States and municipalities have laws banning specific acts. IIRC, an obscenity law has to be built on a foundation of a violation of a state or local statute, ie the law says no fisting in videos, and the video in question has fisting in it. A quick internet search will yeild a weath of state and local laws that are perverse in the specifitity of the acts banned from being depicted in films/videos.

Whether or not the state or local statute is a constitutional restriction of speach hinges on Miller. If the fisting depiction is defensible (as decided by a jury) under any one of the three prongs of the Miller test, the suppression of the depiction is deamed unconstitution under the First Ammendment.

If the depiction cannot be defended by any one of the three Miller tests, then it is deemed to be "obscenity" which according to Supreme Court presedent is not speach protected by the First Ammendment.

At any rate, I believe that idea "obscenity" inconsistant with America's core values, and will ultimately prove to be an untenable legal concept, but in the meanwhile, Miller provide a fantastically large umbrella of protection. You would not believe the (self-imposed under fear of proscecution) restrictions that magazines worked under. I wish I still had the old guideline sheets, because they'd look unbelievably quaint by today's standards.

When Clinton came to office, it was the stated policy of his justice department to table obscenity (ie consenting adults) proscecutions, and focus on the explotation of children. IIRC there were zero obscenity prosecutions during Clintons two terms, and if you look at magazines publish in 1997 vs 1987 you can clearly see the difference Clinton's policies had on what sorts of images where published.

Obscenity, at least as a form of speech that is denied constitutional protection, is only speech pertaining to what happens between our legs. Violence, no matter how graphic, can never be considered obscenity, so long as it does not involve cocks, pussies, or assholes.

This is all part of an absolutely bizarre doctrine that holds that the state has some special claim on our genitals that they don't have on the rest of bodies, and some special claim on our minds, when we are thinking about sex, that they don't have when we think about anything else.

It's an absolutely medieval attititude that I regard as one of the last vestiges of monarchal rule by divine right, ie the state, in the form of the king, is granted, by God, ultimate dominion over it's citizens. We fought a war over this, yet the stink of this notion that the state owns your sexuality still lingers. It's a notion about the relationship of the individual and the state that is perverse and antithetical to our most deeply cheerished ideas about liberty. Yet it persists.

Just changing the party in control of the White House and Congress won't eliminate attempted censorship. A change also needs to take place in local elections.

That's why, regardless of whether the largest candidate that you are supporting is a shoe in, has no chance or will be in a tightly contested race, it's important to show up and vote for candidates in the smaller elections as well. Probably even more important.
