Last night, I had the misfortune to watch Jackass 2 (distributed by Paramount Pictures) and was struck by a couple of the gags that would likely have the feds confiscating tapes if the same gags or scenes were duplicated on a porn set.

In one, a member of the Jackass crew drinks a cup of horse semen after jerking it off with an artificial mare's vagina and in another, one of the guys shits onto a miniature toilet. You see the excrement falling and the whole nine yards. There was also a scene with a guy shitting into a funnel.

I have absolutely no interest in scat or animals, but how can Hollywood do this while porn can't (at least in the U.S.)?

That is a truly, excellent question.
Shame it has taken a year to get answered.
Butt if I were to answer it, the only people who would know what I'm talking about would be you and me. And that includes everybody else on the forum.

Because it's not in a sexual context.

Actually, the real answer is that the government hasn't thought about it. Frankly, having not seen the movie (really? Wow, I must have missed a real epic) it sounds like it would fail all three prongs of the Miller test.
I think a willing prosecutor could make a strong case that the horse semen business appeals to prurient interests. And there's obviously no social or artistic merit.
But because it's a mainstream product from a mainstream producer, it will never be looked at in this context, and that's the key. Context. This is a male-dominated society, and because it's a bunch of fuck-off slackers doing stupid shit, no one cares. It could be exactly the same scene with a woman, and people would be screaming "bestiality."
It's nothing to do with what passes for obscenity law in this country, and everything to do with social structure and perception.
That's how we "get away" with having the super-hardcore scenes we have in the director's cuts of Corruption and Upload; You might not like the story, or how it's presented, but you can't deny it's there. Both movies very clearly have artistic merit, which makes it virtually impossible for them to be found obscene.
It's all about context, not the actual act.
