As everybody knows, in USA showing full insertion of a hand in a vagina or asshole is forbidden. But a four fingers insertion is tolerated. I would like to know (assuming anyone knows, this is so moronic) if it is the thumb which must not be inserted or just any finger will do.
There are many titles that feature insertion of all the fingers but as soon as that thumb goes in, then its considered "fisting" and edited out or pixelated for release in the US by most major producers.

Mark - I think I understand what your ? is asking.
I don't know a definitive answer, as I'm sure there ISN'T a definitive answer. However, I am pretty sure that ANY of the fingers left out of penetration would justify that it IS NOT fisting being shown.
FWIW, I've read somewhere that fisting is banned in some areas (and thus in all USA releases, so as to avoid any trouble) because way back when, it was considered a lesbian activity, and so was made a crime, just as male-male homosexual activity was labelled "sodomy" and even hetero oral sex was considered wrong.
no it's not just the thumb. as long as any one of the 5 fingers from a single hand is left out, it's legal. it just so happens that the thumb is the easiest one to isolate. you can put in 4 fingers from one hand and the thumb from the other hand. you can insert 8 fingers, or heck, even 12 or 16 or 20 fingers... as long as it's a maximum of 4 fingers from each hand.
now i could be completely off about this, but from what i've heard, the reason that showing fisting is still considered obscene in some states is because it is seen as an act of violence. yeah, god forbid a girl pleasure herself with her own hand, but putting 5 dicks in her at once (if it were possible) is perfectly ok.
figure that one out.

shameless, as Constance said, the whole fist is viewed as an act of violence. Following that reasoning, two in the ass would also be considered, or viewed, as an act of violence.
It sounds quirky, but the logic behind laws when they are passed, and then the efforts to subsequently uphold and enforce them, are not necessarily logical.

As far as law following life, I don't know of a single country that doesn't have some quirky laws on their books. Laws that don't make sense, and are difficult to uphold.
I reckon England has more than its fair share of ridiculous rules (until recently you could buy a porn mag on a sunday but not the bible). Here are a few laws that have still not been repealed to the best of my knowledge:
It is legal for a male to urinate in public, as long it is on the rear wheel of his motor vehicle and his right hand is on the vehicle.
Excluding Sundays, it is perfectly legal for a York resident to shoot a Scotsman with a bow and arrow within the walls after sunset.
All English males over the age 14 are to carry out 2 or so hours of longbow practice a week supervised by the local clergy
It is illegal to be drunk on Licensed Premises (in a pub or bar).
Mince pies can not be eaten on Christmas day.

There probably is no answer, yay or nay. Since the late Seventies, and that Supreme Court Ruling who's dockett number I forgot, obscenty is based on community standards and also on artistic merit.
Leaving aside artistic merit for a second it would really depend on your community (and how that community is defined) and what the D.A. wanted to waste his time on. I do recall there was a case in Los Angeles County with Seymour Butts last year were they tried to nail him on a obscenty charge for supposed fisting... Eventually though he plead to a misdemeanor (creating a public nuisance, I think) and paid a fine.
Part of the reason the case was pled out to a misdemeanor is, at least I heard, that the District Attorney wasn't enthralled with the idea of spending a lot of money and time in court and the appeals court, trying to determine if a thumb constitutes a fist...Ect. But also it was rumored that no jury in L.A. would really convict anyone of obscenity since our community standards are so loose.
So basically like all things legal it would depend on something that would depend on something else that would largely depend on someone else's interpetation.
But yeah, in most legal parlance a thumb constitutes a fist and therefore it becomes fisting.

OK, I know I waited too long to jump on this thread, but here goes....
Fisting is not 'forbidden', 'banned', or even illegal under Federal law. US producers, for the most part, make it a policy not to show it. Or, if they've shot the footage, to only distribute it in Europe. Their fear, as evidenced by Seymore's experience, is being prosecuted by a city or county.
I can't presume to know why LA County tried to find fisting to be obscene. The 'violence' reasoning doesn't ring true for me as much as a generalized distaste for practices held to be primarily homosexual (as Speelie mentioned.) In fact, a key set of arguments in Seymore's trial centered on whether previous decisions holding that gay (male)fisting videos were not obscene could be used as evidence that the fisting in "Tampa Tushy Fest", between two females was also not obscene.
The reason this was interesting is that for LA County to hold that female - female fisting was obscene and male-male fisting was not, they'd have had to, basically, violate both California, and LA County civil rights legislation, that is, make a legal finding based solely on gender. Also, Seymore's attorney had a number of expert witnesses in the area of human sexuality ready to testify that fisting, while unusual, is not a 'deviant' or pathological practice.
