So I've been buying and selling on ADMktplace for a few weeks now and recently, I've encountered a situation where a buyer in the buckle of the bible belt has purchased something from me. On top of that, it's on a military base. Now ADMktplace has a section in their FAQs where they list specific zip codes that they don't allow sellers to ship to - this being one of them. My question is what kind of liability can I potentially face from ignoring this rule and completing the transaction.

Don't put your name and return address on it, then you only risk it getting lost, but that risk is always there.

Potentially, you can get hit with a Federal Obscenity charge. That's what happened to Extreme Associates. A Postal inspector placed the order to be sent to a conservative section of Pennsylvania and then Extreme Associates was charged in Federal Court in the Western District of Pennsylvania. It was a federal charge because the items were shipped across state lines. Even if you live in the state to which you are shippping, federal charges can be brought because the items crossed state lines somewhere between the manufacturer and the final recipient.

Omitting a return address wouldn't help in a situation like this because, in the case of Extreme, they knew exactly who they were ordering from.

On the other hand, if you were to ship to someone in one of these states, and you were 100% certain that they weren't someone working with or for the government, then they can't do anything to you.

I've never had problems getting adult DVD's in the mail. But, then again, I'm not trying to purchase the shit in order to file some trumped-up obscenity charges either.

Judging by your previous posts, I guess that you hang your hat in the Queen City, Fiend?

Too bad for you, man. I'm sure some people in my area would love to put my ZIP code onto one of those no-ship lists, but they know they can't do anything as long as Atlanta still allows all-nude strip clubs. And bottomless clubs are a proud tradition here in the Phoenix City.

I still can't order sex toys over the Internet, though. I have to head over to the Love Shack for those. The mark-up isn't so bad, though. After taxes, everything likely comes out even.
