Well there's a porn industry elsewhere. Actually most of my numerous porn DVDs were filmed in Europe : UK, France, Germany, Czech Republic, Hungary, etc...
Don't do that. Just make sure you support abortion. The logic is simple. It's usually stupid people who wind up on the abortion table. Stupid people often give birth to stupid kids...who grow up to be stupid adults who want to ban everything because they can't figure out how to close a window and move on.
The problem is the rules for porn are not written down. We all depend on the constuition which give is freedom of speech. Unfortunately we live in a land where a supreme court justice, not a lowly justice of the peace in some small county, once said "I can't define pornography but I know it when I see it." Enough said. Nothing that is obscene is allowed. For something to obscene it has to be found obscene by a court using the Miller test: It has three parts: * Whether the average person, applying contemporary community standards, would find that the work, taken as a whole, appeals to the prurient interest, * Whether the work depicts/describes, in a patently offensive way, sexual conduct or excretory functions [1] specifically defined by applicable state law, * Whether the work, taken as a whole, lacks serious literary, artistic, political, or scientific value.
There is no rulebook only guidelines based on what has been prosecuted and/or found to be obscene in the past.
Basically i would stay away from doing fisting, pissing (sqirting may be ok lol), shitting, animals, BDSM with sex, rape themes, underage themes. These things may not be illegal but are more likely to be taken to court and found illegal.
As far as Pissmops and Yellow Discipline go, they weren't shut down my the authorities but by their owners who got scared after Max Hardcore got busted.
Unless you plan to operate an internet site then your main concern isn't what is legal but what distributors will distribute. It does you no good to make a movie that you can't get into the porn stores to sell.
Obscenity can be tricky. Especially when you distibute across state lines, in that case it involves federal law, and becomes more restrictive. If you only distribute locally and don't mail it can be more or less strict; depends where you are: in some cities it would be obscene to sell a video that show missionary sex in others it would be ok to show very extreme acts like scat play. There is an element of luck involved. The government can't go after everybody so they pick and choose. Also jurys can be very different from one group of twelve to the next. Even if they think an item is legal or illegal based on evidence, they may still vote based on their beliefs. Basically getting into the business is taking a risk just like driving a car without a seatbelt. To minimize risks, eliminate certain states and cities from your market that are of a higher risk using past court decisions or looking at what other adult distributors avoid. Also to be safer avoid sexually explicit conduct involving sado-masochism, defecation, urination and bestiality. Here is a federal case that sentanced people to prison for that:
The key is to look at federal cases because even if you cut out restrictive states you still will come under federal law during the distribution across state lines or using federal mail.
Again even if you showed something mild like an anal sex scene you could get charged, so be comfortable knowing the risks before jumping in.
