Her motives in lending her name to this lawsuit are suspect, in my opinion.
As always, follow the money.
Assuming that Marcus is basically a guy who lives hand-to-mouth, doesn't have substantial assets, and has no personal liability insurance that would provide coverage for this claim -- and I think these are all reasonable assumptions -- then it will be difficult for Lavey to ever collect all or any part of any money judgment she might win in her lawsuit. So why bother suing him? It wouldn't make much sense for an attorney to take a case like this on a contingency fee basis, nor would it make sense for Lavey to pay an attorney out of her pocket to bring this case.
What would make sense is that this case is being subsidized by an individual at the head of a well-funded organization who is trying to impose a personal agenda on the porn business, and who views any publicity tending to portray porn in a negative light -- particularly publicity which would tend to reinforce a view that porn actors are so irresponsible that the government must step in and protect them from each other -- as helpful in advancing that agenda.
