The community that you live in has determined what's best for it and has establish laws.

Your options range ...you could go public with your outrage at the community, tell everyone you work with, or that visits your business, that you can't jerk-off to porn because the materials have been banned... you could do studies that show the public benefit from having such material available and fight to get the community to broaden it's standards.

You could also move to where most of the porn is made, surely they have no restrictions on it's production and sale.

Freedom is relative to community standards...therefore leaving people free to move on.

I find this especially silly since Austin does not even have a vice squad. Vice prosecutions are pretty explictly off the table here.

Now, a year or so ago the Federal Govt shut down a local porn/drugs/prositution/tax evading store in town. Possibly this is what got the city on the hit list. That guy went down for tax evasion in any case. However, this is not something that local authorities had anything to do with. The owner of that store was a racketeer and he was busted by the Feds.

Austin is the most liberal place in Texas. Lest you think that is faint praise, rather than going after pornographers, our local DA went after (and took down) Tom DeLay.

I find this fairly infuriating since this is not an issue with local porn regulation, it is a mistaken impression by whoever has made the list for the marketplace. I was about to make an order of over $100, all of stuff for sale in town, just at higher prices, when I got blocked for no good reason.

If there is someone official who reads this, I can go down with a digital camera and take pictures of stuff for sale in our local porn stores. Or, if that does not satisfy, tell me what would. I would like this changed.

Don't tell me to change the local government, it is not the problem. The other problem with the typical response of "change the local government" is that the list keepers of these "danger" zip codes would have no idea that the governement had changed. I think that for the most part these lists are based on bad or sketchy, or incomplete information. Heaven knows Austin has no reason to be on this list. There hasn't been an obscenity case brought here in more than 20 years.

I am serious about wanting Austin off the list. What does it take?

Austin is a very liberal town. The police department does not even have a vice department. They have a policy of not being interested in non-violent victimless sex "crimes." The DA in Austin is not going after pornographers, rather he went after, and took down, Tom DeLay.

Austin has many porn stores and I have never heard of one being raided. Rather, the very popular alternative newspaper (whose endorsements are the most important factor for political sucess in the city) has a catagory in their annual "Best of Austin" contest (voted on by readers) for best adult video store.

I am only aware of three obscenity cases involving Austin in over twenty years. Two of them were brought by the Federal Government under John Ashcroft. Both of those involved primarily racketeering and tax evasion charged brought against people who owned chains of adult bookstores. The obscenity charges were Ashcroft's little throw ins. Neither case went to trial. Both men pled guilty as part of a plea bargain. One of those pleas included guilty to a obscenity charge, but that was obviously negotiated between the Federal prosecutor and the defendant. It says nothing about Austin juries or the Austin District Attorney or Police Department.

Both men were tax cheats and were primarily prosecuted for this reason. The grand jury that returned the obscenity charge for the one who pled guilty to obscenity was a Federal Jury in Dallas, it had nothing to do with Austin.

The one other obscenity case involved sexually explicit stuff about gay aids trasmission going out over community access television. I think everyone can agree that the community standards are different for material broadcast on TV vs what is mailed to a home or found in a porn shop.

I want to be able to use your merchants. I spent a couple of hours the other day coming up with an order of over $100 only to find out I could not even set up an account. All of the videos I wanted to buy are easily available in town. I would just have to pay around $270 to get them here rather than ordering over the net.

I am willing to go to a video store and take digital pictures to show what is on sale. I am a non-practicing lawyer so I can probably find any other information you want as well. Tell me what you proof you want in order to remove Austin from your blocked list.
