Max Trial Postponed Until 2003 Max Hardcore
LOS ANGELES — If Max Hardcore looks a bit distracted during the 2003 Adult Entertainment Expo in Las Vegas, be kind to him: He's due to start his retrial on obscenity charges the day after he gets back.
The Expo will run from Jan. 9-12, 2003, and Hardcore will be due in Los Angeles Criminal Court at 9 a.m. on the 13th, where a new jury will again consider whether his tape, Max Extreme 4, fits the legal description of "obscenity." The retrial had originally been scheduled to begin on Oct. 30, 2002.
"We asked the court to push the trial back because the transcripts of the last trial weren't ready yet," explained Jeffrey Douglas, Hardcore's attorney. "I asked the court reporter when they could be ready, and she said she was tied up with other work until December 12, so I said, 'How about December 13?' She laughed."
The reason for the chuckling was that the transcript for the six-day trial could easily run more than 1500 pages; quite an undertaking for a court reporter, even though while the trial was in progress, she was providing, on computer monitors at counsel table and on the judge's bench, a real-time, blow-by-blow account of what was being said.
Since Los Angeles has recently changed the way it schedules cases, it is unclear whether the retrial will again be in front of Judge Michael Kellogg, though for various reasons, that is likely. Kellogg is already familiar with the case, and has made rulings on the admissibility of evidence that it would be redundant to re-argue in front of a new judge.
Douglas also said he expects the new trial to take less time because of the previous rulings.
