IN THE LATEST AVN MAGAZINE THERE IS AN ARTICLE STATING THAT MARC WALLICE IS GOING TO DIRECT.. MY QUESITON IS WOULDN'T THIS BE BAD FOR THE COMPANY WHO HIRED HIM,, ??

Well, Patrick Collins, for whom Dick'o'Death worked when he was unmasked, didn't have any legal trouble over it that I know of. So long as the studio ensures there is no sexual contact with anyone else I suppose they could get away with it.

But...

The studios are used to the idea the porn consumers aren't Politically Correct and will put up with anything so long as the girl has a loose butt. But this, I think, goes too far. There are a lot of consumers who still remember what he did and will protest long and loud. I would be willing to ask the local smut store to boycott anyone dealing with Wallice.

He did have many friends in the industry who might be willing to help him out with a job. That’s an honorable motive, but Dick'o'Death clearly acted with "reckless disregard" and maybe even "depraved indifference" (if he did know he was in fact infected), and this is too much for me. Let him get a job in another industry.

As much as I despise Marc for what I believe he did to me, I hope this thread doesn't go too sour. I'd like it to stay open so people can be aware of it and be able to make decisions for themselves.

I'll be very curious to see if Marc Wallice's name appears anywhere on the video he is supposed to be shooting or if it will be included in any press materials....or if it will be released under a different name. I would imagine the porn community is a rather small one and word of exacty what the project is called is bound to be idenified....I just question the wisdom of any company in hiring someone with so much baggage....

I think hiring Marc Wallice really goes too far. Two questions spring to mind.

Given his past behaviour, how can any woman who works for him trust that he will maintain high health standards on his set?

And what does his hiring say about the company he works for and its commitment to protecting their female stars?

Wallice might sincerely regret what he is supposed to have done -- although I have never read any such statement from him (have you Tricia?). Nevertheless, the harm inflicted on others was so severe and reflected such a serious lack of respect for others that he should never be allowed on a movie set again.

Although the article doesn't mention the title or the company, it does include the female cast: Melanie, Wendy James, Renee Pornero, Taylor Rain, Lil Bit More, Nadia Nyce and Cameron Caine.

Based on iafd listings, there is no movie out containing that cast yet. But I think that it should be easy to figure out what the movie (and the company) is once it is released.

about this & was assured they did not hire
Marc Wallice.

Why would anyone hire him with his bad reputation?

I seriously doubt whether any of the new women of porn even know who he is or what he did. Work is work. Where he may face some resentment on the production level is from the male talent and behind the scenes people who have been around longer. Ultimately it's up to us as consumers to ignore his product and let it die on the vine. I guarantee that all those beautiful girls will do great scenes for somebody else, and we'll watch that.

Honestly... I would avoid buying his stuff just on principle. I can't believe anybody in the porn world would even let him work for them. Even before the HIV thing came out he wasn't a very liked person by his peers(I have read this in numerous interviews). If this rumor turns out to be true the studio will take alot of heat for it. As far as I am concerned he should of been done along time ago in porn. McDonald's hiring? He just left a very bad taste in the mouth in pornworld. As "what's her name" said in the "Weakest Link"...goodbye.

Unfortunately, that doesn't seem to be the case. He's been an editor for a while now, most recently for Simon Wolf. When this topic last came up (in a thread that was utimately deleted), someone posted that they had contacted Simon Wolf Productions directly about this. Their reply was essentially "Tough shit, we're keeping him".

Other than me, I don't know how many people have made a concious effort to avoid Simon Wolf product. But at the time, it didn't seem like there were many who cared that much.

Wow. Thanks for the info Bill. I have heard that Marc was doing some behind the scenes work for some studio. Never knew the name. Geez, "Simon Wolf". I like their stuff and have even got DVDs from them recently. Well, the last DVD I got from "Simon Wolf" will be my last. Thanks again for the info my friend. I too will make an effort to not buy from them until I hear/confirm Marc is not working for them.

I was one of the people who was in e-mail contact with Simon Wolf at the time of the previous incident. We considered each other friends, though admittedly that friendship was very new and hadn't yet been tested. We actually had a "verbal agreement" (well, technically it was a written agreement, but it was by e-mail and not a legally binding contract) that I would be assisting with script development for For Women Only 2 (a movie which has apparently never been made). Because I chose to question the business ethics of employing Marc Wallice and the PR wisdom of ignoring customer concerns over this issue, Simon chose to end our friendship in a semi-public way, with copies of his e-mail response sent to at least seven or eight other people.

I was very hurt by this and almost quit reviewing. My husband and my friends encouraged me to persevere, though, so I'm still here, just no longer comfortable reviewing or recommending SWP movies (even though the early ones I watched were of very high quality).

I don't know if Wallice has continued to do work for Simon Wolf. I read that he has long since moved on, but I would not consider the source of that information to be reliable.

Gosh, I must still be really upset over this; I'm even shaking a little as I type this. Maybe I should heed Cal's advice to "see no evil, speak no evil, tell no evil." I truly don't want this whole topic to flame up again. But I can't completely deny my feelings in this matter, either. And 14 months later, my feelings are still sour ones.

Add me to the list who has not rented or bought from Simon Wolf since news came out that He Who Must Not Be Named was working for them. I would not discourage or encourage anyone to do the same, it is totally up to the individual but again anyone who would do what he did gets no sympathy from me. So if he's working for a new company then that one has lost my business as soon as I find out who they are.

I don't want to derail this thread or inflame what has so far been a very well mannered discussion about painful issues , but ...

A man was sentenced to 8 years in jail last week in my country ( England ) . It seems he had knowingly infected at least 2 women with the illness , though it could have been more . He was convicted under the banner of causing biological Grievous Bodily Harm . You can read more about the story here if you wish , though I warn you it is not pleasant reading . I'd not posted anything about this before 'cause it might have been upsetting to a fellow member .

On the subject of Simon Wolf discs , my unwillingness to buy any of them isn't totally without self interest . How could I jack off to his stuff with the thought that MW may have had something to do with production floating around in the back of my mind .

I guess that makes me #8. The thing that pissed me off most about Marc working for Simon was that about a week before the news that Dick O Death was working for Simon was that ADE had a great sale on Simon's stuff. I picked up a few titles I'd been really looking forward to or was just curious about since I had been really impressed with both Simon and his product. After Simon's response to those of us who questioned him about DOD working for him I've left them gather dust in the corner of the basement and haven't so much as rented a SWP product. I know I've reviewed a few DVDs he was involved with after his alleged transgretions against mankind, but I think most of those reviews have a disclaimer about his alleged deeds also (and if I missed any, please drop me an e-mail so that I can add it). I'll even go one step further to say that I will not knowingly review a DVD that Marc "Dick O Death" Wallice is involved in since he allegedly faked his HIV test results .

US law is mostly based on English common law, except in Louisiana. The two legal principles that would seem in general to apply here are Reckless Disregard or Depraved Indifference . You usually need to prove that the defendant’s act directly resulted to the victim’s infection (in this case) and that, as far as I know, was not done. It probably did, but a jury could well find reasonable doubt that it was Marc and not someone else.

California presumably allows some sort of “assault” charge if an HIV+ person has unprotected sex with an uninformed partner, but that depends on specific case law and I have no idea what California courts have done, and how interested prosecutors are in such things.

I've been told by a lawyer that in California, a precedent has been set that the person being accused of knowingly transmitting HIV to another person has to be proven to have maliciously wanted to infect the other person.

Well, that's the usual point of reckless disregard and depraved indifference - it's possible to act with such disregard as to whether or not you injure someone that the act itself constitutes intent.

The lawyer make have been talking about civil law and that's an entirely different problem. But there’s so much politics surrounding HIV that maybe criminal case law in California says that a person who knows or has reason to know they are HIV+ who has unprotected sex isn’t acting with reckless disregard...

I suspect that a criminal prosecutor who wanted to could make a case if it could be proven that Marc knew or had reason to know he was HIV+. On the practical side a prosecutor might think such a case too expensive since it might require quite a bit of (unbudgeted) medical testing developing the evidence.

I didn’t mean to drag this out – I was originally commenting to Lee from England that there is (at least in most of the US) law here that covers the same sort of thing that happened in the case he referenced. It also probably isn’t obvious to most foreigners that each state in the US can be a bit different in this situation.

Ps. Earlier I said “assault” but meant “battery”.

You should buy Tricia lunch next time you're in the area and talk about it. It's a big deal.

It's worth noting that Marc wasn't new talent or an unknown at that point: he had been in the industry forever, at least ten years, and was good friends with many people including the girls. He was part of Elegant Angel, one of the top companies at that time. This was not the case of an outsider, someone new, or someone on the fringe. Marc had long ago earned whatever trust the girls and industry people had to give when he betrayed that trust.

"Trust But Verify" - it doesn't matter who the guy is, how big a star he is with which company or how many years you've been performing together. *You*, not just the director and not just the agent, need to look at that test result carefully, and say No if there's anything less the perfect about it.

Wow. I couldn't have said it better myself.

I had known Marc for 2 years at point, which was only a fraction of the amount of time he had been in the business. In fact, the first of 2 times I worked with him in the month (Nov 1997) that he infected me, Brandon Iron, who was a new guy to the business back then, was called in to work with me. I had never heard of him, and declined, because I wanted to play it more safe. I worked with Marc instead. I took a peek at his test - saw negative, saw the date, didn't look at the fact that it said he was a 44-year-old woman.

Tricia, I feel really bad for you. Marc is an asshole for what he did. How could he do that? I'm sure that he just wanted to keep his career alive, but there is no excuse. Infecting others when he knew that he was infected himself is just plain wrong. Also, I don't see how he was able to fake his test. I hope that can't ever happen again.

I remember when this case was being reported AND if memory serves regarding English Law, you don't need a Unanimous verdict to convict, just a Majority verdict, which isn't the case in the USA (as far as I know, although some states may be different). This would mean that it should be a lot easier to convict someone like MW, if the case happened on this side of the Atlantic.


This does bring into perspective, the extent that US Law has progressed, that to the majority of people, common sense or more realistically common opinion would find him guilty under criminal law, but nowadays there are so many technicalities and loopholes in the law, that prosecutors wouldn't attempt to prosecute.


I am not trying to further the argument into the situation with US law, but just stating what might happen here instead. I didn't particularly like the situation when the details were revealed a few years back, and I wouldn't buy any modern stuff if he was involved with it either.
