Do you have DeArmond also trademarked separately from Dana, or only collectively trademarked as "Dana DeArmond?" If it's the former, then Velma will most certainly have to change her name, as you stated. Otherwise, citing the Elvis/Elvis Presley Trademarked names as an example, as the name Presley was apparently never trademarked separately, anyone can use that name, at least judging by the number of females in the industry currently using the name Presley (IE. Presley Hart). Based on that, if you haven't had DeArmond trademarked separately, then the name Velma DeArmond might not be legally construed as a trademark infringement. Forgive me if I'm mistaken as this is just an observation on my part.

And I hate when people think their name/design/whatever should be a trademark. Sueing others for having the same name (even those born with it)? Speaking of scam... Why are they scam artists? Because this capitalistic chaos is leading nowhere and people still want more and more... while others are starving from hunger. All "I" and "max profit". ^ There's a lot in a name. Any system will have the faults you mentioned. If there was anything that has been the reason for the progress of humans, it's the "I" and "Maximum for Me".

Actually the trademark registered is "Dana DeArmond the Internet's Girlfriend", so as DeArmond is in itself an existing name I assume Velma DeArmond can continue to use it. Though I doubt she will get the same name recognition. And DeArmond has had several trademark attempts mainly as a transducer primarily for guitars. Though most have since been cancelled or expired. thyrium, you are clearly retarded. Dana is well within her rights and I would do the exact same thing in her position. She has been in this biz for a long time and has definitely earned her namesake.
I'm not a lawyer, but you might want to register "Dana Dearmond" instead of just "Dana Dearmond: The internet's girlfriend." My guess is that the issue will turn on whether Velma's Trademark is likely to confuse the consumer. I imagine you can probably use some of the posts on this thread as evidence. But obviously your lawyer would understand the issues far better than I do.
Again, I'm not a lawyer, but my understanding is that the issue turns on how likely you are to confuse consumers in using another entity's trademark. The fact that the Lawyer, author, and guitar maker are not in the adult entertainment business means that consumers aren't likely to be confused. Unfortunately the court won't care that Dana DeArmond has been using that name for her whole life, and in fact, was given it by her parents upon her birth. Ernest and Julio Gallo (of the wine business) had a dispute with their brother, Joseph, who wanted to use his birth name in the cheese business. The winery won, and Joseph Gallo was not allowed to use his own name in commerce. I tend to agree with Dana that a person's real name matters, but the court won't care.

Gee, I don't remember Angel Long and Ashley Long having any issues with each of them using the same last name. Fans kept wondering if they were real sisters, though (they aren't). Oh, the humanity.
^ Angel and Ashley Long aren't sisters? They strike me as looking rather alike. Both of them are quite hot, at any rate! Anyway, regarding the trademark issue, I'm no lawyer either, but from what I've read, there seems to be a lot of grey area as to how these types of cases are judged. It literally can come right down to what district the hearing takes place at. Perhaps a mutual understanding could be reached between Dana and Velma? It seems to me that a name change for Velma at her stage of career (Perhaps something like Darmond, Dearman or Lemond?) would represent less of a headache for her as well. Just a thought.
