It doesn't seem like its possible due to price disparities -- download as many movies as you want for 29.95/mo (or whatever) vs. the retailers' VOD download for 30 days for $14.95. Any ideas? The sites' guidelines are all just a little vague. They claim to be "legal" but I don't think I buy it... anyone know for sure? [Link] |

I just don't understand the studios. I'm assuming some of them really don't understand what is going on. To be fair, many of the DVD movies on DeluxePass and AdultBouncer are legitimately licensed now - though not by the studios directly usually but by a broker - BUT what both those AVS systems have done with those licensed movies from RLD and other studios is beyond my comprehension. I've been licensing content on the Net since late '97, web licenses are all very similar and they are very basic in what rights you are given, there is a clause in every web license which states that the movie or photos licensed may not be transferred to any other party, in return for traffic or any other considerations other than some specific uses like TGP or MGP galleries or advertising banners. In short, u have the right to publish the content on a certain number of domains which you must inform the licensor the names of at all times and you cannot share the content with anybody else for any kind of financial gain. When the studios like RLD decided to allow a web content broker to license their content to web companies they did not give anybody the right to do what AdultBouncer and DeluxePass did with their movies which was basically GIVE AWAY their movies to anybody who agreed to put up a site attached to their network. That's how AB and DP get traffic, hundreds and hundreds of webmasters create their own sites with the RLD movies and drive traffic to the mothership. My estimate of what the worth of an RLD movie is to those two fucking cockholster companies is half the production cost of one of the RLD titles, $10,000 anyways per DVD, i say only half the cost of the movie because they aren't getting the movie exclusively - i've licensed RLD titles from the broker - for $175 - figure the deal is 50/50, the studio gets a whopping $90.
Both AB and DP are huge now and do well over a million dollars a month in biz. They also allow other webmasters to set up shop on their servers, free hosting, and upload anything they wanted, almost always stolen content. Both of them are trying to go legitimate because VISA is turning up the heat for one and two, like all thieves, when they make enough money from thievery, the develop a need to become legitimate and become respected. They will never be legitimate, their millions were made on the backs of the producers and the talent they steal from. They used to steal their box covers from AdultDVDEmpire. Too fucking lazy and cheap even to scan in or buy box cover art. That's their modus operandi - steal first, answer questions later. There are some studios who have gone after them and no doubt gotten some kind of 'settlement'. Fuck that, there's no punishment or deterrent there, if people know they can cheaply buy their way out of trouble it just makes the problem worse. DeluxePass sent out a memo a month or so ago that unlicensed content would no longer be tolerated on their servers. More lip service for public consumption no doubt. They know exactly how to run a clean ship, make ever webmaster who joins their system produce licenses for everything they upload and publish. AdultVideoNews 'AVN' should be fucking ashamed of itself. This is a publication that owes every fucking cent of their success to the porn studios of Los Angeles. They have never investigated or said a thing about this MULTI MILLION dollar crime against the entire industry, because there isn't a studio that hasn't been stolen from within the walls of AB and DP. Not only hasn't AVN done a thing on the issue but they have sold advertising to AdultBouncer for a long long time, to DeluxePass to I'm sure. AdultBouncer and DeluxePass were at one time partners. |

| Drew Black broken crankshaft 8011 Posts 9/99 | I still don't understand why their isn't an industry group that keeps a lawyer on retainer specifically to go after pirates as DMCA actions. Get the pirates shut off at their ISPs and you cut off the revenue streams. (It's not that difficult.) It's also not easy for them to simply switch ISPs either because these streaming sites require huge amounts of bandwidth. That type of bandwidth takes time to set up. I bet they could have the prosecution process down to a science within six months. They don't need to take the pirates to court with a lawsuit to get them shutdown although they could choose to sue some of them. |

I think all the rights' owner would have to provide is a letter certifying that the company in question is infringing on copyrighted material, and they are pursuing the matter. This would be cheaper than full-fledged copyright enforcement, and, where sucessful, would make it progressively harder for the pirates to do business. What do you think? Scott Kinney |

However, in order to be successful it would need to have access to an attorney and someone would have to pay the associated costs. |

His cause was noble but he failed, it's impossible to stop copyright theft on the Net but what I try to convince studios is that it's not impossible and not that hard to stop those who try to profit from it. All energies should be spent at the credit card processing level and above right to VISA, that's where the C & D legal letters and DMCA notices, worded by a lawyer so that the credit card processor itself knows it has been put on notice that taking no action will result in legal action against not only the infringer but against the credit card processor and VISA. They have to take those letters seriously in the event some company gets angry enough and does do the right thing and sues somebody's ass for a few million dollars. Studios mostly seem to be in the dark, more concerned about going about their business of making product and money. Funny thing though is that there is more money for them in suing people then there is in selling their product. |
