This case isn't likely to move. Such a shame he's leaving the industry. I liked his performances.

Haven't seen this scene but am surprised as I wasn't aware Dogfart still did scenes with raceplay in them. It's one of the reasons I stopped my membership years ago as they stopped making that type of content. They're making it out like this is a common occurrence on that site but it's very rare these days for the n word to be used in porn. I'm also pretty sure I saw Moe in some raceplay scenes for dogfart as well back then with the likes of Spring Thomas. I may be mistaken though and it doesn't excuse it happening in this scene if he repeatedly refused to give consent for the word to be used.
Would think it will be difficult to prove either way unless there is footage of him saying no.

^ Especially if he is fine with it being said to him or in his vicinity, the more recently the better from a defendant's standpoint. Wesley Pipes will be the most likely candidate to lose this case for him.

Dogfart already took down the scene and I suppose is editing it out, but I did download it before hand. I also didn't know they did this in a scene more recently (last year) as they haven't done any in a long while. N-word usage in mainstream porn is basically dead at this point. As far as the scene, well, in comparison with Moe's previous scenes with N-word usage, this one was by far the weakest. Ryan Conner said it a couple of times at the very end in a quiet voice. I know that it's a consent issue on this particular scene and not any of the others, so I digress. I didn't notice any difference in his mood or anything during or afterwards (to be fair, you couldn't see his face during and there was a cut). Not that it matters, but he did pop after she said it (no cut) and then was seen smiling on the couch as the camera faded to black.
Bottom line, this seems like a standard he said/she said. I watched the BTS footage as well and there was nothing in there incriminating (obviously). It's entirely possible it happened exactly as Moe states it did, but there isn't any proof, or if there is, it's obviously not going to be released. And unfortunately for Moe, even though it technically is irrelevant to this particular incident, he has (seemingly) allowed N-word usage scenes to take place in the past. Sure, you can rule out the ones (I guess) with Wesley Pipes or other male talent in them like the Jessie Parker and Summer Carter BlacksOnBlondes gangbangs scenes, but I feel that two big ones that really hurt him here are the Holly Michaels BG and the Leya Falcon (Cammille Austin) scene (but primarily the BTS, although she also says it during the main scene as well). The issue with these scenes is:
1.) In the Holly Michaels one, there are no other male talents in it to 'persuade' him into going along with it. The scene starts off at a park where she says it there, then of course there is a cut and they are back at the studio. There's time here to tell the director he's not comfortable with it being said. Regardless, the scene continues and she says it a record number of times and it becomes a staple of 'hard raceplay' scenes.
2.) In the Leya Falcon (Cammille Austin) BTS, Leya says it a record number of times here, too. The most interesting aspect of this scene, however, is that it is Jovan that expresses his discomfort with her saying it and not Moe. Yes, the same Jovan that accused a director/set of racism not too long ago. Where was Moe in all of that?
Again, you can ignore all of this and just consider it a 'sex act' like anal or something where you have to get the performer's consent every time, which is fine. Not saying that's not the case. Moe very well could of just not felt comfortable with it in that particular scene or maybe he had a change of heart. He also waited a year before finally coming forward, which Nat Turnher calls him out on (Nat was in the scene, too, and if you go through his twitter timeline, he's made several videos/callouts on Moe with regard to the scene in question, disrespect of female talent and rape attempts. Jenna Ivory also accuses Moe of raping someone).
