Do you know if they'll be releasing the XXXX versions or the XXX versions?

I just saw "Poetic Just-ass". It was the first release from PurePlay media. It was however shot before Seymore signed with them. As far as the xxxx version, Seymore was selling this version on his site on VHS. I guess we will just have to wait and see. As long as they release all the stuff with Alisha, Samantha Stylle, Halli, and Mckayla I will be happy!

After having to go through an expensive obscenity trial, I would be very surprised if they released the XXXX versions.

I'm not a lawyer and I don't play on on TV so the question I have is; what are the legal implications if they were to sell the XXXX versions via their web site and not in stores or through the major online retailers?

Seymore's thinking is that he wasn't found guilty of the obsenity charges, therefor this sort of materiel is legal. That is why he started selling the xxxx version of Tampa Tushy Fest. Supposedly there is an unwriten rule that as long as there is no fisting, severe beating causing bleading or injury, beastiality, or ingestion of urine or fecal matter, the gov't won't prosicute.

Seymore hasn't sold the XXXX version of Tampa Tushy Fest for some months now. (or Tushy Girl Lost, for that matter.)

Bill is right that one of the concerns in broadly releasing XXXX material is that it puts the retailers at risk for prosecution. However, there are a number of retailers who know their markets and their legal 'environment' well enough to be comfortable with the more expicit material.

As to the 'unwritten rule', well, that's just hogwash. Prosecutors will take whatever action they think they can succeed with. A Dallas comic book store (owner) was convicted of obscenity for having an explicit Japanese comic in his 'mature audience' section. Avoiding fisting, wet scenes and so on is no guarantee that you'll not be prosecuted for obscenity.

I see that your very passionate about this topic Scott. It wasn't me that came up with this theory. Im just telling you what I was reading during the shole Seymore Butts trial. At that time the question was raised "Why prosicute Seymore Butts and not other porn companies producing more extreme porn that Seymore." Lots of people wondered why Seymore was being picked on when Max Hardcore and Extreme Associates weren't. The reason I kept reading is that Seymore crossed the line in the unwriten govt mandate when he showed fisting in the Tampa Tushy Fest release.

I don't buy into the whole "Bougoizie" mentality. Ive never been a big conspiracy theory person. I don't think the law enforcement and gov't communities conspire to ban porn. I think they are just like everyone else. Some are against it and some are buyin adult dvds like us.

As far as being prosecuted is concerned, obscenity laws are really the only ones that aren't clearly defined.

As far as one person (or group) taking another person (or group) to court (suing them), you're right, people can, and do, sue people for really stupid reasons.

Much of this is the fault of the lawyers who take many of these cases on contingency. If the plaintiff loses, they owe the lawyer nothing, if they win, they give the lawyers 1/3 of the award. Unfortunately, this means that the defendant always loses. Even if they win, they have to pay their lawyer to defend them.

Many people think that when someone sues someone else and loses, they (or in the case of a contingency case) should have to pay the court costs of the defendant. Unfortunately, the people who make laws are usually lawyers. There's not much chance of lawyers passing a law that could cost them money after their political career is over.
