Clearly, the OSHA mandate to consider talent employees of the studios is about its ability to regulate more aggressively the porn indisutry if the performers are considered employees. OSHA looses a great deal of its regulatory power when performers act as sub-contractors.

It is just so frsutrating that government wants to meddle to protect the safety of the employees. If there was truly an issue of such dire safety, there would be a shortage of performers. We always seem to have plenty of talent available in California, despite these "risks."

I have often made the comparison of race car drivers and porn performers. For both parties, compensation is good, the acts we perform as drivers or performers are something that gives most of us some sort of pleasure, and there is clearly some danger involved. Guess what OSHA, the danger is no surprise to those involved!!! We know the risks. ANd a pretty good system is in place to reduce those risks. Just like NASCAR and CART and the FIA have all done... without government interference!!! Just because we're making porn, it does not make us stupid!

What OSHA is failing to look at by its constant suggestion to use condoms and avoid internal cumshots is that consumers have proven that they will NOT buy products that are not "real." I am sure that NASCAR would be much safer if they limited speeds to 100 mph. Who would watch? NO ONE!!!! But it would be much safer (can you hear my sarcasm?). And then go out of business.

Contract girls and boys are more likely to fall under the employee banner, and I am on the fence about them. But who is Venus an employee of if she shoots for Skeeter on Monday, PXP on Tuesday, Red Light on Thursday, Evil Angel on Friday, and John Smith's website on Saturday??? I think she was playing tennis on her day off. :) This is NOT working as an employee. Clearly, OSHA is liberally interpreting its rules in applying employee status in such a situation.

The point is that OSHA seems to be acting out of typical government attitude that people cannot make their own decision and decide for themselves what is right and wrong.

I know the risks every time I stick my dick in some girl (not just for work), but I also trust that she is being smart and, of course, is tested.

I don't want government interference in our biz any more than it already is!

I'm locking this thread because the same topic is being covered in the Cal/OSHA thread. Feel free to re-post your opinion there. Thanks.
