To All, I do not frequent these boards, so I just recently became aware of this slanderous/libelous gossip. I will not go into great depth on advise of counsel now that there is pending legal action. I will however answer the only question out there that deserves addressing. Jessica and I have not now nor anytime after the knowledge of her contracting HIV, had sex of any kind, nor exchanged bodily fluids in any manner, and my long (1&1/2 years) track record of clean tests proves that. Anyone who starts or continues to spread falsehoods will find themselves sitting in a court room. End of Story.
Now that everyone has chosen to blow this gossip way out of proportion, I will respond to the one question that is even worth answering. Since finding out I was HIV positive Shane and I have not exchanged bodily fluids in any manner, and Shane's long track record of negative tests proves that. Shane has been a friend to me when I needed help and could not find it elsewhere. For all of you to point fingers with no knowledge whatsoever shows you for who you really are.

The discussion that's ensued in the other thread has brought up questions that need asking, addressing, ideas that need to be thought of and talked about, important questions about how a whole industry might deal with risk. A case where a specific situation sparks needed discussion (as Drew puts it -adult discussion) and perhaps a chance to talk about ways to minimise harm at a much larger scale. It would be perfect if those discussions only ever had to be had using hypothetical examples. A dream really.
Well, Smartt/aka Planet Sex had a pretty questionable image he kept posting over on XPT, so that would be my best guess. On the other hand, he's in Brazil, so I don't see how suing him over some classy stuff posted on the web is going to work.
Besides, people threaten to sue each other over crap written on the internet all the time. Looking through the thread here on ADT, noone has spread any falsehoods as far as I can see, it's all just speculation and conjecture, noted as such, written in the absence of a statement from the horses' mouths, who we have making their positions clear at the top of this thread..
This starts things off nicely, and I'm glad to see that Shane has responded to the allegations as they're pretty serious. At the same time, all I can say is that for a first impression from both him (and Jessica), it's far from favorable. Was the allegations against him something good? Hell no, and I wouldn't blame anybody who had allegations like the ones discussed here being pissed. That said, one can always take a moment and try to fully engage their brain before hitting that little "Post New Reply" button. He could have just as easily wrote something like "I know there's a lot of talk about the possibilty of sex happening between Jessica and I, and there's absolutely no basis to it. Apparently somebody really has something against me and has drawn my good friend Jessica into it in an attempt to hurt both of us. It's serious enough that we're talking to lawyers about it..." instead of the lawyer and hand grenade approach above.

Like ADT, XPT is a moderated forum. As such, the owners of the site have the ability to remove libelous posts from the forum. That being the case, they could be held responsible for any libelous posts that are on the site.
If someone were to sue, it wouldn't be the individual poster who would be sued, it would be the owner of the website.
Looking at both the Shane and Jessica posts it's clear they were written by the same person. It's rather unlikely that a Czech girl and black American guy happen to write with the same syntax, grammar and vocabulary.
The post(s) does address the one legitimate question asked (are they having sex together) but pretty minimally. I suspect Shane's future co-performers will want a little more than that.
On the other hand I still think it's likely Shane isn't as risky as some other guys in porn, even if he he and Jessica do have (condom) sex. The other guys performing in porn aren't all saints after all. Shane would do better going into a little more detail of what risks he is and isn't taking, and why that's not a significant risk. I personally suspect it would look OK in the end that way whereas this minimalist answers just prolong uncertainty.

For the record, negative test results only prove that one is not HIV positive at the time the test was taken. No more, no less. It does not, however prove with whom one is, or isn't having sexual relations with, and the degree of precautions taken. That being said, if you say that you are not increasing the risk to yourself, and your co-workers, it's good enough for me. I have no reason to believe that you are anything other than an honorable man of integrity, and you are one of the very few other male talent that I actualy like, so the fact that you took the time to dignify the issue means a lot to me. Your response to a very importaint question is very much appreciated, because I (and other talent) do have the right to know. I personally called all 11 girls I worked with during the week I was exposed last year, because it was their right to know. Some took it better than others, while a few wanted to "shoot the messenger", and blamed me for potentialy exposing them. Regardless, it was the right thing to do. Best wishes to Jessica.

Interesting thing (it may be nothing) but the one way in which Shane and Jessica's statements differ is that Jessica's does not specifically state that they are not having sex. It merely states "Shane and I have not exchanged bodily fluids in any manner". It may be just an omission in her statement, but maybe not.
jack-i noticed the same thing. pretending not to notice that and taking shane at face value--can we expect a flurry of press-releases should/when they decide to have sex?

It's not unlikely that the statements were shaped by a lawyer since Shane stated that he'd consulted one. The only thing that matters is whether it's true or not, and unless someone knows for a fact that it's not, should be taken at face value. A year and a half of clean tests means nothing. I don't even know why that would be included. If he ever came up with a positive test we wouldn't be discussing this. His career would be over immediately.

There should be a better way for people in the industry to communicate about these issues with each other - rather than in a public forum. While a public forum may be a good place to discuss the issues in general, it's not a place to assasinate someone's character without having facts (at least it shouldn't be.)
Love your work Shane Diesel and I have no doubt this thing is indeed being blown out of proportion. It's funny how people scream hiv yet they have no problem doing and seeing anal creampies. Doesn't make sense.
