| Noriinrad Member 185 Posts 3/05 | I understand selling and buying her videos here in the U.S. is illegal. But is buying them from a european or canadian distributor and having them mailed here to the U.S. illegal as well? |

If anything you might be able to find that stuff by wandering into porn shops in Canada and asking about it. Very well it might be sold from behind the counter in some places. Even so it is not legal in Canada and, once you acquire it, if you got caught taking it across the border the consequences would be severe. I am not doubting you can find Traci Lords material, just that it isn't legal in North America, Canada is not Europe. |

There is a legal concept called, 'Ex Post Facto' which means 'after the fact' and it's used when prosecutors try offenders who did something that was legal at the time but was subsequently declared to be illegal. 'We don't like what you did so we made a law against it and now we're going to prosecute you.' Imagine if you live in a state that has a .1 presumed to be drunk law and a driver blows a .09. The offender will still receive some citation, most likely he/she was pulled over for some offense, but drunk driving won't be one of them. Then, the legislature passes a .08 drunk driving law the next week and they try to prosecute you under the new law. At the time of the offense, the law was .1 and that applies, not the 'after the fact' new law that was passed. I don't know for certain if those videos which were legal when I bought them, can get me prosecuted. I'm certain they can be confiscated but I'm not too sure about the legality of ownership. By the way, the passage of time has taken it's toll on those videos. They are much darker now, the videos were OK when they were newer but now it's harder to view them as the picture has deteriorated noticably. I never did try to transfer them to DVD, and I've never transferred any of the 2500 or so VHS videos I own onto DVD. I wonder about the legality of that. |

It still isn't "legal" here and never made it past the Ontario Film Review Board and never would. It may seem legal simply because, for the powers that be it is not worth their effort to stop sales of crappy bootleg tapes when they could go after Max Hardcore videos (for instance).
