Has anyone noticed that certain well-known performers are taking footage shot 3 or 4 years ago and marketing it as a new release movie? I think it's short-changing the public.

It may not be the performer, but instead the studio. Certain companies such as Leasure Time, Metro, Pure Filth and Devils Film use the same clips over and over using different titles. The consumer must be careful when buying from any of these.

It's to be expected from companies such as Leisure Time. However, there are a few movies that Digital Playground has put out recently, such as "Jack's Big Tit Show 4", which was released last month, starring Rocki Roads & Julia Ann, who are the first two names in the cast, which clearly included "archive" footage of the two performers.
However, nothing on the box cover gives any hint of this. Actually, since the box cover clearly states "Shot In HD", it implies that both of these scenes have to be new, because Digital Playground wasn't shooting in HD when Rocki Roads & Julia Ann were previously shooting scenes for them.

We should probably clarify what we're talking about...there's a big difference between re-issuing previously released footage and passing it off as new, as compared to releasing footage that has never been seen before.
For example, none of Jenna Jameson's upcoming titles are "new". "I Dream of Jenna 2" was shot back in 2003. However, since we've never seen this footage, it qualifies as a "new" movie.
Anything previously "unreleased" can qualify as "new" footage. Vivid shoots a lot of movies that they don't release right away...they've always been like that.
