Sure the couple may not have known they were being filmed, but they knew they were being watched, and so the observation dynamic is still there. So in a sense, they might as well have been performing for a camera anyway. Yes, some of those couples might be willing to give up the 2257 info etc, but they went into that sex encounter expecting to be watched anyway. Maybe not by thousands of people in other places, but they still expected to be watched. If it's a couple who were NOT expecting to be watched, having sex in the privacy of their own home (or any other location they believed to be private), I just can't see them giving up the model release after learning their privacy had been violated.
