Well yeah, it is. On DVDs they get round it by having the sisters not explicitly touch one another. Websites are far harder to govern, hence the more explicit goings on between siblings. Furthermore, it's hard to prove that anyone's actually related if it were to go further (everyone has stage names etc).

Well it has to physically go into shops, therefore it's a physical product that has be accountable to the laws of the land. It's the same reason why heroin isn't sold in grocery shops. As for the 2257 laws... I'm not well up with that... I'm from overseas, but I'd hazard a guess that it's the case that people do as much as they think they can get away with. The physical chance of prosecution I'd imagine, is very small. Someone would really have to take it upon themselves to do the leg-work. I think the concerned parties would just consider themselves incredibly unlucky if it were to go further.

In my midwest state, it's "OK" for siblings to have sex with each other as long as they are both minors and not more than a 3 year age difference. It is apparently considered somewhat normal for siblings to experiment with each other in this way, although it's probably not the best for the mental health of either. If one sibling/relative is an adult and the other isn't it becomes statutory rape, plain and simple. On top of that it could possibly be prosecuted under an actual incest law. In my state incest is defined legally as knowingly having sex with a relative who is closer than a first cousin (half or whole blood) and is punishable by up to 10 years. Since this is a criminal law, the state could undertake the prosecution without the consent of a "victim", but they would first have to identify one of the parties as a victim and then presumably gain that person's cooperation. In the case of a porn video, the state could probably try to go ahead with the prosecution since there is actual evidence (a video) proving that the sex took place, but I'm assuming that such siblings would probably not be cooperative in the trial which might prompt the question, "Why bother?" I suspect that anymore incest laws are probably only used as additional punishment on top of other charges (probably rape). In my state there are 4 felons currently locked up for incest. In 2 of those cases, the incest charge was on top of a rape charge, and on each of these the incest sentence was for no more than 2 years. The other 2 cases are solely incest charges. (It might have been easier for the prosecution to prove incest than rape, so they went that route, and the average length of the incest sentence in these cases was about 4 and a half years.) There may be more people in jail in my state for incest, but that would have to be a sentence of less than a year for them to not be felons. I would be willing to bet that incest is prosecuted far more if the defendant is a male. My state can be uptight about porn/sex work/sexuality, so I wouldn't put it past them to use an incest charge to shut down a porn production company if they wanted it badly enough. We have a tough time maintaining a decent swingers community because of the overzealous prosecutions that go on.
