In europe, the often have fans in pornos for like gangbangs or sometimes they recruit "regular" girls off the street. Say producer meets a girl on the street and she is willing to shoot, does he have to have her tested before the talent bangs her, or is it up to the talent?

^Testing is mandatory for every person shooting porn so those so-called off the street shoots are not real in so far as the girl or guy shooting the scene has to have a valid test. You can't pick up a random person and have them shoot right away.
Then there are the 2257 regulations stating that all producer must have on record the pertinent information regarding proof of age of anyone that appears in one of their porn scene so you can't pick up a random person because he or she is by default unknown and the producer would be breaking the law.
Although the laws may be different in Europe. I'm pretty sure that all reputable porn producers require a valid test the same as in North America so those recruited off the street scenes are just as fake as the ones made here.

^ In the US even amateur porn comes with 2257 documentation. If the amateurs are a married couple testing can usually be dispensed with but otherwise VD testing is also done beforehand. Most have a test done through APHSS, Mike South uses instant HIV test cards in addition to a full VD screen (since Mike is in Georgia and his performers usually don't work the California circuit he does not use APHSS). In Hungary and the surrounding areas VD tests are also mandatory, I don't know about the rest of Europe or the former USSR and its satellites (Don Fernando can tell you more, he works in Europe).

I don't think it makes sense to recruit "regular girls off the street", when you can find available women through some sex agency.
In Germany, Netherlands, Austria, Hungary, and Switzerland, there are no laws against doing this. People are free to organize orgies and gangbangs legally and without being afraid of the police.

Just a curiosity this was case ruled in Italy
Italy is a strange Country , have liberal people and strict bigots ruling also the Pope has power
It is legal to prostitute themselves (in a private form , no brothels are allowed) but in many places it is not to buy , yet a judge states that a non paying client is a rapist
This is interesting because the prostitute was clearly willing , yet it was at condition, if you don't respect your part of the bargain then it's a rape

There's no law about it, but if any of the performers takes anything can sue the producer , directors and so , there's no law who makes the tests mandatory, but laws on safety of workers and working environments could apply.To shoot untested might be seen as a lack of a basic precaution on health matters.
Also no worker perform without testing for his own sake , in the whole Europe even Syphilis tests are mandatory. In Italy it is not by law but as a general agreement as far as I know

she may not know what is to be done nor what are the procedures,the producer certainly is aware of them, a performer taken off the road is, by definition,an amateur, a green , inexperienced and naive , so even if she accepts it is assumed she trusts the producer not to harm her.
Anyway by law is up to the employer to provide safe conditions and healthy environments for his employees, making a sexual scene with untested and unprotected partners surely is not a safe condition.

Because many a regular porn stars are or have been on meth or other drugs , it means nothing
also I believe this thread is meant for regular girls or so not fucked up hookers, also even if they are on meth and are indeed fucked up girls , surely the male talent is not , do you believe he'd like to see his cock rotting?

i also heard alot of girls lie about being on birht control which makes no sense to me. If a girl gets pregnant while filming is the actor or company liable or is it her problem?

According to attorneys I have discussed this with the male would be liable for child support and the producer's insurance (hopefully they have workman's comp) for birthing expenses and doctor visits from time of conception to (conservatively) at least the two-month after birth visit, maybe even all care of the child to age 18 depending on who is reviewing the case and state law on the issue. In some states you also have to consider fornication law which could put all participants in prison (which is also why most porn is filmed in California as they do not have a ban on fornication or porn filming on the books).
I would personally require confirmation from a doctor that the woman performing has had a Depo-Provera shot if I had any doubt about her being on birth control.

I know a TON of girls in the industry that are not on birth control...I for one think that is entirely stupid. I have one child, that is more than enough for me and who would want to have a child with some random porn talent? I stay on the pill!!

Leya, I agree that it is stupid for a woman to do porn without birth control. I have heard of the rumors that certain performers have multiple "abortions" a year (please don't mention names here). I don't know if the producers pay for them or if these performers just budget for them but "abortions" cost over $1000 if you can even find a place to have one (Michigan currently does not have an abortion clinic, South Dakota only has one which their state government is trying to force out of business -- I don't know if LA or SF have abortion clinics or not). Then you have to think about the fact that these performers are essentially killing their babies without even asking if the man involved would be willing to raise him/her first (I would assume the girls having abortions don't want the responsibility of raising a child). I know if I knocked up a girl I would somehow raise him/her myself rather than have it killed by a heartless woman.
I also thank you for carrying your child to term and raising him/her. You did the right thing here as well as using birth control while in the industry. I wish more women in porn would do so. I wonder how many kids long-term male performers such as Evan Stone and Mark Davis have even after the kids that their mothers chose to kill. We have had several performers take time off to carry and have their children in the past couple of years, usually the boyfriends or husbands claimed the children but without DNA testing it is impossible to know for sure (and most are too private to even consider going to Steve Wilkos' or Maury Povich's show for testing, private DNA testing in MI is about $1000).
