I just received my first two custom notices. Two packages containing DVDs from FiveStar were seized. These were from an order I've been waiting quite a while to be fulfilled because packages kept "disappearing". FiveStar was so nice to reship several times because I never received anything. I asked them for different packaging more likely to get through customs (no declaration of the real price, replacement of the name FiveStar with the name of a person, etc.), but they said they couldn't do that, so packages kept vanishing. Only a few days ago I fortunately received the last missing DVD from my order. Thank you, Ethan & co.
However, the custom notices I received today both contained:
- a standard letter
- the notification of seizure saying there were 4 DVDs in the package containing pornographic material and the number of a paragraph of the German law
- a photocopy of the package (the side with the stamps, address and customs sticker)
The standard letter said that in case a foreign retailer had imported pornography into the federal republic of Germany he committed a punishable act referring to §184 of the German penal code. It also said that now there was a judicial inquiry against the foreign company and that they'd keep the seized items as pieces of evidence.
The last part of the letter told me that I myself, the person who ordered the DVDs, was exempt from punishment.
Well... at least one good news.
Since the customs notices referred to packages that were sent in July (!!!) I'm certainly going to receive a few more of these for all the following packages I didn't receive.
It's a bad feeling knowing they know my name and address and are going to keep the DVDs. Has anybody of you got experiences what the consequences are going to be ? Will they seize every package from FiveStar from now on ? Well, they were obviously doing that most of the time. Or will they open more or even all my packages from foreign countries ? What are the consequences going to be for FiveStar. Why do I read that German customs are going to do everything to punish the foreign retailer although they certainly have no right and possibility to do so in the US ?
What can German customs achieve with a judicial inquiry against FiveStar ?
Any hints or nice words are appreciated :-(
