CA Labor Commissioner Rules for Nadya Nabakova Against LA Direct (AVN/Mark Kernes)
LONG BEACH, Calif.-In a decision released today by the California Labor Commissioner, adult actress Nadya Nabakova (who has since renamed herself Bunny Colby) has prevailed in her claims against talent agency Direct Models Inc. (often referred to as "LA Direct" or "LA Direct Models") and its owner, Derek Hay, regarding Nabakova's complaints of being forced to work under unsafe conditions while under contract to the agency, of having her earnings improperly withheld by the agency, and of being improperly charged for items by the agency which it did not have the legal right to collect.

Wow that is some big fucking news. Imagine how many other performers have the exact same complaints against either LA Direct or other agencies (and I'm not just talking about the '4 Jane Does' mentioned in this thread). Surely with this judgment, they have a better chance of getting a favourable judgment of their own.

LA Direct Models Weighs Appealing Nadya Nabakova Ruling (Xbiz)
LOS ANGELES - Adult talent agent Derek Hay said he may appeal a decision issued yesterday against his company, LA Direct Models, in a complaint that reached the California Labor Commissioner's standards enforcement division.
A Labor Commissioner attorney awarded adult performer Nadya Nabakova (now known as Bunny Colby) $3,500 for unpaid earnings and interest.
The state's attorney also found that LA Direct Models wrongfully withheld $2,775 for alleged rent due, $200 for photos she had taken by a friend and $250 for commissions held unlawfully.
Nabakova was further awarded $11,450 in attorney's fees in the case.

Looks like publicly suing Derek worked better than filing anonymous complaints. Perhaps Jane Does would have been out of their contracts as well if they'd joined Nadya in court.

One would think that stuff like this would put off models from signing with LA Direct but apparently not since their new models who were warned about this didn't take it seriously. In general, LA Direct signed with 10 or so new models over the last few months so doesn't look like this whole thing slowed them down at all.

Sounds like an LA Direct model Adriana Chechik is annoyed that directors are trying to educate and warn new models about her agency (doubt she'd have tweeted that otherwise)

Seems contradictory to be concerned about how models feel while supporting LA Direct and attracting other models to sign with the them.

I really hope the coming 20s sees the end of Derek and La Direct and the rise of performer compatible ethical agencies.

Another LA Direct model Sydney Cole is considering suing them after sitting without work for a while and trying to get out of their contract several times
Also an example of how LA Direct pretends to promote models they actively block from shooting

Its crazy that I read today what happened with Adria Rae. Im glad she took a stand and others took a stand because what she and others went through should never happen to anyone.

LA Direct has ruined so many once promising careers at this point. They need to put an end to this now.

Everyone interested in the industry should watch the NBC documentary regarding LA Direct Models. It is great reporting and illustrates why the industry needs to be regulated and inspected more as Lisa Ann explains.

Racketeering should not be apart of the industry. If half of what the ladies discussed in the documentary is true LA Direct Models should be punished.

Everyone interested should also watch Derek Hay's one hour video response to the allegations. He explains in some detail how he says his agency operates.

Majority doesn't do enough research and just sign with whatever agency contacts them first

Funny thing was that at the Portland Exxxotica their were still girls saying that they are represented by LA Direct. Yet others say that LA Direct did not get their license to operate renewed. The state of California refused to renew Derek's license.

I Think the Industry as a whole is underestimating the impact this thing will have on it , can't see the danger of such practices seen as "usual in porn" by the great public , it could have consequences

^^I just checked their site and they say on their main page that they are still licensed and bonded and show the license number so unless you have verifiable info from performers that they have lost their license then I would classify the info as incorrect. They also still list an impressive number of performers so not sure where some of those people got their info from.

^You may be correct but in which direction will it lead it?

^ and ^^^

The state shows the talent agency license still valid as of four days ago. It comes up for renewal at the end of August.

I also checked their general business registration, and it is still valid as of two days ago. It is updated daily.

Correct, but for the purposes of these legal proceedings, she is going by the name Shay Evans because that's the name she used when she was under contract with LA Direct Models and the alleged violations occurred. Same reason Zoe Sparx is referred to as Andi Rye.

Here an excerpt from the article Pringles linked to, explaining the name issue:

"Originally, the petitioning performers went by "Jane Does 1-5," but a stipulation (agreement between both parties' attorneys) before the hearing allowed for their stage names to be revealed. Their legal names and other identifying information revealed during the hearings are kept confidential for their safety, and are to be redacted from all pieces of submitted evidence.

The "Jane Does" are Charlotte Cross (JD1), Sofi Ryan (JD2), Andi Rye (JD3), Hadley Viscara (JD4) and Shay Evans (JD5).

Andi Rye and Shay Evans stated that they have stopped using those stage names because of their association with their years with Derek Hay and LA Direct. Shay Evans continues to perform as Gia Milana. Rye, through Gelbard, requested that only her former name be used in association with this matter."

Labor Board: Derek Hay's Defense Begins Presenting Their Case (Xbiz)

LOS ANGELES - The second day of the second set of hearings concerning the Labor Board petition filed on behalf of five former models against agent Derek Hay and LA Direct took place today in downtown Los Angeles.

After the petitioners presented their case during the first set of hearings in late September, and their attorney Allan Gelbard rested their case at the end of cross-examinations yesterday, it was time for Hay's defense to present the respondent's case-in-chief.

WhatsApp Recording Provides a Shocking Finale for the Derek Hay Hearings (Xbiz)

LOS ANGELES - Closing his cross-examination of agent Derek Hay, attorney Allan Gelbard, representing five former clients of his LA Direct agency, played his strongest card: a WhatsApp recording where Hay appears to be communicating with adult performer Mia Malkova about an opportunity to meet a gentleman in Dubai in exchange for a large sum of money.

APAC Letter of Support for the Jane Does (APAC)

The Adult Performer Advocacy Committee stands in solidarity with the Jane Does who have chosen to come forward with allegations against their former talent agent, Derek Hay. We know that it takes an enormous amount of courage and conviction for any performer to speak out in a situation like this, and we applaud their bravery. We want them to know that they are seen, and that their grievances are heard by the adult film community. As in any professional environment, so in the adult industry: misuse of power or abuse of authority must never be tolerated. While we are in no position to pass legal judgment regarding the allegations or to state with certainty the legal accountability of any entity or its actions in this case, APAC supports any performer who speaks out to advocate for themselves and others. We hope, regardless of the outcome of this case, that performers continue to speak their truth and fight for a better industry.

Thank you for your courage.

Sincerely, from the Board of the Adult Performer Advocacy Committee
