Here are my questions in all of this, which pertains to U.S. studios, since in the U.S. you must be at least 18 years of age: 1. What are the studios requiring as far as identification? I've seen some BTS footage while girls are filling out their paperwork, and all they seem to have is a driver's license. It seems to me that if underage girls wanted to work in porn, all that would be needed is fake driver's license. 2. Do [any] studios require more forms of ID such as a valid passport and/or a birth certificate? If studios wanted to try and cut down on government inspections, wouldn't (and shouldn't) they go just a little further in ensuring the use of legal participants.
I can only answer this for (most) European countries. Because of the new ( US compliant ) laws we have, porn companys have to request an ID card / passport and take this on file. If there still is the slightest insecurity ( e.g. models from eastern europe, where it isnt so difficult to buy a fake id ), they check the birth certificate and even try to re-check this. But most EU countries now have the new computerized IDs, that are almost unforgeable. I dont know any case in Europe after 2002, that discovered a company, where a model worked with a fake ID.

Yes, almost all european countries have 2257 compliant or at least nearly identical laws. Suppliers/Distributors CAN ask where you have the id records. And federal authorities can too and do this. For the above queries regarding record keeping. The U.S. law is found in Title 28 part 75 of the Code of Federal [ invalid url ] to address Internet porn. As Shagdog noted, the 6th Circuit recently struck down the existing 2257 regulations. The last time the DOJ was handed an adverse decision on 2257 litigation, they simply went to Congress and asked for new laws, which became part of the Adam Walsh Act. With a new AG in the big chair it may be different this time.
And the republicans aren't in control of congress this time to pander to their base. These laws are not meant fight child porn but to harass porn companies. But still the AG will be a republican and bring something before congress trying to embarrass democrats into passing their pandering law.
If these new 2257 regulations or the "old" ones from 2006 or 2005... The main essence is, that the minimum age for porn is 18. And the producers have to keep records. And this will never be changed. Almost all european goverments now have a conservative attitude against pornography. Even if Larry Flint would be the next US president, the EU wouldnt liberalize the laws again. We started doing that to be able to check that the submitters are over 18, since we do not film the scenes ourselves. When we started with VW there were no laws requiring that. And EU privacy laws are under attack, but not dead yet, especially compared to the US.

That said, I never heard about past customers getting prosecuted for Tove material until recently. And I never heard of Kelly Hoose getting prosecuted for Alsscans images until recently, which is telling. It has held up though. Several people were prosecuted for shooting or performing with Traci Lords and were acquitted based on (my recollection may be a bit off here) the fact that even the federal government accepted her fake ID. I think it was that she got a passport using her fake ID and the defence argument was that if the federal government was duped by the fake ID, how could you hold a regular citizen to a higher standard?

^In this instance I'd say age is less a question of morale and more a question of laws past by elected officials. Some Countries used to allow 16 years old to do porn and now they don't. I don't think those past elected officials were less morale than their more modern counterpart but attitude toward doing adult content changed over time. Once upon a time few American citizens would have had a problem with a teenage girl getting married to a man significantly older than her but that would definitely be a problem today.
That said I don't know that 18 is a good age for anyone to do porn and morale's aren't part of the equation. I just don't think most 18 years old have the mental capacity to truly understand the long term implication of doing something as life changing as porn but since 18 is what the Government deems the legal age for this particular type of work then that's what it is. Yes, it is very sketchy. But, porn is performance. It is likely in most cases that its not actually her 18th birthday when they actually filmed the scene. Even if they showed the ID with the name blurred they could just be pretending they are filming on that specific date.
if a girl contacted them and said "I am turning 18 in 8 weeks can I come down to your studios on that day and shoot" they would be pretty scummy to reply to the email with anything other than " don't contact us until you turn 18".
