I'm aware of JM Productions getting an obscenity charge. Then there is also MFX. Is there anyone else out there?
When you get hit with an obscenity charge what happens? Are you forced to stop selling a particular title right away.
Do you go to court and have the chance to defend yourself?
I wish I could figure out what's going on with all of this. MFX's website is dead. It was up for awhile. I hope something really bad didn't happen, but it probably did.
I also heard of some story site getting shut down. I personally don't care about that since that's not porn and should be banned. I guess I should put up with stuff I don't like, but I read that they had stories involving rape/murder of children. I could care less if that stuff was banned.
I also read in the news of a non-nude child modeling site getting shut down. It was run by a man that ran some news agency or something. I think they were shut down because the judge felt even non-nude photographs can be pornographic still.
They targeted American Bukkake 13 as being obscene. What makes that any more "obscene" than the rest?
Can JM fight this? I sure hope so.
I have a feeling we'll be seeing many more obscenity charges in the USA unfortunately. It really pisses me off and can't believe they're doing this.

It's stupid to fight a battle with an indefensible position when there is so much money to be made.
I think 12 jurors from just about anywhere would agree with the prosecutor about any of the american bukakee's and gokkum's flicks.
Get men and women 35yo to 70yo with daughters in the jury box and it's a slam dunk.
About the only way they could pull it off is if they can load the jury with 18yo to 22yo pimply faced men, that have never had a relationship with a real woman. Get 12 of these guys and hand out the kleenex.

All the prosecutor has to do is show the film.... and let the expensive battle begin.... it can be made so costly by taking it film by film that even a win could be a loss in business terms.
All depends if the prosecutor wants to be a zealot, a no-holes-barred, extreme legal bukakkee, all out, no line he won't cross kinda prosecutor.
Either way, I like the arguments...it's all entertainment to me...and there will always be bukakee-cams and films the government mods can't get them all.
It's JM Productions' money...I'm not sure if it's solely their fight.
Well, I'm 33. I've only got two more years to have a daughter and suddenly decide that bukkake is the worst thing in the world......except for spitting, slapping, choking, pinching, biting, puking and sex in general.

This is not personal or how I feel about it's legality...I'm a gambler and I think it's about the odds.
To bad for JM Productions... looks like they have been chosen to take the point.

The government has no business telling us anything at all BUT obscenity cases aren't decided by the government; they're brought by the goverment. A jury of 12 must decide whether or not something should be deemed "obscene". There's a reason why most people try to get out of jury duty; they have lives to live. After arguing unsuccesfully until I was blue in the face as to why I couldn't serve on a jury, the attorney wouldn't dismiss me and I had to serve for 5 days last year on a "Child Molestation" case. In a nutshell, a 20 year old boy kissed the foot of a 17 year old girl when her feet were dangling out the passenger window of a car while her friend was ordering at a fast food restaurant. All evidence illustrated that this was just a horny kid trying to flirt with a girl but her friend called the police and he was charged with molestation of a child. I'm not a genius by a long shot but if I hadn't been on that jury that kid might have done some time and he'd be a registered sex offender now. My point is of course that there was approximately ONE other person on the jury with an ounce of common sense. The rest were simpletons of one sort or another, a few retired guys, several bored housewives etc. and they all wanted to convict and THAT is all it takes to put someone like Jeff Steward or Rob Black away for potentially 50 years; 12 people of questionable IQ's who are PERSONALLY offended. They will make a decision for the other 299,999,988 people in America.

What about a 100 man bukakee while the woman is having a legal abortion performed? You could knock them up in 50 guy cream pie, do all kinds of preggo shots for 7 or 8 months and then, the grand finally. You could call the series " Bad Mommies I'd like to bukakee"

It takes little more than a casual glance through the posts on these forums to arrive at that simple conclusion. Even people who like the same basic things will argue about exactly how it should be done, where it should be done, with whom and for how long. How can anyone even hope to place broad, general restrictions on such an individual thing?
I think that would have a pretty limited audience. I'm sure it's not beyond some people to wish to see such things but in the end, I doubt very many people would even want to film it, profit margins would likely be low and the market would regulate itself.
I don't really care, to be perfectly honest with you. I would have no interest in watching it and therefore, I wouldn't. Abortion is legal (for now). Whether I think abortion should be legal or not is another matter. Bukkake should always be legal as long as the performers are free of serious STDs, are adults and give their consent.
My beef is with the notion that adults shouldn't be free to do whatever they want with their own bodies. That's what it all boils down to. I don't care if people want to get pooped on, peed on, spermed on, whatever. That's what they like (or at least what they've chosen to do) and is none of my business. If someone can demonstrate to me why I should care if my local video store sells scat videos or bukkake videos, people eating bugs - whatever, I'm all ears but I don't see it happening. If I don't like it, I don't have to watch it. Just seeing it on a box cover as I browse through the store isn't going to scar me for life. I see my own bodily secretions every day. If it offends me, I'll get over it by the time I hit the front door.
Bestiality, I guess I can see why that wouldn't be tolerated. Animals aren't people and cannot consent. You do have to draw the line somewhere. I just happen to think (with bukkake, at least) they're trying to draw the line in a place where they have no business doing so.
Well, that's what I meant. It's the government that initiates the process before a jury is even selected. Just saying that a lot of stuff doesn't even belong in front of a jury. The government forces the issue and the jury has to make a decision.
Seriously, we live in a "judicial system" not a "justice system" so there are bound to be irregularities in how certain matters are handled. As I recall it is up to the citizens of the particular area to determine what is considered obscene. If the majority of the general public is likely to find material offensive, then it becomes objectionable to the population as a whole. Bearing that in mind, what might be considered extreme in Peoria or Boise might be accepted as the norm in Chicago or New York.
The key word is "accepted". With the recent tilt of the nation to the right-wing side of the aisle, I'm sure most of the public, as a whole, would find sexually explicit movies and photos disturbing. However, some areas of the country are willing to "accept" these images as honest portrayals of consentual sex between adults above the age of consent. On the other hand, there is a segment of the population who although they are not willing to "accept" these images as the norm, are willing to allow production and ownership of these materials as a right protected by the constitution.
Things get a little fuzzy when companies like JM Production push the envelope to find out what is going to be considered "acceptable". As in DONKEY PUNCH, when is the line crossed between rough choking or a few open handed slaps given in the spirit of arousal before it becomes downright abuse doled out with closed fist and verbal taunts.
From time to time test cases need to come along to give correction to "playing field" and to clearly define what is considered "in bounds" and what is still taboo.

In 1989, Supreme Court Justice Brennan stated, “the Government may not prohibit the expression of an idea simply because society finds the idea itself offensive or disagreeable” (Texas vs. Johnson, 1989).
To date, there have been no significant victories in the struggle of those that wish to restrict free speech on grounds of obscenity.
Therefore, one can only conclude that intimidation and harassment are the main objectives in this case. Therefore, our best defense against future litigious nonsense of this kind may be to refrain from allowing our anxious feelings to be publicly accessible.
Additionally, please -- rest easy. Pornography is protected under the First Amendment, which allows the free expression of all ideas without regard to whether they are right or justifiable. It is a violation of the First Amendment for a government to pick and choose what types of expression are acceptable according to its own personal bias.
They always lose these things. As long as we have a Judicial Branch, they always will.
To be more accurate, they are intended to placcate the Religious Right, which is a huge voting block for the Republican Party. I fully expect any and all (except for stuff like kiddy porn and the like) prosecutions to cease once a Democrat is back in the Oval Office

Here you have several moderators of questionable IQ's who if they are PERSONALLY offended will make a decision for the other members what can and cannot be said.
Why do we find this acceptable here and not in the real communities where we live? We accept building codes of the communities we live in... why?
Why does moderation occur everywhere and in most all other activities and we accept it?
I assume it's for the general protection of the community and it's citizens.

This forum is a privately owned business where we have the right to refuse this free service to anyone. If you are going to insult the people who volunteer to keep the place pleasant and organized then I will exercise my right to refuse service to you.
Exactly what (in this case) is the government trying to protect "it's" citizens from? If building codes aren't enforced, that could be very bad for people who live and work in buildings.
I would still like to know how people sitting around in their homes jacking off to bukkake (or scat, for that matter) is going to harm me personally?
Privately owned web sites can do as they wish with regards to moderation. I don't own this site and therefore, must abide by the wishes of those who do if I want to post here.
I own my house. What goes on in my house (so long as I'm not harming anyone else) is my business. Most people want their houses built to code because they have to live in them and it could be a tad inconvenient for them if it were to suddenly catch fire or collapse.
They are not, however, protecting me from anything by going after adult video. They are simply attempting to inflict their version of morality on me (and everyone else).
Wasn't max hardcore raided over a year ago? was he never indicted?

You are absolutely missing the point if you think my comment was some kind of insult.
The whole point is... if moderation works so well for your private business, keeping it organize and such, why wouldn't those same sensibilities apply in public life and in the public arena?...where after all we are all owners.
Mainly because joining and posting here is a privelege, not a right. The owners of the forum are under no obligation to provide it to anyone, but they choose to as long as certain rules are foillowed. In this country (USA we have rights, that are inalienable...posting in this forum is not one of them.
There are unmoderated areas of the internet (usenet, for example) where you can pretty much post whatever you like, but if you join a moderated forum you accept the rules of that particular forum.
In the country as a whole, there are no moderators, but you are expected to abide by the laws of your particular locale. If you choose not to, you can be punished by the local government, via the police and the courts.
