What if you broke the condom purposefully than wore it broken and sorta "rolled up". Is that weird to think? Hopefully the court challenges (and 1st amendment) prevail and this nonsense goes to the wayside but would a condom worn broken still be a violation? The technology exists to give the performers better protection in the workplace but the studios simply do not want to pay for it. This 1st amendment/we're going to move song and dance is the same stuff we hear any time any regulatory regime is introduced in any industry. It does not really surprise me that the performers are not for the law since they already work with lopsided bullshit contracts, no pension plan, no insurance, no health coverage and no union... so why would they? it is not really up to the employees in an industry where blacklisting runs rampant to decide though so while their opinion may be relevant it is to be taken with a grain of salt. Disclaimer: I work in the legit film industry NOT the porn industry so my views on this matter may be slightly skewed towards the production staff. FWIW: I would do the exact same thing the producers are doing if I was in their shoes since their job is to maximize profit for their investors and get films made. This is why unions and/or government regulation come in handy for workers in the entertainment industry. Just be under no illusions. This is about profit NOT free speech.
