Recall that the standard is that the person has to have had an objectively reasonable expectation that the conversation is not being overheard or recorded.Perhaps. But the man is a reporter for AVN. That's enough like being a journalist that he's got to have some basic awareness that if a person says something in front of a reporter, the reporter can and will use it, assuming there hasn't been an agreement that it's off the record, for background, or the like. I didn't see any indication that Ross attempted to extract any such agreement from the film crew.Again, for purposes of the law, Ross' expectations regarding whether the conversation would be divulged (to Ford, or to anybody) are not the determining factor.
I suspect that this discussion is of even less interest to the great bulk of the ADT readership than most of the feet-related posts are of interest to me. (What was it that MLyons said? "this is a useless, dead-end discussion"?) Therefore, Shylock, this will be my last post in the thread (assuming that Ford doesn't go off his meds and kill a guy, or something interesting like that).
