Even if piracy ceases to exist porn will not recover , the reasons for its condition are more profound than that , actually porn piracy is what allowed the develop of the internet and the home media video , and these thing allowed porn to grow.
Porn always lived a double life on this , also porn companies owing some tubesites is the other face of the coin what they lose in one way they gain in the other.
What is really killing porn is that is not as cool as before , sex is of course , but not porn , also the rates porn pays are lower than what a girl would gain escorting , many stars are leaving porn , and remember you can't maintain an industry alive without the stars they are what make a dvd worth buying a site worth joining.
Is there someone who really believe that there are stars who like to be spitted in face and mouth , spanked , hit in face , throated , humiliated in every manner , by words and situations? And this is a regular scene , even those with supposedly teenagers who should show the progressive debauchery of them , actually depicts the same show of any gonzo, rough sex, spanking the turning of the girl like a box rough anal , is it porn?
this kind os scenes are wanted only by those who want them and is not the majority of porn consumers , there's a reason for the large number of parodies , in there there's not any crap

Yesterday I was at my store I picked up a couple of interesting DVDs but when I read all the names I put them down ALL and I repeat ALL of them were escorts.
You really still believe that the crisis of porn must be blamed on piracy?
It is the whole industry to be reformed , there are pornstars presenting here on ADT , not a DVD out so far and yet they are already escorting , the industry is used to gain a pornstar status to get higher rates and money.And the industry is not getting ANY of all that money.
Also considering how much they earn escorting if you want them back you have to pay a lot more than before unless they want to shoot with advertising purposes not wanting to lose their fanbase
Piracy has its share of the blame but the industry is blind to what really are its problem

^ I meant paysites there were scenes and actresses you can't find anywhere else , it developed and covered all niches available actually it helped the industry to understand their customers actual tastes , for example in early 2000 years sites like Black on Blondes and Spring Thomas with their incomes forced the industry to cover that niche , yes there were already some IR publication but it was in early 2000 that the IR market begun to explode , I was a Member back then and I had to pay (if I recall well) $ 29.90 for each site , now you can get all dogfart sites sites for $ 24
Brazzers and Naughty America scenes were available only via internet and both developed the MILF niche which is now not that a niche
that is what I meant by the Internet , Piracy pushed the interest to the limit , I don't know though if the niche market would have been so big without it , maybe not

And they're making the same mistake that the RIAA/MPAA made in going after the low hanging fruit of BitTorrent users.
Instead of dealing with the issue in a rational and reasonable way by offering people a cost effective way of acquiring their content. They're engaging in a slash and burn total war approach rooted in greed to make as much money as humanly possible. And in the process they'll have early successes like the MPAA/RIAA did, but people being clever, they'll inevitably find new and more anonymous ways of acquiring the content they want.
Which will make it impossible to stop, as happened with mp3 and movie filesharing.

Well here we're not even talking about shoplifting, which is actual theft, we're talking about people sharing already purchased content with each other. Which is merely filesharing.
The definition has been so warped though that it is now defined as theft by those who seek to profit from every single use of their content, no matter how limited. And when they're not allowed to do so it becomes wrong in their minds.
And it is quite ironic that those in the adult industry are trying to shame others for using their product. Are they then conceding that their product is morally objectionable? Because I'm sure that some in religious community would be quite surprised to find themselves on the same side as those they oppose in the adult industry.

Solar I agree with you wholeheartedly, beyond the invasion of privacy issues involved here, going after "end-users" will create an incredible amount of ill will in a business already marginalized by mainstream courts (max hardcore case & the john stagliano case amongst others). Further, I think the average Joe or Jane surfing and finding porn at what appears to be a legitimate site (one of the tubes spoken of here) ought to be differentiated by the same Joe or Jane downloading "bit torrents" which most people know is dangerous (to individuals and their computer hardware) and illegal. The one caveat I'd offer here is for the hardcore porn viewers who are on the tubes 5-10 hours a day knowing viewing porn....that would be slightly different.
This exception aside, It seems a bit greedy to call end-users of tubes "pirates" especially when YouTube and other sites have popularized "sharing" for many years now. I know porn is losing money, but going after those who maintain these sites is more fair than pouncing on unsuspecting surfers. I don't get that....those who support the industry even tacitly will turn against it in Metallica like proportions times 100 (Lars got himself into a pickle with his hardcore fans by going after folks who illegally downloaded Metallica songs from Napster when Metallica gave away thousands of cassettes for free to get there music heard back in the very beginning of their career).

That judge talks a good game, but the sanctions he imposed are completely inadequate, in my opinion. The $10,000 sanction and the attorneys fees award to the ad litem counsel will be covered by ten or twelve settlement checks. There is no order that he disgorge the settlements he gouged out of people by issuing unauthorized subpoenas, no restriction imposed on his handling of more cases like this, and no indication that the judge will be referring the matter for disciplinary proceedings before the Texas bar or seeking to have his admission to practice before that particular federal district revoked or suspended. The guy should be put out of business, not given a slap on the wrist and a verbal tongue-lashing.

Excellent post LCF, very interesting and many of my thoughts exactly too..

^A cycle implies you eventually go back to an earlier stage, and that's what happens for me, when I get bored of the extreme stuff I go back to artsy nudes and softcore stuff, all things in moderation.
Having grown up in the pre-internet VCR era I also wonder what it's like for kids nowadays, access to all of the internet's porn as soon as they're old enough to have a pc or a smartphone. True, and one cool thing about today's samey stuff that I am thankful for is it forcing me to seek out new porn, where I discovered 70s sleaze and Alpha France sensuality, both before my time I had completely missed.

I don't think this is the case at all. I think a distinction needs to be made between the tube sites, and torrents. A lot of companies post vids on these sites for advertising. (Siffredi, Reality Kings, Naughty America, Brazzers etc). Consider the fact that AVN even recognizes Best Free Porn Site as a fan award. Pornhub was recognized at AVN 2013.
It seems to me that it would be hard to crack the whip on people viewing these sites when the industry itself almost encourages their use. I'm not familiar with all the revenue streams utilized in porn, but I'm pretty sure that companies have learned how to play nice with the tubes, and know how to profit off of them.

Many companies are still fighting the tube sites tooth and nail.
And AVN drew a LOT of criticism for the "best tube site" category.
When you consider which companies are posting vids to the tube sites, you need to realize that many of them are owned by (or affiliated with) Manwin, the same company that owns the majority of the tube sites - and all of the biggest ones. So they're posting their own material to their own sites.

What I do know is that people nowadays are exposed to a much higher level of nudity and sex in mainstream media than they were 20 years ago, it isn't just a porn thing. The threshold for acceptable displays of nudity and sex has been raised all around, examples: Game Of Thrones TV nudity, The Witcher 2 videogame nudity
I think those are two separate issues that possibly aren't related:
-how having harder stuff available from the start can change a porn consumer's viewing habits.
-how porngirls are supposedly running through the porn gimmick ladder faster than before.
I think the latter has more to do with the economy's effect on how much competition there now is for the average porngirl and how less money is being spent on the luxury that porn is. More competition and less of a payoff means faster turnouts and more of a need to climb the porn gimmick ladder quickly. At this point starring in porn is possibly just a way to boost your escorting revenue. If you look at the urban modelling/magazine industry most of the women there aren't being paid to feature on those mags, they just benefit from the publicity to boost their own stripping/escorting revenues.
As for the former I don't think that just because kids can see rough/hardcore/demeaned porn right out of the gate that it's setting the baseline for them and that they won't watch anything softer than that, they have access to all kinds of content after all, they can choose. Most of us who had only access to the softer stuff as teenagers still overwhelmingly go for vanilla hardcore B/G or G/G. And yet you still have dudes who prefer softcore sex movies(sreviews) or even solo glam stuff(playboyfanforum, meinmyplace) while others go for extreme stuff despite all having grown up on the same shit, people will eventually discover what kind of porn suits them best. IMO the only real effect the availability of all kinds of porn has on newcomers to porn is that they can find what their favorite kind of porn is much faster than we did.

Not to derail the thread but to piggyback off the last few posts...
I believe some kids - of ages we as adults would think are way too young to be doing shit like this - think it's perfectly normal to shoot loads on their girl's faces, including emulating what they see in porn by removing the condom after sex to do so. And I'm only talking about what happens during random hookups. I have nothing to base this on other than my hunch knowing the ease of accessing porn and its evolution to being somewhat mainstream.

Prenda Law Must Pay Sanctions - Appeals Court (Xbiz)
CHICAGO — The 7th U.S. Circuit Court of Appeals on Thursday affirmed a lower court decision levying contempt sanctions against three attorneys who filed a copyright infringement case on behalf of adult operator Lightspeed Media Corp.
In consolidated appeals, the three-judge panel held that an original order calling for $261,000 in sanctions, as well as finding Prenda Law's principals — attorneys John Steele, Paul Hansmeier and Paul Duffy — in civil contempt, were appropriate.
Prenda Law for years has been prolific in exacting payments from porn piracy defendants through court-approved subpoenas.

This issue needs to be handled directly between the parties that produce the material and those that distribute the material. Leave the courts and lawyers out of it.
Once you involve courts in the matter, you open the door to Big Government interfering in people's lives and telling them what they can and can't watch/hear/taste...before you know it, we've become Cuba or China.

Properly used I think the industry could benefit from them, but that would in my opinion also require that the tube sites take steps to prevent unauthorized movies being made available. One quote from Hirsch that I found interesting was, "What I've certainly seen on these celebrity sex tapes is that we've been able to [take] movies down from the tube sites, and that's because we're working closely with them, and when we see [piracy], we let them know that there's something on there illegally, and they remove it immediately." I don't know if it was poor wording on his part but the take away I got was it was because Vivid worked closely with tube sites that the tube sites remove unauthorized material immediately, indicating that this may not be the case for companies who choose not to work with them. Again this could have just been bad wording on his part.

^^Despite Sophie Saint Thomas' assumption to the contrary, there is nothing "unconventional" about what Mr. Hirsch expresses in that interview. I assume that most adult performers wouldn't agree with Hirsch, but they're not the ones running the industry.

Actually it's not against the constitution because of the concept of privately owned intellectual property. The First Amendment only applies to information, not intellectual property.

Prenda Attorneys Enter Not Guilty Pleas (Xbiz)
MINNEAPOLIS - Former Prenda Law attorneys John Steele and Paul Hansmeier both faced a magistrate judge in separate arraignment hearings this month.
Steele and Hansmeier each pleaded not guilty to all charges included in the 18-count indictment, stemming from their law firm's porn piracy program.
Charges included conspiracy to commit fraud, conspiracy to perjure and conspiracy to launder money over a three-year period.

Prenda Attorney Admits Guilt in Porn-Trolling Operation (Xbiz)
MINNEAPOLIS - John Steele, the former Prenda Law partner who allegedly made millions of dollars suing hundreds for illegally downloading adult films, pleaded guilty today to conspiracy to commit mail fraud and wire fraud, as well as conspiracy to launder money.
Admitting to federal prosecutors in Minneapolis that Prenda Law's operation was a scam, Steele brokered a deal that calls for him to cooperate in the prosecution of others involved, presumably his only co-defendant - Prenda Law partner Paul Hansmeier.
Hansmeier, who is suspended from practicing law and recently filed for bankruptcy, has denied similar charges and awaits trial in Minneapolis.
In exchange for Steele's plea, prosecutors agreed that they will dismiss 16 other charges against him, including mail fraud, wire fraud and conspiracy to commit and suborn perjury.
Steele, with the deal, could be sentenced to 8 to 10 years in prison if approved by U.S. District Judge Joan Ericksen. Without a deal in place, the statutory maximum sentencing on the charges is about 40 years.

Prenda Attorney Changes Plea to Guilty in Porn-Trolling Case (Xbiz)
MINNEAPOLIS - Paul Hansmeier, the former Prenda Law partner who was charged with conspiring to extort $6 million from thousands of defendants through porn-trolling lawsuits, has entered a guilty plea in connection with a case involving fraudulent copyright lawsuits.
A second attorney, John Steele, also involved in the case, pleaded guilty in March 2017 to conspiracy to commit mail fraud and wire fraud and conspiracy to commit money laundering.
Today, Hansmeier pleaded guilty to the same charges - conspiracy to commit mail and wire fraud, as well as conspiracy to commit money laundering. He previously pleaded not guilty in connection with the case.
The two counts could spell 20-year prison terms, as well huge criminal fines, per count. He has yet to be sentenced by a federal judge.

U.S. DA Recommends 12.5 Year Sentence for Prenda Law Mastermind Paul Hansmeier (Xbiz)

As XBIZ has extensively reported, Hansmeier, along with Prenda partners John Steele and Paul Duffy, "created a series of fake entities through which they obtained copyrights to pornographic movies, some of which they filmed themselves and then uploaded the films to file sharing websites to lure others to download them."

The attorneys, according to our previous report "would then file fake copyright infringement lawsuits, concealing their own roles in the distribution of the films. Steele admitted to investigators he and Hansmeier would threaten the individuals involved in the fake lawsuits with financial penalties and public embarrassment if they didn't agree to pay a settlement fee."

After a plea agreement, Hansmeier changed his initial not-guilty plea to guilty last August. Steele pled guilty in March 2018. Duffy died in 2015 from heart- and alcohol-related conditions.

Prosecutors ask victims to file restitution claims against Paul Hansmeier that could add up to millions

As Minnesota "porn troll" lawyer Paul Hansmeier awaits a June 4 sentencing date, when if prosecutors get their way he will be looking at spending the next 12 years of his life behind bars, as AVN.com reported, he now may also face paying his victims back for the money that they paid him-to the tune of millions of dollars.

Those same prosecutors on Monday called for victims of what they called Hansmeier's "sham pornography film copyright infringement" cases, to seek to get back the money they paid him, according to a report by The Minneapolis Star-Tribune.

A federal judge in Minneapolis has sentenced Paul Hansmeier to 14 years in prison for an elaborate fraud scheme that involved uploading pornographic videos to file-sharing networks and then threatening to sue people who downloaded them.
