im confused... let me start from the beggining
couple years ago when Gape Lovers 6 was released, they blurred the scene where Roxxy Raye fists herself. Fair enough. i thought for some reason fisting scenes werent allowed in America. after that, prob seen a few, but never gave it much thought. Now in January Brazzers released the Adriana/Gabi scene where she gets ass fisted... and is not censored at all!
Another example that puzzles me, the "infamous" (more than famous) Karmen Karma puke scene, wich i read in another post wont be released due to some "advice". And as somebody else stated, how about FaceFucking (or whatever theyre called now, not my cup of tea really) but they make the girls puke by throat rapping em and thats ok?
Guess what im asking is... are there EXPLICIT laws that dictates what sorta sex acts (besides the obvious...clearly not meaning underage, rape...) are allowed or not on movies? would really appreciate if somebody could throw some light for me (and prob many of us) on this topic
Thanks in advance

As far as I know that kind of censorship is a result of:
1. Pressure from credit card processors and/or credit card companies.
2. Fear of the possibility that something like puking or fisting may be considered obscene.
What specifically does and does not constitute "obscenity" seems to me to be very vague. I believe that vomiting, pissing, and fisting were singled out when Max Hardcore was charged. I know that vomit was also one of the things that came up in the case against Extreme Associates.
As for FaceFucking and Duke Skywalker's other, similar sites, Duke's clearly decided that the risk is worth it. Most major porn producers do not concur.
What's this Karmen Karma puke scene that you mentioned?

I am pretty sure the tactic used in the past was distribution of obscene material through the US Postal System.
Online delivery largely negates this and clouds the issue. Obscene is left intentionally undefined by the supreme court from what I understand.

Also there seems to be some sort of distinction between DVD porn vs. internet porn. The producers of DVD tend to self-censor the borderline stuff, whereas the producers of internet porn are bolder. Even the same studio will sell censored/uncensored versions of the same scene, depending on whether it's on a DVD or a website.

A blatantly racist industry charged for obscenity sounds about right.

^I agree that racism is rampant in the American porn industry, but that is a subject for another thread.

I believe fisting has been ruled as obscene when the infamous "Tampa Tusky" issue with Alisha Klass double fisting Chloe Nichole was deemed as such by a court and the movie retired . Here in Europe I found a DVD but it was an American edition printed in 2010 , I was pretty sure it was censored and the scene or at least the relevant part of it, cut out from the movie so I didn't buy it.

IIRC, the ppl that pressed Max, Buttman, JM, etc. with legal action back in the 00s were mail-ordering from states w/ the least permissive policies. (Ashley Blue mentions it in her book I think..) So theoretically, a company could only put out DVDs as filthy as the least porn-friendly state allows.
Websites don't have this problem since fencing content behind a disclaimer puts Liability on the consumer. (eg: “If it's illegal to view content involving [insert awesome thing here] where you live etc..”) It doesn't seem to be a problem for tubesites like efukd or eroprofile (or as mentioned in another thread, youtube, which has a ton of puke related stuff) but that could be because they give it away for free and cut out the credit guys altogether.
So.. my guess is that the prosecution for obscenity leans mostly on mailing / charging for it. I agree Adriano should go the FA route w/ the processing company. There's no reason Duke should have all the fun, right?? I mean, say what you will about the product, he deserves credit for just getting it out there.. There's shit already as filthy as “milkgate” from him on tubes, it's just ugly / unwankable quality..

This putting liability on the consumer means that many millions of Americans are now breaking local anti-porn laws, when they look at Internet porn or download it over the Internet.
And this is where widespread government spying on ordinary people comes in. The government isn't going to throw millions of people in jail. But when government agents decide to accuse you of something, then they can easily get you to plead guilty, even if you haven't done it. Because they can pull out from their surveillance the fact that you've broken all kinds of local anti-porn laws and threaten you with 30 years in jail, or something like that.
When most people are criminals according to the law, then basically these people have no rights. The government can tell them to do anything it wants, and throw these people in jail, if they don't obey. Because these people are criminals anyway.

The short answer to your question is, no. The long answer is; pornography is covered under the first amendment, unless it is considered obscene. If it is considered obscene, then it is illegal. What can be considered obscene changes from town to town, county to county, state to state, etc.
The basic test for obscenity is:
This test came from Miller v. California 1973 and is still, to the best of my knowledge, what is the law when it comes to what is legal and not for pornography. Different studios can make up their own mind on what they decide to release; and what they think they can get away with releasing.
The "Cambria List" was made, developed by lawyer Paul Cambria, on material that was deemed safe to pass the Miller test. Many companies used that during the 80s, which is why so many classics at that time got edited. More and more companies seem to have been abandoning the Cambria List these days and deciding for themselves what to include and not include in a release.

Maybe i am a little bit more "libertine" since i was raised in Europe, but shouldn't this obscenity matter be reduced to "i don't like it, i don't buy it"/"i don't like it, i don't watch it"?!?
What gives other people the right to decide in my stead what is obscene for me to watch and what it is not? (different strokes for different folks).
Also, why would a porn producer, if he knows he is under penalty of law, produce an obscene movie/scene just to blur it, so that he can be again in the boundaries of law? I, as a consumer, get nothing from that blurred moment, so what's the point in that?

In a perfect world this would be the case, but certainly is not. Lets put another example beside America. I think Japan is the weirdest case... they shoot the craziest, outrageous shit u can imagine... YET they cant show genitalia, so they blur it...guess is just a cultural thing

Yes, the Japanese psychology can get very fucked-up (in a good way)
like girls throwing up can be hot, esp if they do it themselves (with fingers or a dildo)and staring straight @ the camera. It's more filthy / fetishy than from a rough beej and it'd be cool to see more stuff like that here. Banks and companies globalize / cherrypick legal and tax systems all the time so I don't see why porn wouldn't..
and Dan, I agree the govt's piling up data to build cases on everyone in case they wanna lean at some point. But I don't think they'd risk the blowback from porn users (most adult americans) to go around busting for goofy shit like possesion (as opposed to distribution)
All it takes is one case of getting evidence thrown out on 4th grounds (or maybe bc it was obtained illegally..) A precedent would be set and then the public could defend themselves, which would defeat the whole purpose, not to mention waste money. They want the Big Fish and not the chum, y'know?
Just a theory..

IMO vomiting in porn is fucking gross, but it's becoming more mainstream, just like anal did in the past dozen years. Perhaps people have gotten desensitized to things like anal and vomit-inducing facefucking is the next step up.

^I'm not sure why you think this desensitization is a recent phenomenon. Were you not around during the gonzo era when Max Hardcore was experiencing immense success?

Some scientists say that the so called 'desensitization' due to porn-watching is a myth. They found the opposite to be true in their recent study.
People get sensitized to sex and to porn, rather than desensitized, after they watch porn regularly.

I recently watched Slutty Girls Love Rocco 8 and I was puzzled to see that they blurred Linda Sweet's pussy every time she squirts! First time I saw anything being blurred in a Rocco movie. And why would they blur squirts? Anyone noticing this and can bring some lights?

The download version is uncensored in terms of squirting. Where did you see this film, and in what format? I know in the UK, 'squirting', urination etc are now all banned.

^Here you go.
From the article: "'Many clinicians claim that watching erotica makes men unable to respond sexually to 'normal' sexual situations with a partner,' Prause says. 'That was not the case in our sample.'" I don't really think that's what I and Derp22 were thinking of, or at least I wasn't.

It's a long article that deals with different effects of porn watching. Perhaps you haven't read the whole thing.
Here is a quote from this article about porn desensitization:

^I read that portion of the article and found it interesting, but isn't Derp22 speaking about viewers of hard porn becoming desensitized to specific sex acts?

Ever since the printing press was invented, those in power have tried to limit what the public can view. French authorities made laws about what could and could not be printed.
Those in power (the F.B.I., operation "Choke Hold") are determined to dictate what the citizens of the United States can read or watch.
A clear violation of our constitutional rights under the 1st Amendment.
We have the right to determine our own "spiritual paths", in other words, we should be able to determine, for ourselves, what we can watch and read in the privacy of our own homes.
Brow beat my credit union to force them to deny my use of my credit card to purchase adult content?
Fuck you. I'll get a money order and continue to obtain what I want.
You can sit there and do nothing, while others are trying to limit what you watch.
Or, you can donate to the Free Speech Coalition and fight back.

Yes, that's what Derp22 was probably talking about. But I can say from my own experience that this is a myth. Because I got sensitized to specific sex-acts, rather than desensitized.
When I was a lot younger, I used to be a tit-man and a pussy-man. Pussy-porn was all the rage for me. But then one day, I unexpectedly saw a guy take his cock out of the pretty lady's pussy and press it against her asshole. He went inside and had a good anal ride. And I liked the way this lady's pussy looked during her anal ride with the guy.
I didn't become an ass-man right away. In fact, I saw some anal films, where the hot lady was clearly uncomfortable. And I swore to myself that I won't watch any anal films again.
But I couldn't forget how hot that lady's pussy looked during her anal sex with her guy. I was still a pussy-man alright. But I was hooked on watching the hot lady's pussy during her anal-sex with a guy.
Now I'm a real ass-man. I want to see the guy go straight-to-anal, all-anal on the hot lady and play her pussy with his hand. Because it's her pussy I'm still watching, after all this time.

Not completely correct. Glimpse can make watesportsmovies in de UK and distribute and sell them from a server in a watersportfriendly country. That;'s what they do right now.
Fortunately there are countries in the world where there is freedom to tape and watch things in the privacy of their own home.
Of course everything that is taped has to be legal age and concensual. This should be the only rule everywhere around the globe.
