From what I was seeing the debate had moved on and it had become inflammatory. Talking about how to fight piracy is great and why I continued to let the other thread continue for a while despite it continuing to go back to the inflammatory remarks hoping that it would go back on track to fighting piracy. When it kept continuously going back in the other direction, it was time to end it. This is a debate that effects us all but some of what you have been debating has been beaten through the ground at this point. Again, if you would like to continue forward and keep off the pratfalls that caused the demise of the other thread, you can continue discussing how to combat piracy.

The stores are fighting back against the Producers.
Like I have said on here before I do sells for my own company so I talk to the store owners myself. This is what a store owner told me about a week ago. Forget Tube sites for a minute people still want DVD's and the producers/Studios/Distributors are fucking over the stores by giving there entire library away online for $29.95. Most studios have there own site where you can down load every movie for the price of 1 DVD. He said the studios themselves got to greedy and destroyed the value of the DVD.
1st Example he gave: The studios go to all the shows and sell there DVD's 3 for $10.00 to the public then the distributor or studios call the stores and sell to the stores the same DVD's 1 for $10.00
2nd Example he gave: For his store Milf Hunters was the most popular line of DVD's he carried, but customers told him you can get the entire library for $29.95.
So the store owner signed up and downloaded every single movie they had on the site. He said he downloaded for 30 days straight but got every single movie that was affiliated with Milf Hunters for the low price of $29.95. Now he makes his own compilations at home and sells the DVD's in his stores at 2 for $10.00 this is what him and other store owners are now doing.
Him and his friends that are store owners say they are fighting back, and say fuck the studios and distributors that are taking them out of business. He stated that he has made his $29.95 back a hundred times over.
That call made my day, FUCK!!!

Interesting how this group of store owners are 'fighting back' by contributing to the Piracy that created a big part of the problem in the first place.
"I don't like how you sell to me, so I'll steal from you instead" seems like a particularly moronic approach. What I wonder, is why these stores aren't supporting the studio's and distributors who go out of their way to help the Store Owners.
Premiere Group advertises tons of free promo items for Store Owners. So do many others. The 'MILF Hunter' people are Reality Kings, who are label mates with Maddy G Productions at Pulse, and while I can't speak about their deal, our deal doesn't give Pulse any control over our web site, or our retail pricing. So whatever's going on over at their site, is more than likely NOT the fault of Pulse Distribution.
Our web site only offers streaming in the member's area, and we stick strictly to 'Suggested Retail' pricing on our DVD's, allowing many store owners the ability to out price us. And when they do, we aren't shy about sharing that information with our fans - coupon codes, special deals, etc. We tell our fans about them thru social networking, Facebook and Twitter. And we offer everything from posters and product giveaways, to in store appearances. All for free to the store owners who ask for them.
My point is, instead of breaking the law in an attempt to punish The Studio and Their Distributor, maybe these store owners should put their support behind the studio's and distributors who support them back.
It's good for everyone - including the fans who deserve to get quality product for their money, not some bullshit DVD downloaded off the internet. And it sends the right message to the Studio's.

I would have to remind the store owners the content online is usually compressed to 1000 - 2000 bits per second in order to make DL times somewhat manageable.
A DVD that was compressed that much it would look horrid on a TV set -- like watching a couple fuck through a fish bowl. I'm surprised their customers come back for seconds.
Finally, I still can't get over peoples' rationale for stealing. They're nothing more than thieves, and if it wasn't for the "I don't like how you sell to me, so I'll steal from you instead" reasoning, they'd find a different reason to rip us off.
I'll say it once -- I'll say it a thousand times: we're the "bad guys", so people will steal porno and not feel bad about it. But I wonder, as they're cleaning the jizz from their hands, if they feel a little guilty about it then.

The store owner is full of shit. He ripped it to DVD once, saw what it looked like on TV, and then started duping the DVD's -- DVD to DVD. There's no fucking way one customer would pay for a ripped DVD from a web site. They might once, but they'd bring it back and want a refund.
DVD guys are still pretty much I-watch-porn-on-TV guys, right?

That was 5 years ago. Nowadays you get scenes in 1080p on most sites and they look 3 times better than the best looking porn DVD ever did!

There's no way you're getting true HD 1080p DL's. No way. They can make claims as to "DVD quality" and "hidef", but they're still compressed a bunch in order to keep DL times manageable.

that is a deplorable practice, and if you are selling product in any of these stores, you need to stop. if they are willing to pirate other producers' content, what makes you think that they won't do it to yours?
retailers like this need to be shut down, because their illegal actions negatively impact content producers, distributors and end users.
note to other content producers: this type of piracy continues out in "the open" in retail settings and on ebay.

you're wrong. i own a/v stores, adult stores and am a IP theft consultant.
remember the scenario CK described. the proprietor is downloading scenes and creating compilations. not necessarily full featured DVDs with menus, BTS, etc. so the scenes don't have to tremendously compressed.
armed with a membership to any of the popular file-sharing services, were i so incline, i could get DVD rips of any title and they would look fantastic on an HDTV display.

I know this is real bad news, I was sick hearing him tell me the procedure in detail.
But I understood him explaining how at the shows the public can buy 3 for $10 Then the distributor calls him trying to sell the same DVD 1 for $10
The middle man in our industry AKA the distributors Really needs to go. That's why I'm doing everything myself these days, and biz is way better because of it.

even if the quality isnt perfect which I dont know b/c the arguement seems back and forth, its free. I think thats all that matters to most people that d/l, its free. You dont have to spend a dime, go out, order anything, no credit cards. You are battling human nature so I dont really see how anything can be done about it, the flood gates are wide open. I'm surprised CDs, DVDs, books or anything else that can be downloaded are being bought at all and I'm curious where it will all go. When all the companies are long gone and broke,thge products arent being made, what will people download?
and people individually rarely feel like they are the one fucking it all up and can always justify it

Getting back to the discussion here, the truth is you CAN get better quality on the web. encoding techniques are what makes it possible.
even bluray still use the old mpeg 2 encoding albeit with a much longer GOP
the newer (and way more cpu intensive) H.264 aka AVCHD can deliver the same quality at about half the file size and most players these days will make use of the GPU in your graphics card to play these videos. I offer HD versions on some of my sites that will play on your PS3/XBox360/Wii or bluray player and if you have an HDTV they are far superior in quality to the DVDs you rent at your local video store. Are they true or full HD yes they are, by definition anything 720P or higher IS True HD. But getting away from generalizations as to what is/isnt HD the net is WAY more capable as a delivery mechanism to most people. In reality if you have say comcast 16Mbit connection (I have 50 mbit) you can download a full 1080P bluray dvd in less time than it would likely take you to go to the store and rent it.
TVs with internet connections are starting to appear and so long as the net stays neutral the cable companies are going to have to rethink the way they deliver Television because paying 100 bucks a month for HDTV in the day and age of Netflix instant queue and Hulu, Crackle and others is just plain wasted money.

On a sidenote: Music CD's are at an alltime low, bands now see them as just a promo, for giggs! Live music is back bigtime! Here in London, the O2 arena is selling out and making bands tens of millions of pounds, Jacko was gonna play 50 nights and make $50 million. I see the sex industry going the same way, people always want more, whats more that you actually fucking the porn girl of your dreams! You can find most of the UK's top porn tallent advertising on the net at rates of around $200-300 an hour, the girls can make more money from escorting than porn!

The store owners could also be lying about buying a sub to the site at all and instead just ripped the retail DVDs they had in stock. If so, quality wouldn't be too bad.

No, you are wrong. Maybe you should check out some of the sites offering High Def. Some are heavily compressed, yes, but many aren't. Brazzers have 1080p downloads on their site taking up more than 3 gb per scene. It is flawless quality, I'm watching this stuff in my home theater with a big screen so I should know.
And even a heavily compressed HD video on the web will look better than many of the porn DVDs out there so really quality isn't a benefit that DVD producers can rely upon anymore, it is quite the other way around.

desperate, unethical store owners will use every shortcut (both legal and illegal) to cut costs, so you're likely to see any number of piracy techniques employed.
for hard/physical piracy, distributors can tell fairly well who is pirating retail DVDs and who is not: the buyer who ALWAYS buys 1 of a number no matter how well the title sells in the same region.
the time for EVERYONE along the food chain to STOP turning a blind eye to poor (and illegal) business practices passed us by a long long time ago.

I wonder, seriously, how well some of the tube sites would do if they had only their content to rely upon. It seems pretty low to steal from others and then hide behind a lax DMCA policy.
That's hardly a level playing field but there will always be people to argue otherwise.

In my neck of the woods, I know a retailer who admits and defends renting and selling burned copies of DVDs. His box covers are obviously home-made, so on the rare occasion that I do business with him I can easily pick the original DVD to rent. I only go there when there is a title I can not get from my favorite retailer. However, I refuse to buy from him and if I really like one of his rentals, I buy it from one of the retailers who only sell.
Several years ago, I purchased a VHS video from a prominent "discount" retailer in the Washington DC area. The retailer denied it was a copy, but after an extensive argument, he gave me a refund. As we all know, this is the last thing a porn retailer would normally do. I think he did this becuase I was more angry about his piracy than me losing money and that I would have been happy to turn him in.
I am a TV viewer hobbyist and I demand picture quality. There is no need to stop now, I can remember the rush I got seeing the actual texture of Annette Haven's skin the first time I saw a scene in a porn theater in 1980 (I was under age). Whatever the prevailing medium is, I will not settle for low picture quality, because high picture quality has been available for 3 decades. I did not begin to watch DVDs until 2004, when the quality began improving on a large scale.

On my connection (which is a pretty run-of-the-mill cable modem connection) I can download a 3GB movie in 19 minutes, assuming the source has enough bandwidth to allow me to saturate my pipeline.
For those of you reading this thread who are unfamiliar with compression types and download speeds, the following list breaks down how long it would take someone with a 20MB cable connection to download various quality movies:
Standard Quality DVD Rip - 700-900 MB - 5 minutes
High Quality DVD Rip - 1500 MB - 10 minutes
h.264 HD rip (720p) - 2500 MB - 16.5 minutes
h.264 HD rip (1080p) - 4000 MB - 26.4 minutes
DVD Image - 4700MB - 31 minutes
Bluray Image - 45000 MB - 5 hours
While on the topic, I'm going to back up Prophit and say that on my 61" HDTV the 1080 content from many providers, including Brazzers, puts DVDs (including DVDs put out *by* the companies providing the HD content online for download so it's from the same source) to absolute shame. DVDs look like shit by comparison.

I'm with the others here. I subscribe to several websites that shoot in HD and post their content in HD. Some of them, like FTVGirls, the HD downloaded images look BETTER than 95% of the DVD's in my collection, exclusive of the few HD-DVD/Blue-Rays I own. And even there, its porn, not Avatar, so the difference is negligible.
With current compression and codecs, plus an abundance of internet media players that hook up to the Plasma (Xbox, PS3 or dedicated machines like a $119 Western Digital Media Player), you've got the ability to download anything and stream it to your big-screen TV.

'Porn Industry' is a misnomer.
For the most part it's not so much an industry as a disparate bunch of people with cameras, some more adept at production and sales than others, but all of them out for as many bucks as possible without a thought to creating a lasting, successful venture.
Sure there are exceptions to this, but not many. Contrast porn with any other 'industry', the soap making industry, or anything else, I don't care.
Procter a Gamble has an R & D department spending big money to improve their soap, to come up with new sales gimmicks and advertising. They are motivated politically to gain tax advantages and such; to influence grocery chains to give their product prime shelf space. They maintain close ties to all other soap manufacturers to present a united effort in favor of common goals.
Now to porn. In the nearly 40 years of its quasi-legal existence, I am unaware of a single orginization that represents the interests of the porn industry, that exerts political influence to stop its random prosecution for example, or itself prosecutes people who unlawfully steal its products by broadcasting them on the 'net.
I am unaware of any system like those of other manufacturing companies that control who sells their product and for how much. The porn 'industry' does not even keep track of how much money it makes: information that, if published and verified would increase its political clout as a tax payer and employer with a large voting customer base.
The porn 'industry', for the most part, puts out the same dreck year after year. It takes little or no action that I am aware of to finance or develop new technoogy to prevent piracy or improve the experience of vicarious sex that is their product. Instead of putting profits back into the business to improve it and make it therefore MORE profitable, they put their profit in their pocket. Then, the people in the business come on ADT and whine about pirates and sex tubes and unscrupulous stores.
Until porn makers realize that a business is about a lot more than making a few bucks and going home; until they start working together for their common interests and being more than the passive victims of every crook with the willingness to steal from them and every sanctimonious jerk who thinks their product is immoral, and until they take what they do seriously enough to make it better, they themselves are the reason 'porn is dying.'
It won't, of course. It won't die. It will change. And, when someone comes along with the guts and savvy to make it, in fact, an industry, I'm sure it will prosper.

I think soap isn't really a great analogy here, cause soap is way more complex than porn. We could go back and forth just on that alone, but let's skip it for now.
I want to see if I'm understanding you here: Big Corporations "maintain close ties" with their few competitors over "common goals"? I just don't see that. The only "close ties" I can see if when, say, Pepsico "maintains close ties" with a large chain of Mexican fast food restaurants so they can buy them.
Quasi-legal? LOL. Uh huh. The porn industry's real problem follows: the people who hate it most also consume it the greatest. If I sell soap, and lots of it, I can hire lobbyists to make sure I'm represented in our nation's capital to make sure I can (for example) maintain my sudsy luster while killing all the critters in the lake near my soap plant. Then, as a soap lobbyist, I can go home, beat off like a monkey in the zoo to my favorite dirty web site, just like the Senator who I greased. The same Senator who's fucking his 17 year old male staffers. The same Senator who's leading an investigation into obscenity in porn -- to shut it down. There's no way adult entertainment is ever going to have a lobby in DC, cause the politicians know their voters won't have that. The same voters, I might add, who just logged off Tube 8.
Well, now you're living up to your name. Funny you mention this, Duefuss, cause today I'm sitting down to work on Quickbooks, cause I got 1099's to file, and statements to balance.
What you need to tell everyone here, Mr. Smartypants, is there are no publicly-held porn companies. Unlike Proctor & Gamble, who have to report to their shareholders, adult entertainment is private business. Which means the way I do biz, like all the other fine folks I compete with, is none of your biz.
Now you're getting somewhere. Are you one of the guys who jerks jerks jerks and then gets all guilty about your bad behavior? Like, maybe, the Senator or a Lobbyist I mentioned earlier? Are you a failed porno producer? One that liked to make "real films" with stars like Jenna Jameson blowing up pirate ships off a beautiful tropical island? That's the way I'm leaning, just cause you're a member of this forum. Either way, I laugh at all the guys who bash the industry over shitty quality -- yet lurk and/or participate in forums like this.
In the meantime, I'm off to do a gut check...so I can work together with Apple and Microsoft to see how they can perfect their operating system so the people who create entertainment -- from mainstream to adult -- don't have to suffer seeing their intellectual property being ripped off anymore.

You seem to be too hung up on the soap analogy. I said that it didn't matter.
And what I said about porn not really being an industry still goes. Industries DO in fact set up organizations to work for common goals. Aetna and Blue Cross are competing health insurers, but that didn't stop them from working in concert against Health Care Reform. Porn is NOT that kind of industry, but if it wants to prosper, perhaps it should be.
YES porn is quasi legal. It is in the unique position of being openly available everywhere in shopping centers and the like, legally paying tax on its profits, employing thousands, and, AT THE VERY SAME TIME, even now, being prosecuted as a crime. If that's not quasi legal, what the fuck do you call it LOL?
As for the hypocrisy of porn's customers, that is not the issue here, but you are welcome to visit my view on the subject if you like reading lectures.
I repeat that there is NO published verified data I know of on the actual size of the porn industry. If you think that company tax returns can be culled for this information, you need to bone up on your Federal law; tax returns are confidential - even yours- unless you are an elected legislator have a search warrant obtained for your records, or are the President, etc. Perhaps I'M not the one that's living up to my name here.
It is precisely your attitude that your business is private that hampers you and your fellow porn makers. Other businesses compete with each other for sales, of course, but they recognize that, whether publicly held or not, there's strength in numbers, that that they are not competitors in everything, but share common problems -- like piracy and unfair prosecution -- that together they can combat far better than they can alone.
No one says you have to open your private affairs for public perusal, but providing meaningful data that can be collected into a generally accurate picture of the industry's size (and therefore its importance and political influence) would go far toward eliminating porn's semi legal status. And knowing how big your business is won't hurt it any.
If you don't believe me, witness the history of the tobacco industry in this country, whose size and importance, which they made very sure to publicize, allowed it to knowingly sell poison to the public for decades with impunity, before finally succumbing to public outrage.
So I stand by my original points.

I'll disagree with you on porn's legality (and skip obscenity laws), as well as Big Business being so nice to each other, and I never said anything about Federal Tax laws (I was just replying to your comment on how we don't know how much money we make) and I'd write a whole lot about more about what I think, but I can't; I've got something else to do today -- work on my sarcasm skills.

I think we all want to see porn prosper, if, perhaps for different reasons. Insofar as fans and makers have that common goal, I'd sure like to see them join together and do all they could for our COMMON benefit.

When you watch pornography you are not getting sex for money, you are paying to watch people have sex for money. Pornography can also be completely fictional, there are pornographic comics and pornographic novels and short stories. Prostitution is related but not the same thing as filmed pornography.

Just for your information, there are several publicly traded porn companies, including the biggest of them all, Beate Uhse.
And in other countries than the USA there are organisations of porn companies, like the BEH in Germany and AITA and UKAP in the UK.

I'm curious. Is porn subject to the same criminal prosecutions in Europe and the UK as it is here? I would think not since it was 'in the open' in much of Europe long before it was here, and I suspect it is far more organized and politically influential there because of that organizations you mention.
