I’m not talking about stealing anything. I don’t consider not having to have licenses to play music in films as stealing. Nobody "stole" the Ford Mustang that was shot in the latest film. Nobody "stole" the NY Giants hats and T-shirts that get worn on TV shows, music videos, and films all the time. Nobody "stole" the cell phone that the films character used to make a phone call on in the film. Yet, somebody films a scene where a guy turns on a radio and a song plays for 5 seconds, from a cd that was "legally" bought and paid for mind you (so the artist/company got their money), without all the right licenses attached to it and you call it stealing?? I call it a double standard. Only does the record industry pull this kind of bullshit and get away with it. They’ve been ripping off everybody for years, and are always the 1st to whine and complain when they feel they're not making as much profits as they think they should be. Well in case you didn't know, The Eagles could go on tour and easily make more than enough money to make up for any lack of sales they lose by getting that exclusive distribution deal in Walmart (which I'm sure pays quite well on it's own).

You don’t have to unless what you’re doing will be violating or infringing on the companies trademark and/or copyright restrictions. Usually the issue at hand in films (especially when it comes to cars and clothing) is trademark more than copyright. We’re not trying to reproduce Ford Mustangs, Giants T-shirts, or Nokia phones, we’re only showing them in relation to the film. You don't have to get permission from every car company whose cars are in your shots, or from the makers of all the clothes the people are wearing, etc. There’s a line that has to be drawn at some point or else you can take legal action for everything. The music industry doesn’t want there to be any lines at all.

You tried to make the point that music artists were basically finished and had to resort to selling their albums in Walmart in order to make a buck. You and I both know that's not true and those guys make plenty of money off those Walmart, Target, and Best Buy deals. The fact that artists can't sell the numbers of discs today that they were able to sell 10yrs ago doesn't mean they are going bankrupt. Yes the market has changed, but artists are still able to make a killing despite a drop in cd sales.

In case no one has, lt me mention that several studios/directors use ORIGINAL music that is very good: John Leslie ... organ combo jazz grooves (forget the guy's name but he's a mainstream artist) Jonni Darkko ... composes minimalist techno tracks William H. .... filthy ditties, with crazy Casio-style music Vivid Alt ... usually MySpace bands Justin Slayer ... original hip-hop grooves Van Styles ... underground hip-hop There are a significant number of acts that see porno as a marketing tool, not different from video game placement, ring tones, and other new digital outlets. Joanna Angel has probably made the most use of name rock and hip-hop acts in her DVDs, including Kool Keith, Rancid (I think), and a bunch I can't think of right now ... The truth is, no one pays for CDs anymore, but they will pay for a ring tone ... hahaha. Or perhaps they'll even give away music if it ends up on a bonus disc in a Dana DeArmond Vivid Alt release, since that's a way to reach an audience where, ahem, it really counts .... hahaha. It was on the tip of my tongue. There is a bonus disc of music (I think) that comes with the Brianna Love DVD. Again, smart use of porno to market your music and a smart value-added move for the studio. Darkko's "Bikini Sluts" also has a music disc. but the issue isn't the use of ORIGINAL music....its the use of POPULAR music.. from what i gather it doesn't seem to be a money issue (on the part of the record industry) but a MORAL issue (which is funny and ironic)..the porn industry generates more money than major sports in america damn near combined..
I'm not sure producers of porn would be able to license popular music, because of the cost and because artists may not want to be associated with porno. BUT ... Joanna Angel DOES use popular music, actually. Joe Gallant, who shoots his own stuff in New York but has been distributed by Hustler, is a composer as well ... It's jazz, but he used to fill nightclubs so I think that counts as popular. Also, don't forget that a lot of hip-hop stars, including Snoop and others, have worked out arrangements to appear in and produce music tracks for porn movies. So, maybe I'm missing what you think you're argument is about, but according to the topic line, popular music IS used in porn ... to a limited degree. However, even if mainstream stuff was available, I doubt studios would spend the money to license it.
I've happily paid list for several different versions, including a great one by the Los Angeles Saxophone Quartet -- a recording originally made for LPs which (back to the topic) is no longer in print on CD (or otherwise) due to current market forces.

For some reason "Several Species of Small Furry Animals Gathered Together in a Cave and Grooving with a Pict" by Pink Floyd turns up in a lot of 70's features and loops.
Year's ago, before VHS, someone made a porn called "Ladie's Night" starring among others, Annette Haven. In one scene, Annette fucks two guys while the Kool and the Gang song, "Ladies Night" is playing. I'm guessing that is the reason why it's not available on DVD-- they probably got hit with a "Cease and Desist" order.
