I've talked to three lawyers and gotten slightly different opinions from each.
One thing that we absolutely must do is stop using outside hosting/image hosting for screenshots. I will rewrite our image uploader to work for everyone.

Personally, I started putting pictures in my reviews about 12 months ago because I felt that it helped the reader to make a decision about whether he liked the look of the girl as well as reading about her performance in the scene. Given the new image policy however, the only completely fool proof way of posting a picture is to post one of the woman's face or a fully clothed photo. In which case, is it still worth it to the potential reader to post such a picture or is it best to just describe the woman and leave the picture out completely? I would be interested in member's views, as well as people such as Picman and CJ who regularly show pictures, box covers in their reviews. [Link] |

It seems that predatory behavior on the net with regard to children has markedly declined in the past few years. Apparently, parents actually talking to their children about these things has an affect after all. Of course, news like this doesn't feed into the media fed hysteria that grips this nation, so it was buried in the middle of the paper and only a sidebar at that. [Link] |

Simulated sex is included, so they are still going to freak. Without more info, its hard for a lawyer to give definite advice. Also since there really hasnt been anyone charged/prosecuted under 2257, we dont even know what is going to be problematic with the record keeping or labeling as well. What exactly is the government going to be nit-picky about? We just dont know yet. It does appear though that every page of a website with an image brought into the new bill will be required to be labeled with 2257 info. Again the best advice I can give is to keep the site clean for now until we know more. It looks like the recording keeping and labeling requirements have just become more onerous. It also appears that they are going to try to ramp up the number of prosecutors and agents assigned to Obscenity and possibly 2257 investigations/prosecutions in 2007. According to a story in AVN by Mark Kernes "The PROTECT Act of 2003 required the hiring of 25 new attorneys for the Justice Department's Child Exploitation and Obscenity Section (CEOS), which also deals with adult sexual material, and the Adam Walsh Child Protection and Safety Act of 2006, signed into law by President Bush last month, requires that, "In fiscal year 2007, the Attorney General shall, subject to the availability of appropriations for such purposes, increase by not less than 200 the number of attorneys in United States Attorneys' Offices. The additional attorneys shall be assigned to prosecute offenses relating to the sexual exploitation of children." Michael [Link] |
