Registering a trademark does not automatically entitle you to existing uses of the name, uses outside of the geographic areas in which your trademark is registered, or in areas of commerce other than those covered by your trademark. The Uniform Domain-name Dispute resolution Policy (UDRP) requires that the challenger prove three elements: The disputed domain name must be identical or confusingly similar to that of the challenger, The domain must not be in use for a legitimate purpose, and The domain must have been registered in bad faith. All three elements must be proven for the challenge to succeed. It can be quite difficult to prove all three elements, especially if the use is legitimate. In this case, mollybennett.com was registered in 2002, and is in active use by a designer of the same name. A UDRP challenge would certainly fail on all three elements. In addition, since it is obvious that the challenge would fail, there is the distinct possibility that the challenger could be labeled as a reverse domain hijacker. [background] The dispute in which I assisted involved a common term, which was trademarked by multiple companies in different areas of commerce, and had been in legitimate use by my friend for well over a decade. We prevailed, disproving all three elements, and in addition, a finding of Reverse Name Hijacking was returned against the challenger in that case. I know of another case where the challenger was a well known company, with lots of lawyers. The owner of the domain name was a sole proprietor. BUT, He had a rock solid claim to the name, having registered it many years before the challenger was founded. He won. The challenger later paid big $$$$$$ to purchase the name from him. [Link] |
