or a bar of gold) to perform the sexual act. It's irrelevant the Producer, him or herself, is just dolting out cash for a scene(say the guy at Vivid, can't remember his name) or is dolting out cash and fucking the performer as well ala Rodney Moore or Jules Jordan. that's why most stars come from the strip club or escort environments cause the pay-reasons are the same. Many of the stars return to the stripping & escorting(gosh that's another sanitized name for prostitution) worlds after leaving porn.

The two aren't are off by much. But being paid to have sex as yourself and being paid to portray a character in an adult sexual relationship on film have been viewed differently in the eyes of the law.

Now getting into what the so called 'Law' is is a whole nother matter especially local laws amongst the 50 US states(Im not getting into other countries). If the law had it's way, being infested with a lot of uptight jacklegged religious hypocrits, sex would be outlawed let alone prostitution. All of the states have or have had strident laws regarding SEX(even between married people) and PROSTITUTION at one time or another. It didn't stop people from having sex or prostitution taking place. To make a long story short and to further get to my point, ..laws that are put on paper are sometimes impossible to enforce in reality let alone define. So I still stand by my original point of the correlation of porn-to-prostitution and the very very fine line between them ilregard of local laws.
Please, the example you picked out was the most medieval and extreme of all. As if going "well at least the US isn't stoning people to death, everything is ok." You just got pissed at the criticism, which wasn't even a singling out but just to counter the whole "only place in the world with the freedom to do this " as if they are a leader at an area where they not only aren't the only ones but aren't even the leaders in allowing less restrictions.

Perhaps 'prostitution' is a legal word that artificially separates acceptable and unacceptable compensation for sex acts. Women usually choose men who have more money than they do for dating, sex, common-law relationships, and marriage. And quite often even the divorce courts give these women large monetary awards without any determination whether these women have done anything to earn the money besides having sex with the guy. Perhaps courts justify awarding monetary compensation for these women by reasoning that a guy who is sexually satisfied and happy is a guy who works harder and earns more money. And if it wasn't for the lady having sex with him, then perhaps he wouldn't have all that money. She contributed to earning some of that money by having sex with the guy and keeping him happy. Guys do have to pay women for sexual relationships even according to law. Except that this law accepts only some such relationships as legitimate and worthy of monetary compensation. But porn action probably is not considered prostitution because it's not the stud who pays the lady. It's the film director or the porn company manager who pays.
