It's when you keep playing "chicken" with the authorities. Rob Black understands it now (maybe). Max already had a previous run in with the law, but still did not get it and he kept doing the same thing he wanted to do, knowing he would get burned somewhere down the pike. Black and Max kept defying the law and goading them into doing something about the kind of movies they made. The law took them on, although they used some rather dubious methods, by disguising themselves as "customers" and ordering their material through the mail in states that were less liberal. Max made the fatal mistake of making his uncut material available through Jadedvideo in the US. Jaded came out unscathed and Max went to jail. One made the stuff, while the other distributed it probably knowing it was "problematic", but only one went to jail. Max should have continued selling his uncut versions to European distributors as he previously had. I don't know if he gave reasons for this decision (money, ego, fit of daring, recklessness?), but it would be interesting to know what they were. I did not hear of his motivations, or probably were not reported.
My understanding is that he was sentenced to six years and has to serve at least 47 months before even thinking about being released. I am sure his ass is reamed nightly by five bubbas, he thought he was tough but I know there are tougher inmates than him and they will take full advantage of it. I have a feeling that Max will go back to what he did before once he is out, just under a different name (the name Max Hardcore is now owned by the Federal Government and no one may use it ever again).

Max was fearful that the feds would take his house away, but it seems it did not happen. Why would he not have the right to use his porn name? Lords is still using her porn name, and I am sure there other people in porn who had skirmishes with the law, and did not lose their porn/business pseudonyms.
They don't always take the name, but I think I read that they did in this instance. It is more common to take the business name away in income tax judgments.
You say that like anyone would really want to. I don't think anyone is that desperate.

I will have to check into it. I don't recall reading anything about feds prohibiting him from using the Max Hardcore name. This was an obscenity trial and it had nothing to do with tax evasion. Max was not charged, accused or received any sentence for tax evasion. Janine was sentenced for tax evasion and she still has an internet site up with hc material and using her name. Agreed. Max (Paul Little) got 4 years(47 months or something) and a crushing fine, basically for flaunting his offensiveness -- actually trying to offend people -- and it worked. Although his prosecution was unfair, I have no sympathy for the man, a sick brained lowlife misogynist fool, who is exactly where he should be for exactly the wrong reason. His real crime, I believe, is that, by taunting the anti-porners with his product and public flaunting of it to boost curiosity and sales, he made it easy to convict him and encouraged the prudish moral hypocrites to continue their crusade against pornography. Now, decent folks like the Staglianos who have more than enough trouble without it, are burdened with an outrageous persecution, and the whole porn community is susceptible to the encouragement Paul F. I have always been very conflicted on what to think about Max. I didn't like his stuff, and I didn't like what it represented. But, if the adult industry fails to stand up for Max, then pretty soon you slide on down until something like Playboy is prosecuted. There are way too many groups, especially in the Bible-Belt south who think that People magazine is pornographic, and they've got money behind them. Look at how often hotel chains are being hassled and/or forced to defend themselves for offering a PPV "adult" channel on their TV sets. So while guys like Max are pretty abhorent, to not defend him, allows the Feds to go after the Staglianos and whomever else they feel like going after. I know plenty of people thought that once Obama took the oath of office, this type of stuff would go away. I now tend to think that given the trouble he's beginning to have over issues like health care & the economy, it will be an easy throwaway to be able to point to porn prosecutions so he can say.. "See, I'm cleaning things up!" Plus, he has also said what I think are some chilling things about controlling the internet. So I think that more than ever, the adult industry has to stand up taller for people like Max, to be able to stop a slide where, anything deemed "edgy" gets government attention. Do I make any sense?

There's no doubt in my mind, as I said, that Max's verdict has encouraged the morality tyrants to keep going, and we can blame him for that. To support people who make the least defensible kind of sick crap that Little put out allows people -- even people who, though they may not care for porn, do not want to bother with it -- to think that supporters of porn's right to exist want no limits at all. It allows them (I do not say encourages them, nor do I say that their supposition is justifiable) to fear what will come next if the Max Hardcores are acquitted: kiddie porn, snuff, who knows. It allows them to support Max's persecutors, who appear to be fighting not porn, but misogyny, and. the dignity and safety of women. Much better, IMO to let the Max Hardcores stand or fall by their own actions and zealously support instead product and producers that are far more representative of the harmless, responsibly self regulated erotic fun that porn really is for the most part. Max Hardcore has done more for the anti porn movement than the movement had any hope of ever doing for itself. The thought of helping him do it, for ANY reason, is repugnant.

No, you are not making sense. Max and Rob Black wrapped themselves up in the American flag and making everyone believe that they had the right to produce and distribute what they pretty much liked without any hinderance from anyone. Read some of the statements Max and Rob Black made after their arrest. They believed that they were fighting for everyone's rights, and that the porn industry should support them and stand high behind them all the way. The problem is, the porn industry was always leery of their intentions and were quite happy (although they did not openly say so) to rid of them, as their material caused problems for the whole industry. It WAS controversial and they wanted none of it. They did no want to feds to start rummaging through their own activities. The fact that the industry said and did nothing in their defense speaks very clearly of what it thught of these two. If the porn industry thought it was a battle worth fighting for, I am sure they would have done more. They played chicken with the law and they paid the price. Both Black and Max kept taunting the authorities to shut them down and to charge for obscenitiy. They got their wish. I do not like the sleazy tactics the feds used, but anyone who has been in the porn business and has some basic legal understanding, should have anticipated their move. It was reckless for Black to taunt the authorities (in a documentary aired by PBS)in that fashion and with the material in question, and for Max to allow Jadedvideo to sell his controversial movies domestically (when for many years he had been quite content to make it available only overseas). Reckless disregard will eventually come back to haunt you.

People say such things because it gives them pleasure to imagine that those who they dislike are suffering. These types of people are often just as bad, or worse, than the people by whom they claim to be so disgusted. Atleast all the girls in Max's movies willingly consented to whatever he did to them, which is completely different than happily wishing for someone to be gangraped in prison for doing something that wasn't even illegal, but that you just don't like. It makes you wonder who is sicker: Max, or the people who hate him?
