I have also Guaranteed Supercenter that we will never use the list, as long as we are partners. In the event of a split in our agreement we have given Supercenter a 6 month quiet period. We are not trying to make DVD Supercenter or any of our other partners into adameve.com, we value each stores unique style and try to play to what we believe to be their strong points. The "Partner Status" Logo that Supercenter displays is one of three different types of Partnerships we have Supercenter will make it more clear regarding Adam & Eve and the list on their site. I guess a free product from my company, for doing nothing but stopping by, and our logo stating we are partners was not strong enough. Actually I would of expected more folks to feel that I should have access, as any partner in any business does. See you in Vegas. |
| Saki At-Large 2087 Posts 11/99 | DVD Supercenter's privacy policy states, in clear language, that they will "NEVER" share "ANY" information with other companies. Unless the meaning of the words "never" and "any" have changed, it seems pretty clear that the fact that Adam & Eve is a separate company and that A&E has access to that information means that DVD Supercenter does not adhere to their stated privacy policy. A lot of people in this forum have expressed concern about receiving unsolicited sexually-oriented advertising via e-mail or snail mail. I'm not particularly embarassed, but I know many people would rather not have their kids, parents, spouses, or postal carriers know that they are buying sexually explicit materials. Nowhere in the privacy policy did it say that partnership with any other company is grounds for transfer of customer information, nor did the offer contain ANY indication that the promotion was sponsored by A&E or that by taking advantage of that offer that A&E would have access to your information (or indeed, by not taking advantage of the offer, since it's unclear whether being a Partner gives A&E access to DVD Superstore's entire customer list). I don't honestly think that an average consumer would be able to see the just see the partner logo and then divine that the free product was from A&E (and not Supercenter) and that by virtue of the offer that they agree to give up their customer information (especially given the privacy policy). I figured as much, but that's because I've chatted with other retailers who have had similar promotions with A&E product. Two more points: First, I don't know why you're so defensive about not turning Supercenter into A&E.com. That wasn't my concern, but now that you mention it, it does sound like you're dictating a lot of Supercenter's business practices (like changing the S&H). Should we be concerned? Second, it's generally accepted in e-business today that release of personal information to non-subsidary companies be governed by a privacy policy that outlines how information is gathered, used, and distributed AND that customers have a mechanism for opting out of third-party communications. Anyway, all I'm saying is that it hurts the credibility of this store (and, unfortunately, those who recommended this deal) when a "no strings attached" offer turns out to be more than what some people bargained for. I took advantage of this offer suspecting that I'd get spammed for it, but I'm not as sensitive about that than others. Saki |

This logo (or a smaller version of it) should appear on any pages promoting items/services specifically covered under the program. The image should be placed conspicuously in the same general area of the items/services on the page. This link could lead to a simple Java popup with a text desciption. Will all A&E Partner Stores be bound by the same agreement? If so then it might be appropriate to have the link lead to description of the program on A&E's site.

We will NOT be including any store/distributor customer informaton has part of the program. The program is designed to promote brand distribution throgh the partner store/distributor.

| Drew Black broken crankshaft 8011 Posts 9/99 | People don't want porn in their mail box. I have never bought anything from Adam & Eve yet my address is now on the snail mail distribution list. I get mail once a month from them. I've never bought anything from Excalibur. (I did fill out a customer profile to test their shopping cart at one point.) I was added to their snail mail list too. I think their mailings are once per quarter. We get tons of adult stuff sent here on a regular basis. (UPS and USPS must think we are real perverts.) I don't mind the unsolicted crap in the mail . (I use the paper to get the fireplace started.) I am certainly an exception to the norm though. Most people want to be unconditionally guaranteed that they will not received adult materials in the mail from any company as a result of browsing or shopping online. |

| Saki At-Large 2087 Posts 11/99 | Just received the free DVD in the mail. S&H was $4.00 when I ordered it. The postage on the manila catalog envelope shows $0.55. Although it was marked "Fragile" and "Do not bend," the only structural integrity was provided by the DVD itself, since it does not include a keep case. On the positive side, the envelope was unmarked. They also included the keep case insert, so with the addition of a $1 keep case, it's pretty much the same as a commercial DVD. The DVD was packaged in a CaseLogic CD sleeve and shrinkwrapped with the cover insert and a postcard for "A Midsummer Night's Cream." Saki |
